The purpose of the project is to construct a commercial warehouse building for industrial use for Griffin Industrial Realty (Griffin). Background The site is located at 4530 Poplar Tent Road in Concord, Cabarrus County, North Carolina. The site consists of three parcels totaling approximately 22 acres. According to the Cabarrus County Online GIS Database website, the Parcel Identification Numbers (PINs) are: 02-004- 0022.00 (16.89 acres), 02-004-0020.00 (4.54 acres), and 02-004-0021.00 (0.83 acres). The site consists of agricultural fields, wooded land, and a single-family residence. Surrounding properties consist of agricultural fields, wooded land, single-family residences, and commercial properties. Based on the United States Geological Survey (USGS) Topographic Map, surface waters are not depicted on site. ECS received a Preliminary Jurisdictional Determination Letter (SAW -2017-01514) dated August 22, 2017, from Ms. Catherine Janiczak with the Charlotte Regional Office. The letter states that 261 LF of stream, 0.18 acres of wetlands, and 0.02 acres of impounded wetland area are considered to be jurisdictional waters. The approximate boundaries of these waters are shown on the enclosed delineation maps submitted with the original JD request. A copy of this letter is attached. Protect Description Griffin is a leading regional owner, operator and developer of industrial and other properties. Griffin owns over 3.7 million square feet in Connecticut and Pennsylvania and has land holdings totaling more than 4,500 acres in Connecticut, Massachusetts, North Carolina, Pennsylvania and Florida. Griffin has an acquisition and development strategy focused on the flexible and modern warehouses and light industrial buildings in strong regional markets in the Mid -Atlantic and Northeast. Griffin targets land for development or buildings that are strategically located in close proximity to major highways and transportation, and near densely populated markets. They have a history of developing on speculation as well as delivering build -to -suits on land they currently own. Griffin's development and construction work is performed in house by their construction team. The purpose of the project is to construct a commercial warehouse building for industrial use for Griffin. The site is located in the City of Concord, Cabarrus County, North Carolina, and is near the International Business Park. The site is currently vacant, but is zoned for light industrial use which is ideal for the intended use of the property. The proposed development consists of two industrial warehouse buildings, BMP stormwater ponds, and associated parking lots. Proposed Building A is 136,500 SF and 650' x 210', and proposed Building B is 147,000 SF and 700' x 210'. Site access will be located off of International Drive and Poplar Tent Road, and the two entrances and exits will allow for appropriate ingress/egress for traffic flow and emergency vehicle access. Typical materials and machinery will be used on-site during the construction process. Griffin has designed the buildings in an effort to minimize the footprint needed for successful tenant space, while also appropriately designing the parking lot to fulfill stormwater loading concerns and traffic flow through the site. Also, Griffin has identified this site as the optimal location for the two new facilities with the shared truck court: The building sizes, truck court configuration, parking lot size and location and trailer parking capability is driven by market demand and is necessary to lease these facilities. The minimum building depth and shared truck court width of 210' was used. These dimensions are industry standards based on ideal column spacing and 60 -foot speed bays for staging and shipping goods. Shared truck courts require ample maneuverability to back trailers into the loading bays. Employee parking is driven by market and local zoning requirements. The local zoning code requires two spaces per three employees at peak shift plus one space for each company vehicle. Each building is designed to accommodate 150 employees each (100 required parking spaces) and 10 company vehicles. The proposed site layout and stormwater management ponds (designed to City of Concord specification and meeting state minimum stormwater requirements) are designed to minimize impacts to the stream -portion of the jurisdictional feature. Unless these features are permanently impacted, this property cannot support industrial development for which it is zoned. Avoidance and minimization of waters was performed to the greatest extent possible with respect to the waters on-site and the space needed to allow successful operations for the future tenants. Impacts & Mitigation Based on the current site layout, the proposed permanent impacts include 132 LF of jurisdictional intermittent stream and 0.199 acres of jurisdictional wetlands. Based on the total proposed stream impacts being less than 150 LF, stream mitigation is not proposed. Total proposed wetland impacts are greater than 0.1 acres; therefore, wetland mitigation is included as part of the permit application. Mitigation for the proposed wetland impacts will be procured through payment into the N.C. Division of Mitigation Services (DMS). 2 ECS completed NC WAM forms for both jurisdictional wetland areas A and B, in which the wetland areas scored as low. Based on the information from the worksheet and field observations, ECS is proposing mitigation for the wetland at a 1 -to -1 ratio. Copies of these forms are included as attachments. ECS reviewed the Ribits website in an attempt to find stream mitigation credits in the Concord, Cabarrus County area or within the Yadkin -Pee Dee watershed. According to the Ribits website, mitigation banks and available credits are not located in the area. ECS contacted Ms. Kelly Williams, In -Lieu Fee Program Coordinator, with the Division of Mitigation Services (DMS). According to Ms. Williams, private banks that have credits in HUC 03040105 were not available at the time of the request. Ms. Williams also indicated that the current DMS rate in that HUC is $71,772/credit and that credits are available in quarter -acre (0.25) increments. Ms. Williams also mentioned that an In -Lieu Fee Mitigation Request form would need to be completed to request the appropriate mitigation credits. On January 16, 2017, ECS received the NCDMS Mitigation Credit Approval letter in order to reserve the appropriate wetland mitigation credits to mitigate for the proposed impacts on site. The Ribits mitigation bank request, email correspondence with the DMS, a signed copy of the request form, and the NCDMS Mitigation Credit Approval letter are attached to this permit application. Water Quality Certification ECS is providing 5 copies of this PCN to the North Carolina Division of Water Quality, to request the use of General WQC 4139. Since the project is located in a Phase II — Stormwater Section, the Stormwater Management Plan is being reviewed and approved by the City of Concord. The site is located in the City of Concord, Cabarrus County, North Carolina, and is near the International Business Park. The site is currently vacant, but is zoned for light industrial use which is ideal for the intended use of the property. Griffin performed an extensive study of the entire eastern seaboard for the new location, and Concord, NC was determined to be the ideal location to construct the warehouse. Additionally, commercial properties and industrial campuses are located on the western adjoining property, matching the intended use in the International Business Park. Requirements for potential sites that were evaluated included ease of access to highways and Interstates, sufficient property size for required building configuration and truck traffic flow, and a workforce capable of supporting the needs. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project: Griffin has designed the buildings in an effort to minimize the footprint needed for successful tenant space, while also appropriately designing the parking lot to fulfill stormwater loading concerns and traffic flow through the site. Also, Griffin has identified this site as the optimal location for the two new facilities with the shared truck court. The building sizes, truck court configuration, parking lot size and location and trailer parking capability is driven by market demand and is necessary to lease these facilities. The minimum building depth and shared truck court width of 210' was used. These dimensions are industry standards based on ideal column spacing and 60 -foot speed bays for staging and shipping goods. Shared truck courts require ample maneuverability to back trailers into the loading bays. Employee parking is driven by market and local zoning requirements. The local zoning code requires two spaces per three employees at peak shift plus one space for each company vehicle. The following comments are provided in accordance with the pry visions of the NT E, nvironim.entai Pviivy' I - (-^,2 vT.S. C. X321 et -J.) — coevtivai 7 of the Endangered Species Act of 1973, as amended (16 U.S.C. 1531-1543) (Act). Impervious Surfaces/Low Impact Development (LIDI - Studies' have shown that areas of 10- to 20 -percent impervious surface (such as roofs, roads, and parking lots) double the amount of storm -water runoff compared to natural cover and decrease deep infiltration (groundwater recharge) by 16 percent. At 35- to 50 -percent impervious surface, runoff triples, and deep infiltration is decreased by 40 percent. Above 75 -percent impervious surface, runoff is 5.5 times higher than natural cover, and deep infiltration is decreased by 80 percent. Additionally, the adequate treatment of storm water in development areas is essential for the protection of water quality and aquatic habitat in developing landscapes. Impervious surfaces collect pathogens, metals, sediment, and chemical pollutants and quickly transmit them (via storm -water runoff) to receiving waters. According to the Environmental Protection Agency, this nonpoint-source pollution is one of the major threats to water quality in the United States, posing one of the greatest threats to aquatic life, and is also linked to chronic and acute illnesses in human populations from exposure through drinking water and contact recreation. Increased storm -water runoff also directly damages aquatic and riparian habitat, causing stream -bank and stream- ' Federal Interagency Stream Restoration Working Group (15 federal agencies of the United States Government). In addition, impervious surfaces reduce groundwater recharge, resulting in even lower than expected stream flows during drought periods, which can induce potentially catastrophic effects for fish, mussels, and other aquatic life. Accordingly, we recommend that all developments, regardless of the percentage of impervious surface area they will create, implement storm -water -retention and -treatment measures designed to replicate and maintain the hydrograph at the preconstruction condition in order to avoid any additional impacts to habitat quality within the watershed. We recommend the use of low -impact -development techniques,' such as reduced road widths, grassed swales in place of curb and gutter, rain gardens, and wetland retention areas, for retaining and treating storm -water runoff rather than the more traditional measures, such as large retention ponds, etc. These designs often cost less to install and significantly reduce environmental impacts from development. Where detention ponds are used, storm -water outlets should drain through a vegetated area prior to reaching any natural stream or wetland area. Detention structures should be designed to allow for the slow discharge of storm water, attenuating the potential adverse effects of storm -water surges; thermal spikes; and sediment, nutrient, and chemical discharges. Also, because the purpose of storm -water -control measures is to protect streams and wetlands, no storm -water - control measures or best management practices should be installed within any stream (perennial or intermittent) or wetland. We also recommend that consideration be given to the use of pervious materials (i.e., pervious concrete, interlocking/open paving blocks, etc.) for the construction of roads, driveways, sidewalks, etc. Pervious surfaces minimize changes to the hydrology of the watershed and can be used to facilitate groundwater _recharge. Pervious materials are also less likely to absorb and store heat and allow the cooler soil below to cool the pavement. Additionally, pervious concrete requires less maintenance and is less susceptible to freeze/thaw cracking due to large voids within the concrete. Federally Listed Endangered and Threatened Species - Because the entire project is more than 65 miles from nearest known northern long-eared bat maternity site or hibernacula and there is suitable habitat in the surrounding area, the low probability/amount of "take" occurring as a result of this project is discountable and we believe this project is "not likely to adversely affect" this species. Though the project will result in the removal/loss of very little suitable northern long-eared bat habitat, and the probability of bats using the project area is very low, we recommend all tree felling occur before May 15 (or after August 15) to further lessen the likelihood of the proposed project adversely affecting this species. Our concurrence with a "not likely to adversely affect" determination is not dependent on this action - the cutting moratorium is a measure that can be implemented to further reduce the probability of "take" of this species. Obligations under section 7 of the Endangered Species Act must be reconsidered if.
