Dear Mr. Lastinger and Ms. Higgins,
On behalf of the Town of Holly Springs, we are requesting authorization from the USACE to use
NWP 14 for 20 If of permanent stream impacts and 43 If of temporary stream impacts, for
construction of the proposed project. We are also requesting a 401 WQC from NCDWR for the
above referenced impacts.
The project review area consists of approximately ±0.65 acres along NC Hwy 55 Bypass and
Sportsmanship Way in Holly Springs, Wake County NC (see attached Exhibits). The review area is
adjacent to, and part of, the Town of Holly Springs North Main Athletic Complex (NMAC).
The project is located in the Cape Fear River basin and onsite waters drain to Little Branch (Stream
Index Number 18-7-6-1-1). The Water Quality Classification for Little Branch is Class C, and the
cataloging unit for the site is 03030004.
Proposed Project
The purpose of the proposed project is to provide an additional entrance to the NMAC from Hwy
55 Bypass, in order to improve traffic flow in and out of the NMAC, and alleviate current traffic
congestion due to all visitors currently entering from Main Street. The project consists of the
widening of current footprint of NC Hwy 55 By-pass, adding an additional turn lane to serve as an
entrance and exit from the NMAC. The widening will require an approximate 20 If extension of an
existing culvert underneath Hwy 55 Bypass.

While the proposed project involves extending the existing culvert under the Hwy 55 Bypass, the
impacts are being considering cumulative with the North Main Athletic Complex, as this is required
to provide access to the North Main Athletic Complex. The cumulative impacts do not exceed the
impact thresholds for a NWP, and therefore, the proposed project is eligible for a standalone NWP
14.
Project History
The North Main Athletic Complex (NMAC) was constructed in 2014, utilizing the US Army Corps of
Engineers NWP 39 (SAW -2013-01763), issued to the Town of Holly Springs on Sept 18, 2013. This
permit authorized 0.006 acres of wetland impacts, 125 linear feet of permanent stream channel
impacts, and 24 linear feet of temporary stream channel impacts for the installation of culverts for
road crossing for the construction of the North Main Athletic Park. No mitigation was required for
this project.
The previously permitted impacts for the NMAC were below thresholds requiring written
authorization from NC DWR. A courtesy copy of the PCN was submitted to NC DWR; however, a
401 WQ Certification was not issued or required.
The proposed impacts are limited to an existing DOT culvert under Hwy 55 Bypass, which was not
part of the original JD for the NMAC. A Preliminary JD Request for the proposed impact area is
included with this submittal.
Proposed Impacts
The proposed impacts consist of 20 If of permanent stream impacts and 43 If of temporary stream
impacts, required for the expansion of Hwy 55 Bypass and construction of a superstreet
intersection to provide a second entrance/exit for the NMAC.
The proposed permanent impacts will occur from the installation of 20 If of additional box culvert
to an existing DOT installed box culvert under NC Hwy 55 Bypass.
The proposed temporary impacts will occur from pump -around activities required during
installation of the additional culvert. The pump -around will be conducted by constructing two
stilling basins on either side of Hwy 55 Bypass, with a temporary pipe connecting the two basins,
allowing for work in the dry.
Avoidance and Minimization
Prior to site plan design, the applicant requested that a detailed wetland delineation be conducted
so that impacts to wetlands and "waters" could be minimized.
Proposed permanent impacts have been minimized to only those impacts necessary to allow for the
required amount of fill necessary to support a turn -lane expansion of the existing NC 55 Bypass.

Additionally, this general area (the northwest corner of the NMAC) was identified in the original
404 Permitting submittal as the future entrance/exit point for the park, due to the location of Little
Branch. By locating the intersection in the proposed location, a crossing of Little Branch is avoided,
and the impacts required to construct the intersection are minimized to only the expansion of the
existing DOT culvert.
The proposed temporary impacts are part of the NWP 14 Conditions, as well as project erosion &
sediment control design, and are required as part of the pump -around. An upstream stilling basin
will be used in conjunction with coffer dams to collect the perennial stream flow, then pump the
water under NC 55 Bypass through a temporary 24" pipe set within the existing box culvert into a
downstream stilling basin, which will then discharge back into the stream channel on the western
side of the NC 55 Bypass.
Mitigation
The NWP 39 (SAW -2013-01763) issued Sept 18, 2013 for the NMAC authorized 125 linear feet of
permanent stream impact, and 24 linear feet of temporary stream impacts. The proposed
additional impacts total 20 If permanent impact and 43 If of temporary impact, which results in
revised cumulative total of 145 If of permanent impacts, and 67 If of temporary impacts. Because
the cumulative permanent stream impacts are less than 150 linear feet, no mitigation is proposed.
Stormwater Management Plan
Stormwater runoff will be captured and treated within the existing SW management system for the
NC Hwy 55 Bypass. The Stormwater Management Plan for this project will be reviewed and
approved by the NCDOT, under the Highway Stormwater Program for NCDOT projects. The SMP
for this project has been submitted to the DOT, and is pending approval. A copy of the SMP is
included with this submittal.
The current request is for 20 If of permanent stream impacts and 43 If of temporary stream
impacts (see the attached maps and PCN for details).

Prior to site plan design, the applicant requested that a detailed wetland delineation be conducted so that impacts to
wetlands and "waters" could be minimized.

The USFWS has developed a programmatic biological opinion (PBO) in conjunction with the Federal Highway
Administration (FHWA), the US Army Corps of Engineers (USACE), and NCDOT, for the northern long-eared bat in
eastern North Carolina. The PBO covers the entire NCDOT program in Divisions 1-8, including all NCDOT projects and
activities. The programmatic determination for the northern long-eared bat for the NCDOT program in Divisions 1-8 is
"May Affect, Likely to Adversely Affect." The PBO will provide incidental take coverage for the northern long-eared bat
and will ensure compliance with Section 7 of the Endangered Species Act for five years for all NCDOT projects with a
federal nexus in Divisions 1-8, which includes Wake County, where the project is located.
Therefore, consultation requirements under Section 7 of the ESA have been satisfied for the NLEB through the PBO and
no further coordination is required. Furthermore, consultation with USFWS should not be required for other federally
protected species known to occur in Wake County as the project will have No Effect on these species.

1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project.
The project has been designed to avoid and minimize impacts to the greatest extent possible. The project must have access
from the NC 55 Bypass, and the original site plan presented at the April 9, 2013 pre -application meeting proposed this
connection in the southwestern portion of the property that would have required crossing Little Branch, resulting in an
additional 60 - 80 If of stream impacts. The site plan has been revised to provide the connection to the NC 55 Bypass in the
northwestern portion of the property, which avoids the need for a stream crossing for a connection to the NC 55 Bypass. The
currently proposed impacts have been minimized to a single road crossing (Impact 1) necessary to access the southern
portion of the property, as well as a culvert extension (Impact 2) and road improvements (Impact 3) which are required for
construction of a turning/storage lane on N. Main Street. Stream impacts at Impact 2 for installation of the rip -rap dissipater
pad have been minimized to temporary impacts by installing the rip -rap so that the top of the rip -rap matches the
preconstruction contours of the stream bed. This design will allow the natural flow and aquatic life passage to be maintained
in the post -development condition. A cross-section detail of the rip -rap installation has been provided on the Impacts 20
Exhibit.

1) The Corps of Engineers believes that there may be jurisdictional aquatic resources in the
review area, and the requestor of this PJD is hereby advised of his or her option to request
and obtain an approved JD (AJD) for that review area based on an informed decision after
having discussed the various types of JDs and their characteristics and circumstances when
they may be appropriate.
2) In any circumstance where a permit applicant obtains an individual permit, or a Nationwide
General Permit (NWP) or other general permit verification requiring "pre- construction
notification" (PCN), or requests verification for a non -reporting NWP or other general permit,
and the permit applicant has not requested an AJD for the activity, the permit applicant is
hereby made aware that: (1) the permit applicant has elected to seek a permit authorization
based on a PJD, which does not make an official determination of jurisdictional aquatic
resources; (2) the applicant has the option to request an AJD before accepting the terms and
conditions of the permit authorization, and that basing a permit authorization on an AJD could
possibly result in less compensatory mitigation being required or different special conditions;
(3) the applicant has the right to request an individual permit rather than accepting the terms
and conditions of the NWP or other general permit authorization; (4) the applicant can accept
a permit authorization and thereby agree to comply with all the terms and conditions of that
permit, including whatever mitigation requirements the Corps has determined to be necessary;
(5) undertaking any activity in reliance upon the subject permit authorization without
requesting an AJD constitutes the applicant's acceptance of the use of the PJD; (6) accepting a
permit authorization (e.g., signing a proffered individual permit) or undertaking any activity in
reliance on any form of Corps permit authorization based on a PJD constitutes agreement that
all aquatic resources in the review area affected in any way by that activity will be treated as
jurisdictional, and waives any challenge to such jurisdiction in any administrative or judicial
compliance or enforcement action, or in any administrative appeal or in any Federal court;
and (7) whether the applicant elects to use either an AJD or a PJD, the JD will be processed
as soon as practicable. Further, an AJD, a proffered individual permit (and all terms and
conditions contained therein), or individual permit denial can be administratively appealed
pursuant to 33 C.F.R. Part 331. If, during an administrative appeal, it becomes appropriate to
make an official determination whether geographic jurisdiction exists over aquatic resources
in the review area, or to provide an official delineation of jurisdictional aquatic resources in
the review area, the Corps will provide an AJD to accomplish that result, as soon as is
practicable. This PJD fords that there "may be" waters of the U.S. and/or that there "may be"
navigable waters of the U.S. on the subject review area, and identifies all aquatic features in

Quality Impacts)
Vegetated slopes were used throughout the project. The typical minimum slopes used is 3:1. Where minimum slope was exceeded,slope stabilization measures have been
implemented. Rip rap, permanent soil reinforcement matting, and reinforced soil slopes will be used to stabilize slopes steeper than 3:1. Existing drainage ditches will be
maintained and the existing pipe system will be modified to acheive stormwater managment goals. Proposed median ditches will be lined with grass. Temporary channel liners
will be used for disturbed ditches to prevent erosion until grass is established.

This document is only valid as long as the following conditions are met:

- The project area of influence has not been listed in or become eligible to be listed in the
National Register of Historic Places.
If at any time prior to receiving Construction Authorization from FHWA the above conditions

NORTHERN LONG-EARED BAT CONCERNS
It is anticipated that the Northern long-eared bat will be added to the Federally Protected Species
list as of April 1, 2015. If this project involves tree clearing (greater than 3 inches in diameter)
or structure demolition (bridges, buildings, or

Commitments Developed through Project Development and Design
• The review area contains potential habitat for the northern long-eared bat (NLEB).
The US Fish and Wildlife Service has developed a programmatic biological opinion
(PBO) in conjunction with the Federal Highway Administration (FHWA), the US
Army Corps of Engineers (USAGE), and NCDOT for the NLEB in eastern North
Carolina. The PBO covers the entire NCDOT program in Divisions 1-8, including all
NCDOT projects and activities. The programmatic determination for NLEB for the
NCDOT program in Divisions 1-8 is "May Affect, Likely to Adversely Affect." The
PBO will provide incidental take coverage for NLEB and will ensure compliance
with Section 7 of the Endangered Species Act for five years for all NCDOT projects
with a federal nexus in Divisions 1-8, which includes Wake County, where the
project is located. Tree clearing will be minimized during construction, and will be
limited to the timeframes recommended by the USFWS. At the time of project
completion, the Town of Holly Springs will submit the actual amount of tree clearing
(in tenths of an acre) to the NCDOT Natural Environment Section.
• The review area contains marginal habitat for Michaux's sumac. A field survey will
be conducted during the optimal survey window (May through October) to confirm
presence or absence.
• The following permits/approvals will be obtained for this project:
1. NCDEQ Erosion and Sedimentation Control Plan
2. Town of Holly Springs Buffer Authorization
3. USACE 404 Permit
4. NCDWR 401 Water Quality Certification

NOTES
1. ALL EXCAVATION SHALL BE IN DRY OR ISOLATED AREAS OF THE WORK ZONE.
2. IMPERVIOUS DIKES ARE TO BE USED TO ISOLATE WORK FROM STREAM FLOW
WHEN NECESSARY.
3. MAINTENANCE OF STREAM FLOW OPERATIONS SHALL BE INCIDENTAL TO THE
WORK. THIS INCLUDES POLYETHYLENE SHEETING, DIVERSION PIPES, PUMPS, AND HOSES.
4. PUMPS AND HOSES SHALL BE OF SIZE TO DEWATER THE WORK AREA.
