Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 9, 1994 (or as subsequently amended). The final permit includes no major changes from the draft permit sent to you on Jutlp 13, 2007. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding. Please note that this permit is not transferable except after notice to the Division. The Division may require modification or revocation and reissuance of the permit. This permit does not affect the legal requirements to obtain other permits which may be required by the Division of Water Quality or permits required by the Division of Land Resources, the Coastal Area Management Act or any other Federal or Local governmental permit that may be required. After reviewing the draft Andrew Oakley, Roxboro Public Service Director has requested an additional 6 months beyond the 18 months stated in the draft to be in compliance with the TRC limit. At this point I will reply to the request and state: 1) that we will not amend the draft compliance, it is the standard compliance we apply to all permittees 2) that we expect Roxboro to properly measure and report applicable Cl values under any permit including the current one 3) that we expect Roxboro to work towards meeting the 18 month compliance time line the same as other WTPs 4) that at such a time approaching the 18 month dead line in the future Roxboro feels it cannot meet the 18 month time line then they can make a request Based on the DMR reports and annual inspection reports Roxboro has had some problems historically with correctly reporting C1 values. I am not sure what there perception is on measuring values in the 17Ag/L range. If you have any additional thoughts let me know. We have reviewed the draft permit and the changes that were included therein. In regards to the addition of a limit on Total Residual Chlorine (TRC), the effects of this limit on our Water Treatment Plant are unclear until a monitoring plan can be established to identify a baseline for our plant's effluent at this time. The 18 month time constraint may not be sufficient for analyzing the situation and making plant or system modifications that would be necessary. The city will gather data for both winter and summer months. Then if action is needed to correct any TRC problems, the city could possibly needed to enter into an RFP for consultants and bid out work for corrective actions. We would request that the time frame be extended for at least 24 months. The City would like to have 6 months to develop a procedure for monitoring the PH required by this permit. The additional 6 months would allow us adequate time to verify that existing equipment will be available for monitoring PH or if new equipment might need purchasing. I� ! As far as the status of the current renewal application it is still being reviewed. But you are still covered by your last issued permit until a new one is issued. At this point with the additional information you provided the paperwork appears complete. The stream that is impacted by your discharge is listed on the impared stream list and automatically requires additional scrutiny by NC-DENR, just as any other discharges sources entering an impared stream will be scrutinized. Ron Berry NPDES Permit Group (919) 733-5083 x.531 1 of 1 6/11/2007 4:14 PM CONVERSATION WITH ROANOKE BASIN COORDINATOR — NORA DEAMER Date: 6/8/07 3:45 pm Based on current information the Roxboro WTP is discharging into an impaired stream, Marlowe Creek. Contacted Nora as basin coordinator for input and direction on monitoring and/or new limits for permit. Current 2006 Plan fro Marlowe Creek is focused on storm water runoff control by the City of Roxboro. Copper is sited as possible source of impairment but do not know of any potential source in WTP discharge. Agreed we would include Nora in cc distribution on permit draft. Nora provided web site link (already had visited) and a hard copy of the approved 2006 plan with map. Referred to 2006 plan for most current information. Talked to Jim about this and he does not see any additional monitoring requirements beyond what we had planned, pH and TRC. Jim did suggest checking back with DMR to see if any metals were monitored. He wanted to know besides the missing WTP flow schematic was there any other information needed. I reviewed what was required for the flow schematic and asked him to mark where the grab sample was taken. I also asked him about the "Water Softener" check box that was checked on the application. It stated it was checked in error and the WTP plant operation had not changed. Mr. Oakley requested my email address which I did provide.
