You have our approval, in accordance with the attached conditions, to place fill in 0.014 acre of vegetated wetlands in order to
construct a single-family residence on your property near Roper in Washington County, as described in your application received by the
Division of Water Quality on June 11, 2002. After reviewing your application, we have determined that this fill is covered by General
Water Quality Certification Number 3371, which can be downloaded from our web site at http:Hh2o.enr.state.nc.us/ncwetlands . This
Certification allows you to use your CAMA Permit when it is issued by the NC Division of Coastal Management. In addition, you should
get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion
Control, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying CAMA Permit
expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your project, you
must notify us in writing and you may be required to send us a new application for a new certification. If the property is sold, the new
owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total
wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC
2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60
days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter 1508 of the North
Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its
conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you have any

8. PROJECT SUMMARY: The applicant proposes to fill a 404 wetland area, fill slope and grade uplands,
modify the existing drainage system, and construct a single family residence.
Frymier/Martin Beach Cottage Project
Washington County
Project setting
The project site is located off U.S. Hwy 64 on Mallard Cove Road, adjacent the Albemarle Sound near
Roper in Washington County. A review of our Archives Topographic Maps indicates that there are no historical
or archeological sites within the project area. The site is a 0.8 acre tract of land owned by Paul D. Frymier and
Kerri Frymier-Martin. The property measures ±100' along the Albemarle Sound shoreline and extends ±350'
landward of the shoreline. An existing bulkhead provides shoreline stabilization. A ±1,600 ftZ depression
located ±40' landward of the Albemarle Sound shoreline has been delineated as 404 wetlands by Tom Walker
of the U.S. Army Corps of Engineers (USACOE). A copy of the USACOE Notice of Jurisdictional
Determination is included in the application package. The vegetation on the site consists of scattered pines
mixed hardwoods, and upland grasses.
The site and surrounding properties generally slope from south to north (toward the Albemarle Sound)
and from west to east. Surface run-off from adjacent properties to the west of the site are directed through an
existing ditch and 8 inch drainage pipe down the west boundary of the site. The drainage line ends ±85' from
the Albemarle Sound. The surface run-off then sheet flows east into the depression that has been delineated as
404 wetland. Under high flow conditions, the surface run-off continues to sheet flow to the east, off the site and
into an existing man-made canal.
The Albemarle Sound is classified as "SB" by the Environmental Management Commission, with "best
uses" being primary recreation, aquatic life propagation and survival, fishing, and wildlife.
Project description
The applicant proposes to fill, slope and grade a ±15,000 ftZ area from the existing ±100' bulkhead
landward for a distance of ±160'. Included in this area is ±1,600 ftZ of delineated 404 wetland, ±600 ftz of
which is to be filled. The remaining ±1,000 ftZ will not be altered and will continue to function as wetland. The
drainage system will be modified as follows:
the existing 8" drainage pipe running along the west boundary of the site will be extended ±60 ftZ.
2. the drainage pipe will then turn east and run under the fill material, directing surface run-off into
the remaining ±1,000 ftZ of 404 wetland.
3. a "highwater overflow" pipe will run north for ±40' from the remaining wetland area, through
the existing bulkhead to provide drainage during periods of heavy rainfall or high tides (wind
driven) coming over the bulkhead..
The applicant also proposes to construct a single-family residence on the site. The residence is to be
located ±150 landward (south) of the Albemarle Sound on grassed high ground.

Anticipated impacts
The project as proposed will result in the filling of ±600 ft2 of 404 wetland. The proposed drainage
system design (particularly the highwater overflow pipe) will modify the existing drainage pattern.

We propose to fill an area (approximate overall perimeter dimensions 160 ft long by 100
ft wide) at the front of a lot adjacent to the Albemarle Sound in Roper, North Carolina in
the Mallard Cove area. The lot is bulkheaded on the north side, adjacent to the Sound.
The lot is roughly level (see original plan view) with a small low area near the north edge
of the lot. Water from a grove of small pines across a marl road on the south side of the
lot drains onto the lot through a small culvert under the road. Currently, the water runs
north down an open ditch (see drawing 1), through an approx. 30 foot length of approx. 8
inch drainage pipe, and then exits the pipe and follows the contour of the ground to the
east, enters another short piece of approx. 8 inch corrugated drainage line and then spills
out onto the front of the lot, forming a small wet area during periods of high rainfall
(typically the winter and spring). The area was delineated by Mr. Tom Walker in the
Washington, NC office of the Army Corps of Engineers (see drawing 1, total area of wet
area approximately 1600 square feet). A copy of the letter from Mr. Walker attesting to
his delineation visit is attached.
We propose adding two additional sections of drainage line and fill material to allow the
northwest side of the lot to stay dry, while maintaining the wetland portion closer to the
east edge of the lot (see drawing 2). An overflow drainage line will be added to allow
water to flow out of the wetland area to the Sound in the event of high water coming over
the bulkhead or during periods of unusually high rainfall. The wetland area is saturated
in the late winter and spring but essentially dry during most of the summer months. The
result of the added sand and drainage lines will be to fill about 600 sq. feet of the wetland
area on the northwest side of the lot. We will be building a small, single family cottage
on the upland portion of the property (see drawing 2 for location and footprint).
Also attached is a drawing of the lot showing the adjacent property owners and the
location of the property on Hwy. 64 in Roper, NC about 1-2 miles west from where Hwy.
32 splits off at the "Y" and heads north for the Albemarle Sound Bridge.
