Box 3136 Greensboro, North Carolina 27402-3136 Subject: Modification of Permit No. NCC000003 Haw River Nutrient Compliance Association Dear Ms. Groome: The Division has reviewed the Haw River Nutrient Compliance Association's requests of June 17 and 26, 2019, for modification of its NPDES permit and is forwarding herewith the revised cover sheet and Appendix A of the permit. Please replace the affected pages of your current permit, issued December 22, 2016, with these revised pages. This minor permit modification is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency, dated October 15, 2007. The modified permit includes the following change, which becomes effective January 1, 2020: Per the Association's request, Appendix A now includes the City of Burlington as a co- permittee member and its treatment facilities as member facilities: o Eastside WWTP, NC0023868, and o Southside WWTP, NC0023876. All other terms and conditions of the 2016 permit are unchanged and remain in full effect. With the addition of these members, the Associations TP Limit increases to 100,0631b/yr delivered load. If any parts of this permit modification are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be a written petition conforming to Chapter 150B of the North Carolina General Statutes, filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding. The conditions in this group permit supplement the conditions in the Co-Permittee Members' individual NPDES wastewater permits. Together, the group and individual permits establish an integrated set of nutrient control requirements consistent with the B. Everett Jordan Reservoir TMDL. All conditions in the Co-Permittee Members' individual permits remain in full effect except as specifically provided in those permits.
