APPROVAL OF 401Quality Certification with
ADDITIONAL CONDITIONS and Catawba River Buffer Rules

Dear Mr. & Ms. Martin:
You have our approval, in accordance with the attached conditions, to place riprap along the
shoreline at Lot 12, Harbortowne Subdivision in .09 acres of wetlands or waters for the purpose of
shoreline stabilization as you described in your application dated March 28, 2002. After reviewing
your application, we have decided that this fill is covered by General Water Quality Certification
Number 3376, which may be viewed on our website at http://h2o.enr.state.nc.us/ncwetlands. This
certification allows you to use General Permit Number 30 when the Corps of Engineers issues it. This
approval is also valid for the Catawba River buffer rules (15A NCAC 2B .0243). In addition, you
should get any other federal, state or local permits before you go ahead with your project including (but
not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply
Watershed regulations. This approval will expire when the accompanying 404 or CANIA permit
expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application
except as modified below. If you change your project. you must notify us and you may be required to
send us a new application. If the property is sold, the new owner must be given a copy of this
Certification and approval letter and is thereby responsible for complying with all conditions. If total
wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be
required as described in 15A NCAC 2H .0506 (h) (6) and (7). This approval shall expire "hen the
corresponding Natiom ide Permit expires or as othenvise provided in the General Certification. For this
approval to be valid, you must follow the conditions listed in the attached certification and any
additional conditions listed below.
1. Stormwater shall be directed to flow at non-erosive velocities across the entire protected stream
buffers;
2. No trees shall be removed from Zone 1 of the Cata%kba Buffer unless they are directly within
the construction access corridor. If trees are removed. at least two species of native forested
vegetation shall be re-established within the construction access or other temporary impact area
occurring in the protected buffer zone within the next growing season following construction
of the project:

3. This project is for the installation of a bulkhead to prevent further erosion of the property due
to wave action. The use of mechanical equipment on the beach must be minimized-,
4. Equipment and materials may be offloaded to the beac`, at r,ic bulkhead site, b...z-steps must he
taken to keep all equipment out of the reservoir;
5. Any disturbance within 50 feet of the shoreline must be done in compliance with the Catawba
River buffer rules;
6. Upon completion of the project, the applicant shall complete and return the enclosed
"Certification of Completion Form" to notify DWQ that all the work included in the 401
Certification has been completed. The responsible party shall complete the attached form and
return it to the 401/Wetlands Unit of the Division of Water Quality.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send
a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean

Dear Mr. Martin:
This'office has received your response to the Notice of Violation for removing the
riparian buffer on Lot 12 Harbortowne Subdivision in Gaston County, NC. Your response
indicates that you will replant Zone 1 of the buffer with trees and stabilize the area with mulch
after the shoreline stabilization project is complete.
Please be advised that the placement of rip rap or other stabilization measures placed
within waters of the State typically requires authorization from the Division of Water Quality,
the US Army Corps of Engineers, as well as Duke Power on Lake Wylie. This office accepts
your proposal to restore Zone 1 of the buffer and requests that you provide a reasonable time
frame by which the work will be completed.

Dear Mr. Gleason,
Thank you for your recent letter and phone call from Mr. Colwell.
I must say it was quite a shock.
I was not aware of any riparian buffer rule.
I had heard sonic counties had enacted some restrictions but I did not know
Gaston County had any.
I purchased my lot from an individual, not a realtor and I had never heard of this
rule.
I am sorry for any violation and anxious to resolve this per your instructions and
approval.
I have not disturbed the soil or slope of the zone I area.
The existing shoreline homes in our sub-division all have grass very close to the water's
edge. Our plan was and is to keep a natural buffer in the zone I area.
I have contracted Green Earth Landscape and Design to assist in a plan for your approval.
Be assured I am very sensitive to the long-term health of the river. This is where I plan to
live.
It is my understanding that with your permission I can remove trees, stumps, and
roots within approximately 5 feet of the shoreline so I can prep and install rip-raff rock to
prevent further erosion. Please advise.

Once that is complete I would like to plant trees back in the zone I area to keep it
in a natural state.
I wish to use a variety of indigenous trees (as shorn in Green Earth's proposal).
This would provide good mulching through leaf shedding, and a stable root
system to help control erosion.
Long-term (not shown in the drawing), I would like to intermediately include a
variety of smaller plantings such as forsythia, abelia, and butterfly bushe.
These plants are compatible to soil, climate, etc. and require only a minimal
amount of organic / natural fertilizing.
After this stage I would like pennission to install a natural around-cover such as
periwinkle to further protect from erosion and add additional habitat for wild-life while
adding texture to the landscape.
Please review my plan and tell me if this meets your requirements or specifically
what you would have us do.
