Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated October 15, 2007 (or as subsequently amended). Your March 5, 2012 letter indicates the City of Roxboro is currently designing upgrades to your facility, which will direct the existing WTP discharge to your existing WWTP. Construction for these planned upgrades should start by the Spring of 2013. Because of these planned upgrades, you requested that new monitoring requirements, contained in your draft permit, be postponed for three years. These new monitoring requirements have been in place since October 2009. After review of your application, the DWQ has made the following changes to your draft permit: . Please note that the receiving stream is listed as an impaired waterbody on the North Carolina 303(d) Impaired Waters List. Addressing impaired waters is a high priority with the Division, and instream data will continue to be evaluated. If there is noncompliance with, permitted effluent limits and stream impairment can be attributed to your facility, then mitigation measures may be required. The DWQ applauds and encourages your efforts to upgrade your facility and eliminate this point source discharge. However, we cannot allow reduced monitoring during this two year proposed time frame because of'your discharge is to 303(d) Impaired waters, and the completion of the project is far into the future. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. As of this permit issuance, any previously issued permit bearing this number is no longer effective. ('I.) EFFLUENT LIMITATIONS AND MONITORING REQUIREMENTS During the period beginning on the effective date of this permit and lasting until expiration, the Permittee is authorized to discharge from outfall 001. However, the Permittee shall continue to record and submit all values reported by a North Carolina certified laboratory (including field certified), even if these values fall below 50 ug/l. 4) Parameter should be monitored in conjunction with toxicity test. 5) See Part I, Condition A. (2.). Further studies may be required to determine the -cause of toxicity, if any. The collection of samples shall'coincide with the sampling of other parameters. There shall be no discharge of floating solids or visible foam in other than trace amounts All samples collected should be of a representative discharge. Permit NCO003042 A. (2.) CHRONIC TOXICITY MONITORING (ANNUALLY) The permittee shall conduct quarterly chronic toxicity tests using test procedures outlined in the "North Carolina (Ceriodaphnia Dubia) Chronic Effluent Bioassay Procedure," Revised February 1998, or subsequent versions. The effluent concentration defined as treatment two in the procedure document is 90%. The testing shall be performed as a Ceriodaphnia dubia 7day pass/fail test. The tests will be performed during the months of January, April, July and October. Effluent sampling for this testing shall be performed at the NPDES Permitted final effluent discharge below all treatment processes. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form (MR-1) for the month in which it was performed, using the parameter code TGP3B. Additionally, DWQ Form AT-1 (original) is to be sent to the following address: Attention: North Carolina Division of Water Quality Environmental Sciences Section 1621 Mail Service Center Raleigh, N.C. 27699-1621 Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Section no later than 30 days after the end of the reporting period for which the report is made. Test data shall be complete and accurate and include all supporting chemicallphysical measurements performed in association with the toxicity tests, as well as all dose/response data. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the facility name, permit number, pipe number, county, and the month/year of the report with the notation of "No Flow" in the comment area of the form. The report shall be submitted to the Environmental Sciences Section at the address cited above. Should the permittee fail to monitor during a month in which toxicity monitoring is required, then monthly monitoring will begin immediately. Upon submission of a valid test, this monthly test requirement will revert to quarterly in the months specified above. Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include alternate monitoring requirements or limits. If the Permittee monitors any pollutant more frequently than required by this permit, the results of such monitoring shall be included in the calculation & reporting of the data submitted on the DMR & all AT Forms submitted. NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival, minimum control organism reproduction, and appropriate environmental controls, shall constitute an invalid test and will require immediate follow-up testing to be completed no later than the last day of the month following the month of the initial monitoring. ELIMINATION OF DISCHARGE Should the permittee fail to eliminate the wastewater discharge and request rescission of NPDES Permit NC 00003042 by May 4, 2015, the measurement frequency requirement for flow will changed from 2/month to continuous and the sample type shall change from Instantaneous to recording. Facility comments per WTP Strategy Facility has responded with documented requests. Facility is moving forward with plans to tie in this discharge to existing WWTP within two years of permit issuance. Facility requests that the following new testing parameters be changed to coincide with elimination of discharge: • Change flow monitoring back to Instantaneous. • Remove Zinc monitoring because no Zinc Orthophosphate is used in system • Change downstream sampling back to 100 feet because of safety reasons • Change new testing frequencies from Quarterly to annually for Aluminum, Fluoride, Iron, Manganese and Aquatic Toxicity. Final permit includes the following changes: • Flow monitoring has been changed back to Instantaneous • Zinc monitoring has been deleted ( none used in treatment train) • Downstream sampling location has been changed back to 300 feet. Majority of changes are rejected because: • Facility is one of the few remaining WTP to have them incorporated into renewal permits. • Proposed construction activities to reroute WTP discharge to existing WWTP are two to three years from planned actions. • Facility discharges to UT to Marlowe Creek, which is one the DWQ 303(d) impaired waters list for Zn and Cu. Changes to.the Previous Permit: • This section of Marlowe Creek is listed as impaired for Copper and Zinc with notation of cover letter about Impaired Stream status • Special Condition A (3) added • Limits and monitoring for Settleable solids deleted • The site map has been updated to reflect lat & long values for your discharge point, • Footnotes have been modified and added. o Reporting condition #3 added in "Supplement to cover page" requiring facility to report backwashing with waters containing Zinc. This was added to protect receiving stream, which is impaired for Cu and Zinc if facility changes process during current permit cycle. • Parameter codes have been added to the effluent page. The date of the letter was January 18, 2012, but we did not receive it until February 13, 2012. We have reviewed the draft permit and the changes that were included therein. Firstly, in our review we discovered that the standard conditions were not the most recently approved. We request that the standard conditions reflect the November 9, 2011 update. (�( otk In regards to the additional monitoring, the City is currently designing an upgrade to our water treatment facility for removal of disinfection byproducts and as a part of that upgrade our wastewater will be directed to our wastewater treatment plant, thus eliminating our discharge. Currently the upgrades are expected to be permitted by August 2012, bid in the Fall of 2012, and construction started by Spring of 2013. The first phase of the construction would need to be the construction of a pump station for the wastewater and within two years we would hope to eliminate this discharge. As such, we request that the monitoring requirements for copper, zinc, fluoride, aluminum, iron, Chronic Toxicity and manganese be annual. We request that the sampling for Instream Turbidity be quarterly. The solids settle out and the clearwater is discharged to the stream. The settled solids are pumped out to 1 of 2 additional decant lagoons. The concentrated soilds in the 2 additional lagoons is released into 2 solar drying beds and any clearwater is returned to the first lagoon in the system. The solids are allowed to settle out here and then pumped to our holding pond. Then the solids are released into our drying beds. Ron Berry NPDES Section Phone: (919) 733-5083 x.531 Mr.Oakley, I discussed the operator certification requirements with the Certification Division in regards to the addition of dechlorination. At this time they will continue to require only an operator certification of PC-1 for your plant. In regards to your second questions the only effect to the effluent that may be a potential concern is the lower pH. However, this may be a small effect and depends on the amount of chlorine that is neutralized. I hope this information is helpful.
