Dear Mr. McMillan:
On behalf of Donald Fose and Soundtracts Properties, LLC, Applied Resources
Management, P.C. is providing you with a project narrative for the above referenced site.
The project is located on the southeast side of NC Highway 53 in Onslow County. The
property is approximately 26.33 acres with an existing dirt access driveway that bisects the
wetland area. In order to access the upland areas behind the wetland area, a Nationwide
Permit 29 is being sought.
The proposed project consists of approximately 30 single family residences that are served
by on-site wastewater systems. Approximately eleven homes are to be serviced by remote
off-site wastewater systems located in a designated wastewater easement area. The
property will be provided potable water by a community water well that is to be located in
the middle portion of the tract.
The USACOE permit required will include 404 wetland impacts for a wetland fill area tQ>
accommodate the construction of a right of way that meets requirements for access by
emergency and fire vehicles. The impact are expected to be approximately 0.48 acres.
This wetland impact has been minimized by locating the right of way and roadway in the
existing disturbed drive that is currently on the property. The impact is also minimized by
installing the supply line for the septic systems under the wetland areas by directional bore

method and will be accessed only from the upland areas. This area for the supply line
easement has not been considered in the impact area.
In response to the needed impact, payment into the Hoffman Forest Wetland Mitigation
Bank (HFWMB) at a 1:1 ratio is being proposed and an acceptance has been obtained
from the HFWMB.

This project is to involve the construction of 30 single family residences. The development plan will call for upgrading the
existing road that crosses the wetland areas. The road construction is to be done in accordance with standard
construction practices. The road is to be stabilized with retaining walls in the wetland areas and is to utilize areas already
under current use. The existing culvert is to be replaced with a larger diameter pipe to allow greater flow as needed. The
ares of impact is to be limited to 0.48 acres as shown on the attached plans. The supply line for the wastewater systems
are to be installed under the wetland areas by directional bore method to avoid any impact to wetland areas.

1. Avoidance and Minimization

The proposed right of way shows avoidance by utilizing an existing access way through the wetland area. This preserves the
forrested wetland areas and upgrades the existing drive that is currently bisecitng the wetland area.

Construction of the road will be only that which is required by Onslow County and NC DOT to allow emergency vehicles
access into the residental areas. The road shall be constructed with retaining walls to eliminate further impacts with slope and
fill. The supply line for the wastewater systems shall be installed by directional bore under the wetlands. The access points
for maintenance of the supply line shall be located in the upland areas. This will eliminate any impact to the wetland areas.

This residential development is utilizing the entire property to the fullest extent allowable according to wastewater rules.
There are no more homes or lots anticipated therefore this impact is the only impact that is anticipated.

their natural or mitigated condition. No person or entity shall perform any of the
following activities on such conservation area:
a. fill, grade, excavate or perform any other land disturbing activities
b. cut, mow, burn, remove, or harm any vegetation
c. construct or place any roads, trails, walkways, buildings, mobile
homes, signs, utility poles or towers, or any other permanent or
temporary structures
d. drain or otherwise disrupt or alter the hydrology or drainage ways of
the conservation area
e. dump or store soil, trash, or other waste
f. graze or water animals, or use for any agricultural or horticultural
purpose
This covenant is intended to ensure continued compliance with the mitigation
condition of a Clean Water Act authorization issued by the United States of
America, US Army Corps of Engineers, Wilmington District, Action I.D number
SAW 2009-01528, and therefore may be enforced by the United States of
America. This covenant is to run with the land, and shall be binding on the
Owner, and all parties claiming under it."
