I read the email and re-read it - looked the file up in our data base - received a NWP 14 on July 9, 2019.
As proposed, the replacement of the washed out crossing w/ a 20'6" span x 7'3" rise Aluminum Box Culvert w/
baffles for low flow, qualifies for a NWP 3.
See attached NWP 3 Conditions:
Page 1 (a) -- towards the bottom of first paragraph - NWP 3 -- includes the replacement of crossings damaged
by storm events (provided the replacement occurs w/in the first 2 years of the event).
Page 1 (b) -- NWP 3 -- covers the removal of accumulated sediments w/in 200' of the crossing... the removal of
accumulated sediments is a reporting activity. The Corps would want plan views and cross sections to
demonstrate what areas would be excavated. Preferably in the dry.. etc.. bmps are expected to minimize
turbidity in the creek. We can discuss more if need be.
Paragraph (c) -- NWP covers all temporary dewatering devices that are necessary to perform the pipe
replacement.
Special Conditions related to culvert replacement are on pgs. 29 - 36. W/ the inclusion of baffles - NCDOT has
designed to comply w/ Special condition 3.6.2 (pg. 36).

Dave and Nicholle,
We have written 404 and 401 permits for the replacement of 2 lines of 98"x72" CMPA with 4' in between the
pipe (Total of 192"). We have had the road closed since flooding damages caused a pipe failure on February 6,
2020. Prior to the failure of the pipe, the plan was to replace with a 2 barrel 8'X7' reinforced concrete box
culvert that was going to be let to contract. However, now our Bridge Maintenance forces are going to handle
the replacement. Our Bridge Maintenance Engineer has found that switching to a 20'-6" span x 7'-3" rise
Aluminum Box Culvert will be more economical and quicker to install. He is in discussions with the pipe
company to have the pipe fabricated with one foot baffles on a single side to maintain a low flow channel
inside the pipe. Prior to giving him the ok to proceed with the cost, I wanted to run it by you and see if you
had any objections. Page 5 and 6 of the attached quote are shop drawings of what the pipe will look like. Also
attached is a picture of the flooding that damaged the pipe. The last pdf is a copy of pipe inspection report
which has pictures of what the pipe looked like under normal conditions.

For reference the DWR permit number is 2019-0749 and the USACE Action ID is 2019-01013.
