Summary of Proposed Work This report provides Pre -Construction Notification (PCN) documentation in accordance with General Condition #32 of the 2017 Nationwide Permits (82 FR 2003), regarding the permitting of the "Voice of America" project under the Clean Water Act (CWA) Section 404 permitting requirements. This project qualifies for verification under Nationwide Permit (NWP) #12 (Utility Line Activities) as outlined in 82 FR 1985, since the project area contains waters of the U.S. (WOUS) and the project will impact jurisdictional features for the purpose of rebuilding a 20 -mile long 11 5k transmission line within an existing right- of-way (ROW). Furthermore, the project requires approval under the North Carolina Department of Environmental Quality's (DEQ) Section 401 Water Quality Certification for Nationwide Permit #12. The remainder of this document presents the rationale and justification for this permitting scenario. B. Project Components The Voice of America TL 82 Transmission Rebuild Project is a 20 -mile long linear project along the existing Transmission Line 82 (TL -82) from Everetts substation located off West Main Street (ALT 64) in Martin County to the Leggett's Crossroad DP Substation, located off Horse Pen Swamp Road (1414). The scope of the project is to replace the existing aged transmission structures and lines with new H -frame structures. Several of the new towers may increase in height by five feet, but overall there will not be a significant change in tower height. There will be a temporary line located within certain locations of the easement during construction. They will mostly be located near existing substations and distribution points (DPs) so they can remain energized. The applicant will be utilizing various types of construction equipment to complete the work including but not limited to timbering equipment, drill rigs, concrete trucks, cranes and line pull equipment. Temporary stream impacts will result from the use of 12 -foot by 12 -foot timber bridges for construction access. The original cross-section of temporarily impacted streams will be restored and stabilized with matting and seed. In addition, temporary wetland impacts will result from the use of timber mats for construction access. C. Project Location The northern end of the 263 -acre project area is located approximately 2 miles south- southeast of the Town of Williamston in Martin County, North Carolina at Evertt's Substation. The project begins approximately 0.5 -miles west of the intersection of Kehukee Park Road and West Main Street (US 13 Alt.). The project corridor continues southward for approximately 13 miles to Wharton Substation. The southernmost end of the project corridor occurs approximately 0.4 -miles north of the intersection of VOA Road and Cherry Run Road at which point it turns west approximately 2 miles to Robersonville Road. At Robersonville Road, the project corridor turns north approximately 3.3 miles to its terminus at Horse Pen Swamp Road at Leggetts Crossroads DP. The project corridor also has a spur that runs east from the southernmost terminus for approximately 1 mile (See Vicinity Map in Appendix A). D. Waterway Receiving waters for this project include Ready Branch, Bear Grass Swamp, Horsepen Swamp, Aggie Run, Middle Tranters Creek, and unnamed tributaries. All streams are within the Lower Roanoke and Tar -Pamlico watersheds. 2 E. Jurisdictional Impacts Temporary Impacts 971,218.61 square feet (22.29 acres) of palustrine emergent wetlands (PEM) 438.74 linear feet (1,973.81 square feet) of stream Permanent Impacts (from new tower foundations) 358.14 square feet (0.004 acre) of PEM The impacts map, which identifies the scope of the project as well as erosion and sediment (E&S) controls, is included in Appendix B. II. ENVIRONMENTAL EFFECTS OF THE PROJECT A. General Site Conditions As observed on the Williamston (NC), Old Ford (NC), and Leggetts Crossroads (NC), USGS Quadrangle Map, the drainage networks on-site are primarily associated with the Tar -Pamlico River basin and its tributaries including Ready Branch, Bear Grass Swamp, Horsepen Swamp, Aggie Run, and Middle Tranters Creek. Potentially jurisdictional features can generally be found in the lowlands, interstream divides, and drainage swales. The project corridor is located within an existing, maintained overhead electrical utility easement. B. Existing Waters of the U.S. Angler conducted a wetland delineation on the project area from May 3 — June 15, 2016, in accordance with the Corps of Engineers' Wetlands Delineation Manual (Environmental Laboratory, 1987), as well as the Regional Supplement to the Corps of Engineers Wetland Delineation Manual. Eastern Mountain and Piedmont Region (Version 2.0) to identify those areas that are most likely within the regulatory purview of the U.S. Army Corps of Engineers (Corps). Based on the on-site field investigation of the approximately 263 -acre project area, Angler has identified potentially jurisdictional WOUS consisting of 96.46 acres of palustrine emergent wetlands (PEM), 0.11 acres of palustrine forested wetlands (PFO), 20,014 linear feet of streams, and 0.75 acres of palustrine open water (POW). A confirmation site visit was conducted with the Corps in September 2016 to confirm the delineation. The confirmation is still pending. Copies of the Delineation Report and the WOUS Delineation Map are provided in Appendix C. C. Threatened/ Endangered Species For this project, Angler queried the U.S. Fish and Wildlife Service's (USFWS) Information for Planning and Consultation (IPaC) system and the USFWS North Carolina County database concerning federally threatened and/or endangered species that may exist within the project area. Eleven federally -listed species, and one federally -protected species were identified by these databases (Table 1). In the following narrative, Angler evaluated the findings and identified the likelihood of these species either having habitat, or possibly occurring within, this project area. 3 Table 1. These include the green sea turtle, Atlantic sturgeon, shortnose sturgeon, West Indian manatee, and Kemp's Ridley sea turtle. The green sea turtle is generally found in shallow waters inside reefs, bays, and inlets. This species has not been identified in the vicinity of this project and this project will have no effect on this species. The federally -endangered Atlantic and shortnose sturgeons occur in major river systems, which are not located within the project area. These sturgeon species will not be affected by this project. The federally -threatened West Indian manatee has been observed in all North Carolina coastal counties, and is found in 5-20 feet of water in canals, sluggish rivers, estuarine habitats, salt water bays, and even offshore. No waterways that support manatee habitat are located within the project limits, and this project will have no effect on this species. Finally, the Kemp's Ridley sea turtle is known to nest on North Carolina beaches, which are not found within the project area. This project is located well inland and will have no effect on the Kemp's Ridley sea turtle. Additionally, disturbance areas proposed under this application are 4 relatively minor in scope, and will be conducted with proper erosion and sediment control measures, so sedimentation downstream should not be a concern for this work. Two of the listed species are found in shoreline habitats, the red knot and sensitive joint - vetch. The red knot is a shorebird found primarily on seacoasts on tidal flats and marine and estuarine beaches. It can also be found less frequently in marshes and flooded fields. According to the Cornell Lab of Ornithology eBird website, which allows users to track sightings of birds by species and date, the nearest recorded sighting of a red knot was about 37 miles east of the northern limit of the project site. Sensitive joint -vetch is an intertidal dwelling annual plant preferring slightly brackish conditions. According to the Raleigh USFWS field office website, sensitive join -vetch distribution in North Carolina includes Hyde County. Therefore, it is not expected to occur within the project area. This project will have no effect on either the red knot or sensitive -joint vetch. Four species identified in the IPAC databases that could potentially have ranges within the project area include the red -cockaded woodpecker, red wolf, northern long-eared bat (NLEB), and the rough -leaved loosestrife. The red -cockaded woodpecker excavates nesting cavities in mature living southern pine species, especially longleaf pine (Pinus palustris). For nesting, the bird typically requires at least sixty -year-old trees, and prefers forest stands with a regular fire regime. For foraging, the understory must be clear, and the presence of a hardwood understory signifies that there is not suitable foraging habitat for this species. The majority of the project area is maintained ROW and work within the existing corridor will not affect this species. However, a total of 1.35 acres of trees will be cleared for this project in three separate areas. In the first area that will be cleared, Leggets Crossroads DP, 0.38 acre of trees will be cleared. This area is a loblolly pine stand approximately 25-30 years in age, with tree diameter at breast height (DBH) of 8-12 inches. The understory in this location was approximately 80% cover of hardwood species. The second area, Leggets Junction, contains about 0.38 acre to be cleared, and trees in this area are also primarily loblolly pine. These trees are 10-15 years old with a 6-8 inches DBH and growing so densely that there was no opportunity for understory to establish. The third area, Wharton, contained 40 to 60 -year-old loblolly pines, which are of sufficient age for nesting; however, this stand also had a dense hardwood understory. Additionally, all trees of sufficient age within this small, 0.52 acre proposed clearing area were evaluated for red -cockaded woodpecker nests by Angler, and no nest trees were identified. These three areas do not contain suitable foraging habitat for red -cockaded woodpecker, and the trees of sufficient age to provide nesting cavities do not contain nests. Finally, the nearest sightings of this species recorded on the aforementioned eBird website are approximately 42 miles away. Based on these findings, the species may be affected, but it is unlikely to be adversely affected due to the type of trees and amount of area to be cleared. Red wolves were introduced to several counties in eastern North Carolina as part of an experimental recovery program established in the 1980s by the USFWS. These animals are protected under the Endangered Species Act, however, with regard to Section 7 coordination, when occurring on private property they are treated as a species proposed for listing with no special work conditions. According to Mr. Michael Morse of the USFWS — Manteo Office, the currently -known extent of the red wolf range in North Carolina is believed to be to the south of Pamlico River. This project, located north of Washington, should not adversely affect the red wolf. Based on these findings, the species may be 5 affected, but it is unlikely to be adversely affected due to the small amount of clearing that will take place and overall nature of the line remaining intact. Summer habitat for the NLEB consists of both live trees and snags, where they will roost singly or in colonies underneath bark, in cavities or crevices. Males and non -reproductive females may also roost in cooler places; such as caves or mines. The NLEB is flexible in selecting roosts, choosing roost trees based on suitability to retain bark or provide cavities or crevices. Approximately 1.35 acres of tree clearing is proposed as part of the project. According to the January 5, 2016, Programmatic Biological Opinion for Final 4(d) Rule on the Northern Long -Eared Bat and Activities Excepted from Take Prohibitions, incidental take of the NLEB associated with forest conversion (e.g. tree clearing) is not prohibited as long as the activity occurs outside of a 150 -foot radius of known maternity roost trees during pup season (June 1 — July 31) and outside of a quarter -mile radius of known hibernaculum at any time of year. The project area is not located within 150 feet of a maternity roost or within a quarter mile of a hibernacula. Therefore, Section 7 responsibilities are fulfilled through reliance on the January 5, 2016, Programmatic Biological Opinion. Based on these findings, the species may be affected, but it is unlikely to be adversely affected due to the small amount of clearing that will take place. Finally, rough -leaved loosestrife is a perennial plant that grows in ecotones or in edges between longleaf pine uplands and areas of dense shrub and vine growth on wet, peaty, poorly drained soils on moist to seasonally saturated sands and on shallow organic soils overlaying sand (Raleigh Ecological Services Field Office). This species is threatened by habitat elimination through fire suppression, wetland drainage, and development. According to the Raleigh Ecological Services Field Office website on the species, there are historical records of populations of rough -leaved loosestrife in Beaufort County. Habitat for this species is potentially found within the project limits. Angler contacted Mr. Dale Suiter of the Raleigh Field Office on September 21, 2016, to confer on the occurrence of rough -leaved loosestrife within Beaufort County. He stated that he believes historical occurrences of the species occurred in the southern part of Beaufort, with no known instances of the species in the northwestern part of the county near the project area. Additionally, the majority of impacts occurring for this project are temporary in nature, and matting will be installed in wetland areas to prevent permanent impacts. There are no known populations of rough -leaved loosestrife within five miles of the project site. It is possible that this species may be affected, but it is unlikely to be adversely affected due to the distance from known historical or current populations, and the minimal permanent impacts associated with this project. Bald eagles were identified as likely to occur within Beaufort and Martin Counties. Habitat for the bald eagle primarily consists of mature forest in proximity to large bodies of open water for foraging. Large dominant trees are utilized for nesting sites, typically within 1.0 mile of open water. A desktop -GIS assessment of the project study area, as well as the area within a 1.13 -mile radius (1.0 mile plus 660 feet) of the project limits, was performed on September 13, 2016 using 2015 color aerials on Google Earth. No water bodies large enough or sufficiently open to be considered potential feeding sources were identified. Since there was no foraging habitat within the review area, a survey of the project study area and the area within 660 feet of the project limits was not conducted. Due to the lack of habitat, known occurrences, and minimal impact anticipated for this project, it has been determined that this project will not affect this species. The complete findings of this query are included in report form in Appendix D. 0 D. Cultural/ Historic Resources To address potential impacts to cultural and historical resources for this project, Angler coordinated with the North Carolina state archeologist, Susan Myers, on August 30, 2016, and subsequently reviewed the North Carolina state SHPO databases for known resources. Ms. Myers identified no archeological sites within or in the vicinity of the project area. Based on Angler's review of databases, there are no known cultural or historic resources within the proposed expansion area or adjacent to the project area. The nearby resources identified studied sites within the vicinity of the project area, however no sites were proposed eligible or listed on the National Register of Historic Places (NRNP). Mapping showing study sites within the project area is included in Appendix E. E. Proposed Impacts to Waters of the U.S. The proposed temporary impacts include 971,218.61 square feet (22.29 acres) of PEM wetlands and 438.74 linear feet (1,973.8 square feet) of stream. The proposed permanent impacts include 358.14 square feet (0.004 acre) of PEM wetlands. The locations of these impacts are depicted on the E&S Maps and Impact Table in Appendix B. III. PERMIT CONDITIONS A. Avoidance and Minimization Throughout the project's planning and design process, the applicant has evaluated alternative construction options in the attempt to avoid and minimize impacts to WOUS and other natural resources to the greatest extent practicable. The result of that planning has limited the permanent impacts to WOUS to 358.14 square feet of PEM wetlands along the project length. Timber mats and timber mat bridges will be placed across all temporary stream and wetland crossings and all temporary impacts will be returned to pre-existing contours and seeded with a local wetland mix when work is complete. B. Compensation Based on the mitigation threshold for permanent impacts associated with NWP #12, compensatory mitigation is not proposed for the project. C. General Conditions NWP #12 authorizes activities in WOUS associated with utility line activities. This section details the applicable NWP General Conditions as related to the proposed project. 1. Navigation Not applicable to this project. 2. Aquatic Life Movements Not applicable to this project, no disruption to any necessary life -cycle movements of aquatic life is anticipated to result from the project. Please see NWP #12 Virginia Special Conditions. 3. Spawning Areas Not applicable to this project. Please see Virginia NWP #12 regional conditions. 4. Migratory Bird Breeding Areas 7 Activities in waters of the United States that serve as breeding areas for migratory birds must be avoided to the maximum extent practicable. This project will comply with this condition. 5. Shellfish Beds Not applicable to this project. 6. Suitable Material This project will comply with this condition. 7. Water Supply Intakes Not applicable to this project. 8. Adverse Effects from Impoundments Not applicable to this project. 9. Management of Water Flows To the maximum extent practicable, the pre -construction course, condition, capacity, and location of open waters must be maintained for each activity, including stream channelization and storm water management activities, except as provided below. The activity must be constructed to withstand expected high flows. The activity must not restrict or impede the passage of normal or high flows, unless the primary purpose of the activity is to impound water or manage high flows. The activity may alter the pre -construction course, condition, capacity, and location of open waters if it benefits the aquatic environment (e.g., stream restoration or relocation activities). This project will comply with this condition. 10. Fills Within 100 -Year Floodplains. The activity must comply with applicable FEMA -approved state or local floodplain management requirements. According to FEMA Flood Insurance Rate Maps (FIRMs), portions of the project area are located in Zone A, which is designated as an area within the 100 -year flood zone. However, no fill associated with the project is proposed. 11. Equipment No heavy equipment associated with this project is anticipated to be working in preserved jurisdictional areas on the property. However, if this is required during construction, appropriate measures will be taken to minimize soil disturbance in these areas. 12. Soil Erosion and Sediment Controls All appropriate soil E&S controls will be used during construction in accordance with North Carolina DEQ requirements and an approved E&S control plan. 13. Removal of Temporary Fills All temporary fills in jurisdictional areas will be removed following construction activities. 14. Proper Maintenance This project, to be authorized by NWP #12, will be maintained in accordance with all applicable federal, state, and or local construction requirements to ensure public safety. This project will comply with this condition. L 15. Single and Complete Project The activity must be a single and complete project. The same NWP cannot be used more than once for the same single and complete project. This project will comply with this condition. 16. Wild and Scenic Rivers. No activity may occur in a component of the National Wild and Scenic River System, or in a river officially designated by Congress as a "study river" for possible inclusion in the system while the river is in an official study status, unless the appropriate Federal agency with direct management responsibility for such river, has determined in writing that the proposed activity will not adversely affect the Wild and Scenic River designation or study status. If a proposed NWP activity will occur in a component of the National Wild and Scenic River System, or in a river officially designated by Congress as a "study river" for possible inclusion in the system while the river is in an official study status, the permittee must submit a pre -construction notification (PCN). The permittee shall not begin the NWP activity until notified by the district engineer that the Federal agency with direct management responsibility for that river has determined in writing that the proposed NWP activity will not adversely affect the Wild and Scenic River designation or study status. Information on Wild and Scenic Rivers may be obtained from the appropriate Federal land management agency responsible for the designated Wild and Scenic River or study river (e.g., National Park Service, U.S. Forest Service, Bureau of Land Management, U.S. Fish and Wildlife Service). No Wild and Scenic Rivers are located within the project area. 17. Tribal Rights No activity or its operation may impair reserved tribal rights, including, but not limited to, reserved water rights and treaty fishing and hunting rights. This project will comply with this condition. 18. Endangered Species See Section ll. C above. Results of the online project review are included in Appendix D. 19. Migratory Birds and Bald and Golden Eagles The permittee is responsible for ensuring their action complies with the Migratory Bird Treaty Act and the Bald and Golden Eagle Protection Act. The permittee is responsible for contacting the appropriate local office of the U.S. Fish and Wildlife Service to determine applicable measures to reduce impacts to migratory birds or eagles, including whether "incidental take" permits are necessary and available under the Migratory Bird Treaty Act or Bald and Golden Eagle Protection Act for a particular activity. This project will comply with this condition. 20. Historic Properties See Section ILD above. Mapping is included in Appendix E. 21. Discovery of Previously Unknown Remains and Artifacts If you discover any previously unknown historic, cultural or archeological remains and artifacts while accomplishing the activity authorized by this permit, you must immediately notify the district engineer of what you have found, and to the maximum extent practicable, avoid construction activities that may affect the remains and artifacts until the required E coordination has been completed. The district engineer will initiate the Federal, Tribal and state coordination required to determine if the items or remains warrant a recovery effort or if the site is eligible for listing in the National Register of Historic Places. This project will comply with this condition. 22. Designated Critical Resource Waters Critical resource waters include NOAH -managed marine sanctuaries and marine monuments, and National Estuarine Research Reserves. The district engineer may designate, after notice and opportunity for public comment, additional waters officially designated by a state as having particular environmental or ecological significance, such as outstanding national resource waters or state natural heritage sites. The district engineer may also designate additional critical resource waters after notice and opportunity for public comment. a) Discharges of dredged or fill material into waters of the United States are not authorized by NWPs 7, 12, 14, 16, 17, 21, 29, 31, 35, 39, 40, 42, 43, 44, 49, 50, 51, and 52 for any activity within, or directly affecting, critical resource waters, including wetlands adjacent to such waters. b) For NWPs 3, 8, 10, 13, 15, 18, 19, 22, 23, 25, 27, 28, 30, 33, 34, 36, 37, and 38, notification is required in accordance with general condition 31, for any activity proposed in the designated critical resource waters including wetlands adjacent to those waters. The district engineer may authorize activities under these NWPs only after it is determined that the impacts to the critical resource waters will be no more than minimal. 23. Mitigation Based on the mitigation threshold for permanent impacts associated with NWP #12, compensatory mitigation is not required for the project. 24. Safety of Impoundment Structures To ensure that all impoundment structures are safely designed, the district engineer may require non -Federal applicants to demonstrate that the structures comply with established state dam safety criteria or have been designed by qualified persons. The district engineer may also require documentation that the design has been independently reviewed by similarly qualified persons, and appropriate modifications made to ensure safety. Not applicable to this project. 25. Water Quality This project will comply with all required local and State water quality regulations, including erosion and sediment control measures to ensure that the project will not cause more than minimal degradation of downstream water quality. 26. Coastal Zone Management In coastal states where an NWP has not previously received a state coastal zone management consistency concurrence, an individual state coastal zone management consistency concurrence must be obtained, or a presumption of concurrence must occur (see 33 CFR 330.4(d)). The district engineer or a State may require additional measures to ensure that the authorized activity is consistent with state coastal zone management requirements. This project will comply with this condition. 27. Regional and Case -By -Case Conditions 10 The activity must comply with any regional conditions that may have been added by the Division Engineer (see 33 CFR 330.4(e)) and with any case specific conditions added by the Corps or by the state, Indian Tribe, or U.S. EPA in its section 401 Water Quality Certification, or by the state in its Coastal Zone Management Act consistency determination. This project will comply with this permit. 28. Use of Multiple Nationwide Permits Not applicable to this project. 29. Transfer of Nationwide Permit Verifications If the permittee sells the property associated with a nationwide permit verification, they will submit a letter to the appropriate Corps district office to validate the transfer. 30. Compliance Certification The permit applicant will submit a signed certification following completion of the authorized work, in accordance with this NWP General Condition. 31. Activities Affecting StructuresMorks Built by the US Not applicable to this project. 32. Pre -Construction Notification This PCN document has been prepared in accordance with the notification requirements of NWP General Condition #32. D. 2017 Regional Conditions Specific to NWP #12 1.0 Excluded Waters The Corps has identified waters that will be excluded from the use of all NWP's during certain timeframes. These waters are: 1.1 Anadromous Fish Spawning Areas 1.2 Trout Waters Moratorium 1.3 Sturgeon Spawning Areas as Designated by the NMFS There are no Excluded Waters within the limits of the project. 2.0 Waters Requiring Additional Notification The Corps has identified waters that will be subject to additional notification requirements for activities authorized by all NWP's. These waters are: 2.1 Western NC Counties that Drain to Designated Critical Habitat Not applicable for this project. 2.2 Special Designation Waters Prior to the use of any NWP in any of the following identified waters and contiguous wetlands in North Carolina, applicants must comply with Nationwide Permit General Condition 32 (PCN). This project will comply with this condition. 2.3 Coastal Area Management Act (CAMA) Areas of Environmental Concern 2.4 Barrier Islands 11 2.5 Mountain or Piedmont Bogs 2.6 Animal Waste Facilities 2.7 Trout Waters There are no Waters identified in Sections 2.3-2.7 within the limits of this project. 3.0 List of Corps Regional Conditions for All Nationwide Permits The following conditions apply to all Nationwide Permits in the Wilmington District: 3.1 Limitation of Loss of Perennial Stream Bed NWPs may not be used for activities that may result in the loss or degradation of greater than 300 total linear feet of perennial, intermittent or ephemeral stream. Not applicable for this project. 3.2 Mitigation for Loss of Stream Bed For any NWP that results in a loss of more than 150 linear feet of perennial and/or ephemeral/intermittent stream, the applicant shall provide a mitigation proposal to compensate for more than minimal individual and cumulative adverse impacts to the aquatic environment. Not applicable for this project. 3.3 Pre -construction Notification for Loss of Streambed Exceeding 150 Feet. Prior to use of any NWP for any activity which impacts more than 150 total linear feet of perennial stream or ephemeral/ intermittent stream, the applicant must comply with Nationwide Permit General Condition 31 (PCN). Not applicable for this project. 3.4 Restriction on Use of Live Concrete For all NWPs which allow the use of concrete as a building material, live or fresh concrete, including bags of uncured concrete, may not come into contact with the water in or entering into waters of the US. Water inside coffer dams or casings that has been in contact with wet concrete shall only be returned to waters of the US when it is no longer poses a threat to aquatic organisms. Not applicable for this project. 3.5 Requirements for Using Riprap for Bank Stabilization Not applicable for this project. 3.6 Safe Passage Requirements for Culvert Placement Not applicable for this project. 3.7 Notification to NCDENR Shellfish Sanitation Section Not applicable for this project. 3.8 Preservation of Submerged Aquatic Vegetation Not applicable for this project. 3.9 Sedimentation and Erosion Control Structures and Measures All PCNs will identify and describe sedimentation and erosion control structures and measures proposed for placement in waters of the US. The structures and measures 12 should be depicted on maps, surveys or drawings showing location and impacts to jurisdictional wetlands and streams. Please see Appendix B. 4.0 Additional Regional Conditions for Specific Nationwide Permits 4.1 NWP #12 - Utility Line Activities 4.1.1. Pipeline/utility line construction through jurisdictional waters and wetlands will be accomplished utilizing directional drilling/boring methods to the maximum extent practicable. Not applicable for this project. 4.1.2. Temporary discharge of excavated or fill material into wetlands and waters of the United States will be for the absolute minimum period of time necessary to accomplish the work. Temporary discharges will be fully contained with appropriate erosion control or containment methods or otherwise such fills will consist of non -erodible materials. This project will comply with this condition. 4.1.3. The work area authorized by this permit, including temporary and/or permanent fills, will be minimized to the greatest extent practicable. This project will comply with this condition. 4.1.4. In areas where a sub -aqueous utility line is to cross a federally -maintained channel, (i.e., the Atlantic Intracoastal Waterway [AIWW]), the line will be buried at least six (6) feet below the allowable overdepth of the authorized channel, including all side slopes. For areas outside federally -maintained channels, sub -aqueous lines must be installed at a minimum depth of two (2) feet below the substrate when such lines might interfere with navigation. Not applicable for this project. 4.1.5. The minimum clearance*(see NOTE in 4.3.6.) for aerial communication lines, or any lines not transmitting electrical power, will be ten (10) feet above the clearance required for nearby stationary bridges as established by the U.S. Coast Guard. Not applicable for this project. 4.1.6. The minimum clearance* for an aerial line, transmitting electrical power, is based on the low point of the line under conditions that produce the greatest sag, taking into consideration temperature, load, wind, length or span and the type of supports. Not applicable for this project. 4.1.7. On navigable waters of the US, including all federal navigation projects, where there is no bridge for reference for minimum clearance, the proposed project will need to be reviewed by the US Army Corps of Engineers in order to determine the minimum clearance between the line and MHW necessary to protect navigational interests. Not applicable for this project. 4.1.8. A plan to restore and re -vegetate wetland areas cleared for construction must be submitted with the required PCN. Cleared wetland areas shall be re -vegetated to the maximum extent practicable with native species of canopy, shrub, and herbaceous species. Fescue grass shall not be used. 13 This project will comply with this condition. 4.1.9. For the purposes of this NWP, any permanently maintained corridor along the utility ROW within forested wetlands shall be considered a permanent impact and a compensatory mitigation plan will be required for all such impacts associated with the requested activity. This project will comply with this condition. 4.1.10. Use of rip -rap or any other engineered structures to stabilize a stream bed should be avoided to the maximum extent practicable. If riprap stabilization is needed, it should be placed only on the stream banks, or, if it is necessary to be placed in the stream bed, the finished top elevation of the riprap should not exceed that of the original stream bed. This project will comply with this condition. 4.1.11. When directional boring or horizontal directional drilling (HDD) under waters of the U.S., including wetlands, permittees shall closely monitor the project for hydraulic fracturing or "fracking." Any discharge from hydraulic fracturing or "fracking" into waters of the U.S., including wetlands, shall be reported to the appropriate Corps Regulatory Field Office within 48 hours. Restoration and/or mitigation may be required as a result from any unintended discharges. Not applicable for this project. E. Section 401 Water Quality Certification Activities meeting any one of the following thresholds or circumstances require written approval for a 401 Water Quality Certification from the Division of Water Quality: a) Permanent impacts to any wetlands and/or waters, including streams; or b) Any stream relocation; or c) Impacts to any wetlands and/or waters if the maintenance corridor in a wetland or at a stream crossing is greater than 15 feet wide (except activities located in areas with Riparian Area Protection Rules when the maintenance corridor at stream crossing must be 10 feet wide or less). Gas pipelines may have a maintenance corridor wider than fifteen feet if mitigation is provided for these additional wetland fills. d) Any impact associated with a Notice of Violation or an enforcement action for violation(s) of DWQ Wetland Rules (15A NCAC 02H .0500), Isolated Wetland Rules (15A NCAC 02H.1300), DWQ Surface Water or Wetland Standards, or Riparian Buffer Rules (15A NCACO2B .0200); or e) Any impacts to streams and/or buffers in the Neuse, Tar -Pamlico, or Catawba River Basins or in the Randleman, Jordan or Goose Creek Watersheds (or any other basin or watershed with Riparian Area Protection Rules [Buffer Rules] in effect at the time of application) unless the activities are listed as "EXEMPT" from these rules or a Buffer Authorization Certificate is issued through N.C. Division of Coastal Management (DCM) delegation for "ALLOWABLE" activities. The project appears to qualify for written approval since it meets one of the thresholds listed above. 14 Activities included in this General Certification that do not meet one of the thresholds listed above do not require written approval from the Division as long as they comply with the Conditions of Certification listed below. If any of these Conditions cannot be met, then written approval from the Division is required. Conditions of Certification 1. No impacts beyond those authorized in the written approval or beyond the threshold of use of this certification. 2. Standard erosion and sediment control practices must be in full compliance with all specifications. 3. No sediment and erosion control measures in wetlands or waters. 4. An NPDES Construction Stormwater Permit is required for construction projects that disturb one or more acres of land. 5. Construction Moratoriums and Coordination If activities must occur during periods of high biological activity (i.e. sea turtle nesting, fish spawning, or bird nesting), then biological monitoring may be required at the request of other state or federal agencies and coordinated with these activities. 6. Work in the Dry All work in or adjacent to stream waters shall be conducted so that the flowing stream does not come in contact with the disturbed area. 7. Riparian Area Protection (Buffer) Rule Activities located in the protected riparian areas (whether jurisdictional wetlands or not), within the Neuse, Tar -Pamlico, or Catawba River Basins or in the Randleman, Jordan, or Goose Creek Watersheds. 8. Compensatory Mitigation In accordance with 15A NCAC 02H .0506 (h), compensatory mitigation may be required for losses of equal to or greater than 150 linear feet of streams (intermittent and perennial) and/or equal to or greater than one (1) acre of wetlands. For linear public transportation projects, impacts equal to or exceeding 150 linear feet per stream shall require mitigation. Buffer mitigation may be required for any project with Buffer Rules in effect at the time of application for activities classified as "Allowable with Mitigation" or "Prohibited" within the Table of Uses. 9. Relocated stream designs should include the same dimensions, patterns, and profiles as the existing channel (or a stable reference reach if the existing channel is unstable), to the maximum extent practical. 10. Utility lines within the Riparian Buffers shall be installed in accordance with the Table of uses in the most recent version of the appropriate buffer rules. Utility lines shall not cross a stream channel at other than a near -perpendicular direction (i.e. 15 stream channel crossings shall not be at an angle of less than 75 degrees or more than 105 degrees to the stream bank). 11. Any wastewater line that crosses any stream shall be installed in accordance with the most recent version of the Gravity Sewer Minimum Design Criteria. 12. If concrete is used during the construction, then all necessary measures shall be taken to prevent direct contact between uncured or curing concrete and waters of the state. 13. Any rip -rap required for proper culvert placement, stream stabilization, or restoration of temporarily disturbed areas shall be restricted to the area directly impacted by approved construction activity. 14. Annual native species suitable for wet locations shall be planted and established within jurisdictional wetlands for soil and erosion control. Non-native perennials such as fescue are prohibited. 15. A one-time application of fertilizer to re-establish vegetation is allowed in disturbed areas including riparian buffers, but is restricted to no closer than 10 feet from top of bank of streams. 16. The construction corridor (including access roads, sediment and erosion control measures and stockpiling of materials) is limited to 40 feet (12.2 meters) in width in wetlands and across stream channels and must be minimized to the maximum extent practicable. 17. Permanent, maintained access corridors shall be restricted to the minimum width practicable and shall not exceed 15 feet in width except at manhole locations. 18. An anti -seep collar shall be placed at the downstream (utility line gradient) wetland boundary and every 150 feet (45. 7 meters) up the gradient until the utility exits the wetland for buried utility lines. 19. The applicant shall have a specific plan for restoring wetland contours. Any excess material will be removed to a high ground disposal area. 20. If an environmental document is required under the National or State Environmental Policy Act (NEPA or SEPA), then this General Certification is not valid until a Finding of No Significant Impact (FONSI) or Record of Decision (ROD) is issued by the State Clearinghouse. 21. In the twenty (20) coastal counties, the appropriate DWO Regional Office must be contacted to determine if Coastal Stormwater Regulations will be required. 22. This General Certification does not relieve the applicant of the responsibility to obtain all other required Federal, State, or Local approvals. 23. The applicant/permittee and their authorized agents shall conduct all activities in a manner consistent with State water quality standards (including any requirements 16 resulting from compliance with §303(d) of the Clean Water Act), and any other appropriate requirements of State and Federal Law. 24. When written authorization is required for use of this certification, upon completion of all permitted impacts included within the approval and any subsequent modifications, the applicant shall be required to return the certificate of completion attached to the approval. 25. Additional site-specific conditions, including monitoring and/or modeling requirements, may be added to the written approval letter for projects proposed under this Water Quality Certification in order to ensure compliance with all applicable water quality and effluent standards. 26. This certification grants permission to the director, an authorized representative of the Director, or DENR staff, upon the presentation of proper credentials, to enter the property during normal business hours.
