After reviewing your application, we have determined that this fill is covered by the Division of Water Quality (DWQ) General Water Quality Certification Number 3374. This Certification allows you to use Nationwide Permit No. 12-when issued by the US Army Corps of Engineers (USACE). This letter shall also act as your approved Authorization Certificate for impacts to the protected Neuse River Buffers as required under 15A NCAC 2B.0233(8). In addition, you should get or otherwise comply with any other federal, state and local requirements before you go ahead with your project including (but not limited to) Erosion and Sediment Control Permit, Water Supply and Non-Discharge. Also, this approval will expire when the accompanying 404 permit expires unless otherwise specified in the General Certification. This approval replaces the approval issued on July 2, 2002. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total fills for this project (now or in the future) exceed one acre of wetland or 150 feet stream, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the DWQ General Water Quality Certification No. 3374 and any conditions listed below. Conditions: You are required to mitigate for impacts to the protected riparian buffers. The required area of mitigation to compensate for impacts to the protected riparian buffers is 20,496 square feet as required under this Authorization Certificate and 15A NCAC 2B .0233. We understand that you wish to make a payment into the Riparian Buffer Restoration Fund administered by the NC Wetlands Restoration Program (WRP) to meet this mitigation requirement. This has been determined by the DWQ to be a suitable method to meet the mitigation requirement. In accordance with 15A NCAC 2B .0242, this contribution will satisfy our compensatory mitigation requirements under 15A NCAC 213 .0233(9)(C). Until the WRP receives and clears your check (made payable to: DENR - Wetlands Restoration Program Office), no impacts specified in this Authorization Certificate shall occur. Project Number 00013 Dear Mr. Dorney: ENGINEERS-PLANNERS-SURVEYORS The City is in receipt of the July 2, 2002 DWQ approval of the Johnsdale Road Sanitary Sewer Extension project in Raleigh. We appreciate the assistance the Division has provided with this project to date. Condition 1 requires the City to compensate for impacts to the protected riparian buffers within one month. The City requests a time extension for making payment to the WRP. The City will require at least two months to make the payment depending on when the invoice is received. The City will request the invoice within 30 days of today. The City Council must act on the request before funds can be assigned to the project. I informed Dale that square footage mitigation would be required for ALL of the impacts within the 50 foot buffer. NO OTHER WAY. I thought that we were waiting on a revised realignment from their 010373 approval. It turns out that one was received and sent to the RRO on 3/21/02 (020419). The previously approved 010373 plan has less impacts to buffers but more impact to Mr. Jackson's property. The 020419 plan has more impacts to buffers but less impact to Mr. Jackson's property. Given the existing properties and structures, I'm willing to recommend the approval of the 020419 plan with the condition of buffer mitigation for all Zone 1 parallel impacts. Look over plans and see if you agree. Please be aware that the 020419 plan has impacts within 10 feet of the creek. If we issue this are we doing so in conflict with the 15A NCAC 02H .0219 reps? In this case the stream is classified as "C NSW". Our GC3374 requires that they keep the construction corridor at least 10 feet from the stream when running parallel. Non-Discharge rules, 15A NCAC 2H .0219 "Minimum Design Requirements" (i) For sewer systems and sewer system extensions (2) (G) minimum separations (vi) any other stream, lake or impoundment, require that the sewer system (pipe, man-holes, etc.; not the construction corridor) be kept 10 feet away (50 feet for WS-II, WS-III, B, SA, ORW, HQW, or SB; & 100 feet for WS-I, or Class I or Class II impounded reservoirs used as a source of drinking water). Please keep in mind that these rules only apply to the actual pipe, man-holes, etc. and not the construction corridor. Like with any regulation there are exceptions that allow sewer systems to infringe within these minimum separations. 2H .0219(xii) states; "Ferrous sewer pipe with joints equivalent to water main standards, shall be used where these minimum separations cannot be maintained. The minimum separation shall however not be less than 25 feet from a private well or 50 feet from a public water supply well." I plan to put the project on hold because the RRO believes that the line can be placed greater than 10 feet from the stream. I plan to place a condition on any final approval that states that "The project shall comply with 15A NCAC 2H .0219 (i) (2) (G) and all other State, Federal and Local sewer system regulations." and cc: Mr. Kim Colson, DWQ Non-discharging Permitting Unit to ensure that they use the ferrous sewer pipe. I think this should be a standard condition for all sewer systems that we approve within these minimum separations. The proposed alignment of the sanitary sewer cannot be moved greater than 10 feet away from the bank of the stream because of constructability issues. On the east side of Manhole 60 there is an embankment to a driveway (6709 Johnsdale Road), approximately 7 feet tall with approximately a 2:1 slope. If the proposed sewer route is moved more to the east, the sewer construction would compromise the structural integrity of the driveway's embankment. Additionally, the sewer would be closer to the foundation of a house. A portion of the proposed sewer between Manhole 60 and Manhole 40 is located near the stream. The sewer cannot be shifted to the east because of the same reasons listed above. Manhole 40 is currently located near the bank of the stream. This manhole cannot be shifted to the east because of the location of the workshop. Currently, the alignment of the construction corridor between Manhole 40 and Manhole 30 of the proposed sanitary sewer abuts against the western face of the workshop. The route of the sewer is confined between the workshop and the top of bank of the stream. The route proposed on the stream side of the workshop will allow the sewer to be installed at a relatively shallow depth, 4 to 6 feet deep. This is important due to rock located in the area. The route will minimize the environmental impact by minimizing the depth of the sewer, especially the portion of sewer located parallel to the bank of the stream. There are less number of large trees that would have to be removed within the proposed construction corridor on the creek side of the workshop. Any proposed sanitary sewer alignment on the east side (upland side) of the workshop would have more of an environmental impact. There would be more large trees removed within the construction corridor on the upland side of the workshop. Additionally, the depth of the sewer would need to be 12 to 15 feet deep, directly east of the workshop. Presently, the embankment around the upland side of the workshop is cut out to accommodate the structure (see attached photographs). The sewer installation on the upland side of the workshop might jeopardize the stability of the embankment around the workshop due to the depth of excavation (especially if rock is encountered), possibly shearing of the soil upslope above the workshop. The proposed sanitary sewer will be constructed of ductile iron (ferrous) sewer pipe with joints equivalent to water main standards meeting Administrative Code Section 15A NCAC 2H .0200 - Waste Not Discharged to Surface Waters requirements. Erosion control protection will also be implemented during construction. The primary considerations for this project are the physical constraints of the existing mature residential development which include existing houses and existing mature trees. Secondary considerations include the potential to encounter rock when installing the proposed sanitary sewer. Photographs of the area along on the east side the workshop are included as exhibits to this narrative. A plan showing where the pictures were taken is also included at the bottom of each photograph. 2. The City of Raleigh intends on satisfying the mitigation requirement by paying the mitigation fee for all of the Zone 1 encroachment area for this project. Approximately 6,832 square feet of Zone 1 of the Neuse River Buffer will be encroached. The mitigation factor is understood to be taking the area of land encroaching Zone 1 and multiplying it by 3 to give an adjusted square foot. Once that quantity is determined, the number is multiplied by dollar amount, $0.98/adjusted square foot. The site corridor is not within the city limits of Raleigh, but is surrounded by the city limits. There is an existing sanitary sewerage pump station on Ravenhill Road used for transport of sewage from the houses within the city limits. Houses on Johnsdale Road are on private septic systems and water supply wells. The City of Raleigh is interested in taking action to eliminate the maintenance and overflow concerns of the Ravenhill Road pump station. To accomplish this, the City is investigating abandoning the pump station and installing a gravity sanitary sewer in its place. Secondary benefits of the gravity sanitary sewer include the ability of houses along the alignment to tie into the main if their septic systems fail. Proposed Construction A gravity sanitary sewer from the Ravenhill Road pump station to the existing manhole north of the pump station should flow from the pump station east to Johnsdale Road and north along Johnsdale Road. From the northern end of Johnsdale Road, we evaluated three alternates to tie into the existing manhole. The summaries below reference the plan included as an exhibit with this narrative. All of the routes assume the sanitary sewer will flow along Ravenhill Road from the pump station area, west toward Johnsdale Road, and north along Johnsdale Road to the driveway of 6705 Johnsdale Road (Don and Dorothy Roberts property). This is the starting point for the three routes. Route 1: The sanitary sewer would begin at the intersection of Johnsdale Road and the driveway at 6705 Johnsdale Road, and run westerly along the driveway to a point. This point will be located approximately 10' to 20' west of the toe of slope of the driveway to_the_Green V. Garcia property. The location of this point will be encroaching in Zone 2; and Zone 1. of the Neuse River Buffer. From this point, the sewer will run in a northerly direction along and parallel to a perennial stream. This portion of the sanitary sewer route will encroach in Zone 1 of the Neuse River Buffer. The route of the sewer will run : parallel to the stream and run between a large storage structure and the top of bank of the stream. The sewer will continue to run parallel to the stream and connect to an existing 4' I.D. manhole. Typically under the Neuse River Buffer rules, the alignment of the sanitary sewer would normally be at least 50 feet from the edge of bank. In order to serve the area by gravity, the further the sanitary sewer is from the stream bank, the deeper the sanitary sewer is to Impact Justification Page 2 be constructed. The deeper the sewer main, the wider the trench will need to be to install the sanitary sewer. The wider the trench, the wider the area of disturbance. Due to steep topography and rock in the area, and due to a large workshop located approximately 30 feet from the edge of bank, we recommend the route of the sanitary sewer run parallel to the stream (see attached Drawings). We have tried to minimize the environmental impact by minimizing the depth of the sewer, where possible. The length of disturbance across the stream is approximately 20 feet (top of bank to top of bank). The benefits of this route include: • Minimizing damage of large trees by a wider trench and routing around the large storage structure and house. We believe the variance is justified. Route 2: From the beginning point, Route 2 consists of running the gravity sanitary sewer along the right of way of Johnsdale Road (SR 2086) to a point located approximately between the Nathaniel M. & Mildred Jackson and Green V. Garcia properties. At this point the route of the sewer would run northwesterly along the property line between the two properties. The sewer would run to a point located approximately 40 feet from the top of bank of the stream. The sewer then would then run along and parallel to the Neuse River Buffer (encroaching in Zone 2 of the Neuse River Buffer) until it reaches a point where the sanitary sewer will cross the stream and tie to an existing manhole. This route is not favorable due to: • The fact that proposed sanitary sewer would be installed along a paved driveway and large ornamental retaining rock wall. • Large hardwood trees would have to be removed and two utility poles would have to be moved and relocated. • More importantly, the depth of the sewer would be approximately 29 feet deep near the intersection of the property line and Johnsdale Road right of way line. • Where the sewer is located between two houses, the depth of the line would be approximately 22 feet deep. It would be recommended that a permanent sanitary sewer easement with an excessive width (minimum 40 feet wide) be acquired at - the locations where the depth of the sewer is deeper than 15 feet. The easement could encroach in the houses, which is not acceptable. Route 3: Route 3 consists of running the gravity sanitary sewer along the right of way of Johnsdale Road (SR 2086) to a point located on the eastern most boundary line of Nathaniel M. & Mildred Jackson property. At this point, the sewer would run northwesterly along the property line to a point. At this point, the sewer would turn and run in a westerly direction along the northernmost property boundary line of the property. The route of the Impact Justification Page 3 sanitary sewer would continue in a westerly direction to a point where the sanitary sewer crosses the stream and ties to an existing manhole. This route is not favorable due to: • The fact that the depth of the sanitary sewer would be between 37 feet to 42 feet deep along a portion of Johnsdale Road and the eastern most property of Nathaniel M. & Mildred Jackson property. • Large hardwood trees will have to be removed. It would be recommended that a permanent sanitary sewer easement with an excessive width (minimum 60 feet) be acquired at the locations where the depth of the manhole is 30 feet in depth or greater. The easement could encroach in the houses, which is not acceptable. Summary and Recommendations The primary considerations for this project are the physical constraints of the existing mature residential development which include existing houses and existing mature trees. Secondary considerations include the potential to encounter rock when installing the proposed sanitary sewer. Routes 2 and 3 would involve installing the sanitary sewer at depths that may structurally undermine existing residences, would significantly effect the constructability of the sewer, and may require existing residences to be within permanent sanitary sewer easements. All three routes would require the sewer to cross the stream from west to east to tie into an existing manhole on the east side of the stream. Due to the significant potential impact on the existing residences, we recommend that Route 1 be used for this project. Regardless of the route chosen, impacts to Zone 1 and Zone 2 Neuse River buffers will be minimized, and no fill, temporary of permanent, will be placed in the buffer zones. Photos of the area along the recommended route where the Zone 1 and Zone 2 buffers will be impacted are included as exhibits to this narrative. The proposed alignment encroaches in the Neuse River buffer zone 2 for 317 feet, with 204 feet being in zone 1, as it crosses the upstream adjoining lot. After the line clears my neighbor's workshop, the alignment turns uphill away from the creek and exits the buffer very close to my property line. At my property line the sewer is approximately 12 feet deep and is 20 feet deep at the manhole at the other side of m? lot. This depth requires a 40 foot construction easement. From the manhole the sewer line turns almost 90 degrees downhill and crosses the creek to an existing manhole located 10 -15 feet on the other side of the creek. This section to the existing manhole is in the buffer for approximately 70 feet. The existing sewer below my property was constructed before the Neuse Rules were enacted and are in the buffer zone. I suggested a different alignment - roughly along the alignment of the abandoned sanitary sewer line from Millbrook High School. This alignment would require an additional encroachment in the buffer zone of 120 - 130 feet. If the City's proposed alignment is followed, the only portion of the sewer in compliance with the rules would be the portion across my property. Considering the additional cost and damage to my property, this appears very illogical. The City staff refused to consider an alternate alignment until after the hearing before the City Council, Public Works Committee. If you look at my proposed route I think you will find it poses no additional threat to the environment and would be considerably cheaper to. install. The project route passes through an established residential neighborhood. We have been informed there is rock in the area which may hamper construction. There is an existing workshop building, which currently encroaches into the buffers. The route generally follows what we have been told is an abandoned sanitary sewerage service. Please note the abandoned manhole (near proposed Manhole 60) and cleanout (near Station 11+33). One of the affected landowners, Mr. Nathaniel M. Jackson, has indicated he has been in contact with you. Mr. Jackson said DWQ would approve the route as shown. Dale Crisp called me today and requested I write you a letter expressing my concern with the proposed City of Raleigh sanitary sewer alignment across my property at 6713 Johnsdale Road. The proposed alignment encroaches in the Neuse River buffer zone 2 for 317 feet, with 204 feet being in zone 1, as it crosses the upstream adjoining lot. After the line clears my neighbor's workshop, the alignment turns uphill away from the creek and exits the buffer very close to my property line. At my property line the sewer is approximately 12 feet deep and is 20 feet deep at the manhole at the other side of my lot. This depth requires a 40 foot construction easement. From the manhole the sewer line turns almost 90 degrees downhill and crosses the creek to an existing manhole located 10 -15 feet on the other side of the creek. This section to the existing manhole is in the buffer for approximately 70 feet. The existing sewer below my property was constructed before the Neuse Rules were enacted and are in the buffer zone. I suggested a different alignment - roughly along the alignment of the abandoned sanitary sewer line from Millbrook High School. This alignment would require an additional encroachment in the buffer zone of 120 - 130 feet. If the City's proposed alignment is followed, the only portion of the sewer in compliance with the rules would be the portion across my property. Considering the additional cost and damage to my property, this appears very illogical. The City staff refused to consider an alternate alignment until after the hearing before the City Council, Public Works Committee. If you look at my proposed route I think you will find it poses no additional threat to the environment and would be considerably cheaper to install.
