By memo dated May 21, 2009 (attached), Cyndi Karoly - NCDENR-DWQ - 401
Oversight and Express Permitting Unit, requested that the Ecosystem Enhancement Program
(EEP) determine the amount(s) of Riparian Buffer Mitigation and/or Nutrient Offset Credit that
would be available from the subject site. As noted in the memo, the site was projected to provide
15 acres of wooded buffer a minimum of 50' wide and a maximum of 200' wide on each side of
the agricultural drainage ditches. The memo indicates the site is not suitable for Riparian Buffer
Mitigation but can be used for Nutrient Offset Credit. Analysis indicates the actual buffered area
totals 14.88 acres.
Based on this information, the Debit Ledger will be list the site with 14.88 Nutrient
Offset credits.

The Brogden Road Buffer Mitigation Site (NCEEP Full Delivery site) includes buffer restoration along Moccasin Creek.
According to the monitoring report, 15 acres of buffer mitigation credits were created by planting a wooded buffer along
ditches which are tributary to unnamed tributaries of the Neuse River. Buffer width was greater than 50 feet in the reports
except along the unnamed tributary. Guy Pearce from EEP as well as Dave Schiller from Restoration Systems and Katie
Merritt from DWQ were also present on site.
The site is in its third year of monitoring. The monitoring report stated that all monitoring plots met vegetation success
criteria and that the stream was stable.
The site is fine as long as it is not used for buffer mitigation credit since it is along ditches as opposed to streams. According
to Guy Pearce, the site should be listed as nutrient offset credit rather than buffer mitigation credit. DWQ staff concur and
EEP should examine the ledger to make certain that the site is listed as nutrient offset rather than buffer credit.
