PROJECT SUMMARY: The applicant is proposing to modify a portion of State Permit # 149-98 in order to construct a 2-story building with a partially covered deck and a floating dock. FIELD INVESTIGATION REPORT: Georgi K. Coffin PAGE #2 ------------------- 9. NARRATIVE DESCRIPTION: The proposed project is located in the central business district of downtown Wilmington along the Cape Fear River between Muter's Alley and Orange Streets. The project was a coordinated effort between 5 property owners and the City in an effort to bring about the redevelopment of the project site in such a manner as to provide for enhanced public access to the public trust area represented by the Cape Fear River. This allowed for the consideration of such features as impervious/pervious development which would not be available if the properties had been developed singularly. The property in question was originally identified as Parcel Four. Parcel Four is approximately 100' by 50' in size. The parcel is covered by existing concrete slabs and other impervious material to such a degree that it is considered to be 100% impervious. There are several relic pilings along the shoreline which appear to be the remains of a previous dock. The shoreline is lined with rock rubble at present beginning at the upstream property corner and extending along the shore until it reaches the remains of what appears to be a rock crib. At this point there appears to have been an attempt to stabilize what is left of parcel four and the City park to the south with a poured concrete apron. There are scattered plants along the shoreline but no significant wetland species. The waters of the North East Cape Fear River in the project location are classified as SC by the Division of Water Quality and as a primary nursery by the NC Division of Marine Fisheries. There are no shell fish resources located within the project area. There are pockets of coastal wetland and other plant species irregularly distributed along the shoreline in the vicinity of the site. Water depths in the river of approximately -12' mean low water are present approximately 45' waterward of the NHW contour. Originally a one-story building was proposed for this site. The building measured approximately 97' long by 40' wide. Approximately 5' of this proposed structure was aligned waterward of the Normal High Water (NHW) contour. A deck approximately 95' in total length was proposed on the water side of this building. This deck was shown as 20' wide for, a distance of 80' along the front of the building and then was to taper down over a distance of approximately to a width of 0'. This entire structure appears to be located on the waterside of the NHW and it too appears to have a dual purpose of both public and private access. The City's riverwalk feature was to extend along the shoreline of this parcel for approximately 70' and then branch so that a 40' arm would extend toward the street to access the City's parcel located at the end of Orange Street. On the river side of the City's riverwalk a proposed floating dock measuring approximately 100' x 10' was proposed. This structure was to connect to the floating dock on parcel three. Based on the current information submitted the new applicant proposes -to modify the building and is now proposing to build a two-story structure. The foot print dimensions of this new proposal are approximately 91' x 36'. The alignment has been shifted to a more landward position and the water side of this structure will approximate the NHW contour. The building will be placed on'a pile supported foundation which may require the removal of the existing rock rubble along the shoreline. The plans depict a metal canopy which extends out over the deck for a distance of approximately 12.5'. The length of this canopy is approximately 88' long. The plans also indicate that a second story balcony is proposed which will be centered over the canopy and which measures approximately 57' x 6'. There is an easement proposed at the north end of the applicant's property. This easement provides access to the first floor area of the proposed building. The applicant is also proposing to construct a deck along the waterward edge of the proposed building. The structure is shown as approximately 90' x an average of approximately 25'. There is an increase in width of approximately 3' tapering from Page Two George Coffin the north end to the to south end of this structure. This structure will provide access to the riverwalk via two sets of steps located at either end of the structure. The City's riverwalk will be constructed between the applicants deck and a proposed floating dock at the most riverward side of the applicant's proposal. This dock is shown as approximately 94' x 10'. There is a 6' x 8' platform at the southern end of this feature which affords access to the float by means of a 24'x 3' ramp. There are no slips designated for this docking facility. 10. ANTICIPATED IMPACTS: The proposed project has eliminated the encroachment below the NHW contour for the enclosed building. The proposed deck retains the mixed use characteristics of the original proposal in that it will be used for both water dependent and non-water dependent activities. The proposed docks extend to both riparian corridor lines. We initially review this feature as part of the comprehensive project. With the change of ownership it will be necessary for waivers to be obtained. The 940 s. f. of platform was originally permitted and this dimension is need for public safety. This Project is located in Wilmington's Central Business District. It is one element of the redevelopment of downtown, waterfront commercial property along the Cape Fear River. The proposed occupant is a restaurant serving the public during normal daily and evening business hours. Access to the property will be from South Water Street and the City's future Riverwalk. The City of Wilmington was issued State Permit Number 149-98 for the redevelopment of waterfront commercial property on the Cape Fear River. This Permit allows improvements at the 128 South Water Street Project site, noted as Lot #06-01 in the City's Permit Application Attachments and Parcel Four in the DCM's Field Investigation Report. The proposed Project is compatible with the property improvements permitted by the City's State Permit 149-98. The building will be constructed of steel, concrete and brick masonry. The deck will be constructed of steel and wood. Both structures will be supported by timber piles driven to an approximate elevation of -23 feet. Part of the proposed deck will be covered with a non-water-dependent unenclosed canopy. This canopy is allowed by recent amendments to CAMA passed by the General Assembly for urban waterfronts.
