On behalf of Lambert Development, LLC., we are requesting Buffer Authorization from the
NCDWR for 1,184 sq ft of permanent Zone 2 buffer impacts for construction of a road crossing.
The project is a ±1.76 acre assemblage comprised of 7 parcels (Wake Co. PIN#: 1703369192,
1703460143, 1703460192, 1703461141, 1703462102, 1703463116 and 1703463009) located
at 611 W South Street, in Raleigh (35.772096°N; -78.648904°W). The project is located in the
Neuse River basin and onsite waters drain to Rocky Branch. The Water Quality Classification for
Rocky Branch is C; NSW and the Stream Index Number is: 27-34-6. The cataloging unit for the
site is 03020201.
Proposed Project
The purpose of the proposed project is to construct two condominium buildings with a total of 84
units in order to meet the ever growing demand for residential housing in downtown Raleigh. The
overall proposed project consists of the construction of two condominium buildings with ground
level parking garages below the buildings, additional external parking, roadways, and associated
infrastructure.
The project is an urban redevelopment project. The seven parcels this project encompasses have
historically been used as an automotive repair shop. The site has been historically contaminated,
and is currently under review for approval of a Brownfields Agreement with the State for the
redevelopment. The existing riparian buffer has been historically disturbed and degraded, and a
portion of the riparian buffer has been removed from construction of a gravel pad from the
historical use as a parking area for the automotive repair shop formerly on the property (see
attached 2013 & 2016 Aerial Photo). The gravel parking area is noted in the Existing Conditions
Survey, which has been provided as an Appendix.

Project History
There are no wetlands within the project area, as the project has been historically cleared, filled
and graded. The only jurisdictional feature within the vicinity of the project is a perennial UT to
Rocky Branch, located offsite to the site which originates at the outfall of an existing storm
drainage pipe.
NCDWR issued a Buffer Determination (NBRRO 16-084) for the project area on 04/01/2016. A
copy of the Buffer Determination has been provided as an Appendix.
NCDWR issued a Buffer Authorization (DWR#16-0564) for the 611 West South Street project on
07/01/2016, for the replacement of an existing storm drainage pipe which runs through the
project area. The previous Buffer Authorization approved 4,687 sq ft of permanent riparian buffer
impacts (zone 1: 1,815 sq ft; zone 2: 2,872 sq ft) associated with the replacement of the failing
storm drainage pipe and establishment of a permanent drainage easement through the buffers. A
copy of the previously issued Buffer Authorization for the replacement of the existing storm
drainage pipe has been provided as an Appendix. Please note that the replacement of the storm
drainage pipe has not been conducted, and will be take place during general construction of the
project.
NCDWR issued a Buffer Authorization (DWR#16-0564 V2) for the 611 West South Street project
on 05/03/2018 authorizing buffer impacts for a road crossing. The previous Buffer Authorization
approved 4,058 sq ft of permanent riparian buffer impacts (zone 1: 1,304 sq ft; zone: 2,754 sq ft)
associated with the construction of a road crossing to access the western building. A copy of the
previously issued Buffer Authorization for the road crossing has been provided as an Appendix.
Please note that due to revisions to the site plan, the road crossing will not be constructed, and
the proposed project as shown in the attached impact plan will be constructed as an alternative.
Proposed Impacts
The proposed impacts consist of 1,184 sq ft of permanent Zone 2 impacts to riparian buffers for
the construction of an underground detention SCM (sand filter), and installation of stormwater
conveyance pipes which will connect to the drainage pipe that was previously permitted to be
replaced.
Please note that the southern parking area for the eastern building is located within the existing
gravel parking pad. The gravel parking pad is exempt from riparian buffers as existing impervious
area, and therefore, will not result in impacts to riparian buffers.
Avoidance and Minimization
Prior to site plan design, the applicant requested a buffer determination be conducted so that
impacts to buffers could be minimized.

Buffer impacts have been minimized to only those necessary for construction of the sand filter
SCM and stormwater conveyance pipes in order to treat onsite stormwater and convey treated
stormwater to an existing storm drainage pipe.
The proposed project design was driven by site constraints, including the small footprint
associated with urban redevelopment, a 50' storm drainage easement that bisects the site and
limited access from W. South Street. The 50' storm drainage easement is required for protection
of an existing storm drainage pipe which conveys runoff from significant area of upstream urban
watershed and discharges into a perennial UT to Rocky Branch located south of the project.
Mitigation
The proposed buffer impacts will result from construction of an SCM, which is classified as
"Allowable" in the Neuse River basin table of uses, and therefore does not require mitigation.
The current request is for 1,184 sq ft of permanent impacts to riparian buffers (see the attached
maps and PCN for details).

2. Diffuse Flow
All stormwater must be directed and maintained as diffuse flow at non-erosive velocities
through the protected stream buffers such that it will not re -concentrate before discharging
into a stream. [15A NCAC 02H .0506(b)(5)]
3. No Waste, Spoil, Solids, or Fill of Any Kind
No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas
beyond the footprint of the impacts depicted in the Pre -Construction Notification. All
construction activities, including the design, installation, operation, and maintenance of
sediment and erosion control Best Management Practices, shall be performed so that no
violations of state water quality standards, statutes, or rules occur [15A NCAC 02H .0501

The stormwater management plan (SMP) must be approved by the City. of Raleigh an -d meet
the requirements of this Certification. The SMP may not be modified without prior written

No;wa'ste, spoil, solids, or fill of any kind sli,all occur in wetlands, waters, or riparian areas
