On behalf of the City of Gastonia, LaBella Associates has subcontracted Carolina Wetland Services, Inc. (CWS) to provide Section 404/401 permitting services for this project. CWS is submitting a Pre -Construction Notification pursuant to Nationwide Permit No. 3 to the U.S. Army Corps of Engineers and Water Quality Certification No. 4132 to the North Carolina Division of Environmental Quality (NCDEQ) for proposed permanent impacts to 94 linear feet of stream channel associated with upgrading the culvert system to prevent flooding. Additionally, temporary dewatering system will result in approximately 40 linear feet of temporary stream impacts. An executed Agent Authorization Form is attached (Attachment B). Project Description 3a. Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application: The Court Drive and Wellman Street site study area is approximately 7 acres in extent and is located at the Court Drive— ellman Street intersection in Gastonia, North Carolina (Figure 1 and 2, Attachment A). The limits of disturbance for this project total 1.05 acre (Figure 3). The study area consists of maintained residential lawns, stream channels, and forested areas. The vegetation communities on site consist of maintained/disturbed urban vegetation (Figure 3, Attachment A). The surrounding land use consists of single-family residences, forested areas, and commercial/government properties. According to the United States Department of Agriculture - Natural Resources Conservation Service (USDA-NRCS) Web Soil Survey of Gaston County (Figure 4) and the most recently published NRCS Soil Survey for Gaston County (Figure 5), current and historic on-site soils consist of Cecil -Urban land complex (8 to 15 percent slopes [CfD]) and Tatum gravelly loam (2 to 8 percent slopes [TaB] and 8 to 15 percent slopes [TaD]). None of the on-site soils are listed on the Web Soil Survey Hydric Soils List as containing hydric inclusions. The National Wetlands Inventory (NWI) GIS layer does not depict any potential wetland areas within the project limits (Figure 6). Jurisdictional Waters of the U.S. were delineated by CWS on July 20, 2016. There are two jurisdictional stream channels within he project limits (Figure 7). NCDEQ Stream Classification Forms representative of on-site jurisdictional stream channels are attached as SCP1-SCP2 (Attachment C) and a Wetland Determination Data Form representative of on-site non -jurisdictional upland areas is attached as DP1 (Attachment D). The on-site jurisdictional boundaries and locations of the stream classification points and the Wetland Determination Data Form are depicted on Figure 7. The delineation documentation is included with this application, but no Jurisdictional Determination is requested at this time. 3b. Explain the purpose of the proposed project: The purpose of the project is to replace the deteriorated 48" CMP Court Drive culvert and to improve flooding conditions at 279 Court Drive. This 48" culvert is at the end of its service life and must be replaced. In addition, the existing 36" CMP Wellman Street culvert is undersized and is causing frequent flooding at the 2792 Court Drive residence. There is a dual 30"/24" RCP pipe system on the upstream end of this 36" CMP that provides greater capacity than the culvert. During even minor storm events, water backs up into the yard at 2792 Court Drive and causes structural flooding. The 36" CMP is being replaced with a dual 42" culvert to provide greater capacity and reduce the frequency of structural flooding at the house. 3e. Describe the overall project in detail, including the type of equipment to be used: (see next page) Page 3 of 14 PCN Form — Version 1.4 January 2009 3e The project proposes to replace the existing undersized culverts with appropriate sized culverts and install rip rap stilling basins (fill) at the downstream end of the culvert (Figure 8). The culverts will be replaced within existing culvert footprint. Additionally, grading upstream of the Court Drive culvert will disturb 14 If of stream bed. The construction plans with details are included as Attachment E. S1 -S3 - Permanent Impacts The length of each rip rap stilling basin at the downstream end of the culverts is 40 feet, totaling 80 linear feet of permanent impacts (S1 and S2). Minimum grading and stabilization with rip rap upstream of the Court Drive culvert will disturb 14 linear feet of stream bed (S3). Rip rap stilling basins and rip rap are required due to the high velocities in the culverts. The full flow velocity in the 42" Wellman Street culvert at 3.10% slope is almost 20 fps. It would not be possible to adequately stabilize in such high velocities without rip rap stilling basins. Stilling basins were designed using the methodology in the Federal Highway Administration's HEC -14 publication to minimize the length of rip rap. If standard rip rap aprons would be utilized, the length of stream impacts would be even greater. S4 and S5 - Temporary Impacts due to Dewatering A pump around system will be utilized to complete the construction activities in the dry. This water diversion system will result in a total of approximately 40 linear feet of temporary stream impacts (S4 and S5). Impervious dikes will be placed upstream and downstream of disturbed area. Please see the Sheet EC1 for the pump around system details (Attachment E). All temporary structures will be removed from the channel after the work is complete. The channel and pipe improvements will primarily be constructed using a large excavator. A medium wheel loader will be used to transport materials. Dump truck will also be used to transport materials but will remain in the street. Asphalt paving machine: will be used to resurface the streets at the end of construction. Impact Justification and Mitigation 1. Avoidance and Minimization la. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project. Impacts to on-site jurisdictional waters of the U.S. have been reduced to the maximum extent practicable while still meeting the project goals. The culverts will be replaced within existing culvert footprints. The culverts must be replaced at the same approximate invert elevations because of conflicts with existing utilities. As shown o Sheet 4 (Attachment E), there is an existing 8" sanitary sewer directly beneath the proposed dual 48" Court Drive culvert. There is also a 24" sanitary sewer force main beneath the culvert. As shown on Sheet 5, there is an existing 24" sanitary sewer force main directly beneath the proposed dual 42" Wellman Street culvert. There is also an existing 8" sanitary sewer beneath the sewer on the downstream end. The inverts cannot be lowered due to the location of these existing utilities. Because of this, the City of Gastonia requests a waiver from the General Condition No. 3.6.1 as the proposed new pipe system ill not be buried. The current system has not been buried. 1 b. To determine which protected species are listed as occurring or potentially occurring within the project vicinity, and prior to conducting the on-site field investigation, CWS consulted the United States Fish and Wildlife Service (USFWS) Endangered and Threatened Species and Species of Concern by County for North Carolina online database for Gaston County. In addition, CWS performed a data review using the North Carolina Natural Heritage Program (NCNHP) Data Explorer on May 17, 2018 to determine if any record occurrences of federally -listed, candidate endangered, threatened species, or critical habitat were located within the project limits.
