Lyle Phillips 3331 Heritage Trade Drive Suite 105 Wake Forest, NC 27587 Re: Wildcat Branch Subdivision (Formerly 3124 Garner Road Property) Request for NWP 29, GC #4139 and Riparian Buffer Compliance – Response to Comments Sage Project # 2017.34 On behalf of Glenwood Homes, LLC (applicant and owner), please find attached a revised PCN application and supplemental information as requested from the US Army Corps of Engineers (USACE) that the activities associated with the proposed development of the Wildcat Branch Subdivision (Project) may proceed under Nationwide Permit (NWP) 29 and the corresponding GC #4139. Our responses to comments received from Mr. G Lyle Phillips are below. 1) NWP General Condition 15 an application/pre-construction notification is considered complete only if the activity is deemed a single and complete project. For non-linear projects "single and complete" is defined as the total proposed or accomplished by one owner/developer or partnership and must have independent utility. Single and complete non-linear projects may not be "piecemealed". The submitted project plans were insufficient to review the complete project. Exhibits should depict the entire project, including all impacts to jurisdictional features, roadways, utility lines, lot lines, greenway trails etc. Please provide zoomed in exhibits of the proposed impacts areas. Exhibits should be no larger than 11x17. a. Response: Impact mapping has been revised to reflect the entire project, including all impacts, infrastructure, and lot lines. Smaller scale exhibits of proposed impacts have also been included. 2) On the Index to Impact Map Sheets exhibit it appears that the proposed project will impact Stream SD in the southwest corner of the project. Please depict impacts from the proposed project to SD and update the PCN and exhibits accordingly. If this crossing is existing, please add a label on the plans. Exhibits should be no larger than 11x17. a. Response: No impacts are proposed to Stream SD in the southwest corner of the project. Impact mapping has been revised to depict this area more clearly. 3) To verify that the project will not result in impacts to Stream SC please depict Stream SC and the proposed grading on the exhibit depicting Impact 4. Exhibits should be no larger than 11x17. a. Response: No impacts are proposed to Stream SC. Impact mapping has been revised to depict this area more clearly. Wildcat Branch Subdivision Page 2 of 3 4) On the Index to Impact Map Sheets exhibit it appears that the proposed north/south road will impact Stream SA. Please depict impacts from the proposed project to SA and update the PCN and exhibits accordingly. Exhibits should be no larger than 11x17. Additionally, if impacts are proposed please be advised that the road appears to not have logical termini, specifically why couldn't the road stop short of stream impacts. If the proposed north/south road is not impacting Stream SA please provide an exhibit to show the project limits. Exhibits should be no larger than 11x17. a. Response: No impacts are proposed to Stream SA at the proposed north/south road. The design allows for a required City right-of-way dedication. No construction is proposed beyond the project limits. Impact mapping has been revised to show project limits. 5) On the Index to Impact Map Sheets exhibit it appears that the proposed project will impact Stream SA near its confluence with Stream SB. Please depict impacts from the proposed crossing to SA and update the PCN and exhibits accordingly. If this crossing is existing, please add a label on the plans. Exhibits should be no larger than 11x17. a. Response: No impacts to Stream SA near the confluence of Stream SB are proposed. The sanitary sewer depicted on the mapping is an existing utility. Impact mapping has been revised to depict this area more clearly. 6) To verify compliance with General Condition 2 (Aquatic Life Movements) please provide a profile view for Impact 1 (road crossing), including the culvert and any riprap. a. Response: A profile view has been included in the impact mapping for this road crossing. 7) For Impact 1 please identify impacts from the culvert and riprap as separate impacts so, permanent (loss) impacts and permanent (no loss) impacts can be recorded separate and update the PCN and exhibits accordingly. Exhibits should be no larger than 11x17. a. Response: Impacts for the culvert and riprap have been accounted for separately in the impact mapping and the PCN. 8) On the Index to Impact Map Sheets exhibit it appears that the proposed project will impact Stream SB near its intersection with the northern property line. Please depict impacts from the proposed crossing to SB and update the PCN and exhibits accordingly. If this crossing is existing please add a label on the plans. Exhibits should be no larger than 11x17. a. Response: No impacts to Stream SB near the northern property line are proposed. Impact mapping has been revised to depict this area more clearly. 9) There are no wetlands within the project area. Please remove mentions of wetland avoidance as a part of your avoidance and minimization statement. a. Response: All references to wetlands have been removed from the application. 10) Stream SB was confirmed as intermittent during the PJD site visit. Please update the stream impact table in the PCN accordingly. a. Response: Stream SB has been revised to “intermittent” in the PCN table.
