Return # 1317 Alamance County We received your application for an NPDES discharge permit on June 26, 2017. On July 21, 2017, we sent a request for additional information, which we received on September 7, 2017. We have concluded that stormwater discharges from this site are not categorically captured by NPDES stormwater regulations and therefore will not require a discharge permit. This determination is contingent upon the removal of mulch processing and storage activities at this site. With this letter, your application and supporting materials are being returned to you. We have submitted a request for the application fee to be reimbursed to you, which will arrive separately once processed. Please be advised that if the State determines that discharges from this site contribute to a water quality standard violation or are a significant contributor of pollutants to waters of the U.S., the Department of Environmental Quality (DEQ) is authorized to require a discharge permit. If operations at your facility change such that an NPDES stormwater discharge permit is required, then you must submit an application and receive permit coverage prior to any discharge. The return of this application does not affect the legal requirements to obtain other permits which may be required by the Division of Energy, Mineral, and Land Resources, or permits required by the Division of Water Resources, Coastal Area Management Act, or any other federal or local governmental permit or approval that may be required.
