Warren, Jr. Timberline Land Co. 150 East Arlington Blvd., Suite E Greenville, NC, 27858 APPROVAL of 401 Water Quality Certification with Additional Conditions and Tar-Pamlico River Buffer Rules Dear Mr. Warren: You have our approval, in accordance with the attached. conditions, to shade 0.06 acre of wetlands in order to construct a boardwalk access to a platform on Ross Creek on lot 14 of Smugglers Cove Subdivision in Beaufort County, as described in your application received by the Division of Water Quality on February 4, 2002. After reviewing your application, we have determined that this fill is covered by General Water Quality Certification Number 3371, which can be downloaded from our web site at http://h2o.enr.state.nc.us/ncwetlands . This Certification allows you to use your CAMA Permit when it is issued by the NC Division of Coastal Management. This approval is also valid for the Tar-Pamlico River Buffer Rules (15A NCAC 2B .0259). In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us in writing and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification and the additional conditions listed below: 1. An additional condition is that stormwater shall be directed to diffuse flow at non-erosive velocities through the protected stream buffers; 2. No additional impacts to the protected stream buffers are allowed under this approval. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. PROJECT SUMMARY: The applicant proposes to construct a boardwalk access to a platform on Ross Creek on lot 14 of Smugglers Cove Subdivision. Timberline Land Company Smugglers Cove Subdivision Project Setting Smugglers Cove subdivision is being developed by Timberline Land Company and is located off SR 1731 (Wheat Patch Road) on Ross Creek and East Fork near the Town of Belhaven in Beaufort County, North Carolina. Ross Creek connects into East Fork which is a tributary of North Creek which is connected to the Pamlico River. This is a new subdivision covering ±215.21 acres. The majority of the property is vegetated with mixed hardwoods, pines and has an undergrowth of vines and shrubs. The undergrowth was mowed last fall up to the wetland line. Large portions of the tract have been delineated as Section 404 wetlands by the U.S. Army Corps of Engineers. There are numerous fingers of Coastal Wetlands that interface with Ross Creek and East Fork and taper down as they transition away from the creek. The Coastal Wetlands are primarily vegetated with Juncus roemerianus, Cladium - jamaicense and Tynha snn.. The project area is bordered on both sides by undeveloped property vegetated similarly to the applicant's property. Lot 14 fronts Ross Creek and is ±935' deep. The landward end of lot 14 is ±327' wide and the waterward end at Ross Creek is ±39' wide. Coastal Wetlands interface with Ross Creek and extend ±620' onto the lot. The Coastal Wetlands on lot 14 are dominated by Juncus roemerianus and Cladium jamaicense. Timberline Land Company has constructed a house and septic system on lot 14 and the property is for sale. The construction was not within any Area of Environmental Concern nor was it within the Tar-Pamlico River buffer basin jurisdiction. Ross Creek is classified as SA-NSW by the Environmental Management Commission. Ross Creek has been designated as a primary nursery area by the Division of Marine Fisheries and is not open to shell fishing. Project description The applicant proposes to construct a 4' wide by ±620' long boardwalk over the existing Coastal Wetland to Ross Creek. A 9' wide by 16' long platform is proposed in Ross Creek. The water depth at the platform location is ±2'. The platform has been designed to maintain the 15' riparian setback on both sides. The boardwalk as proposed will be elevated 36" above the marsh substrate measured to the bottom of the decking. Anticipated impacts The project as proposed will result in the shading of ±2,480 ft2 of Coastal Wetlands associated with the placement of the boardwalk. The construction of the platform will result in the shading of ± 144 ft2 of creek bottom. The project as proposed will result in localized turbidity as a result of the construction activities.
