Box 234 I Kenansville, N.C. 28349 Subject: NOTICE OF VIOLATION NOV-2017-PC-0714 Administrative Code 15A NCAC 2T .13 04 Liberty Farm Permit No. AWS310692 Duplin County a Dear Mr. Nethercutt: On October 6., 2017, staff from the Wilmington Regional Office (WIRO) of the Division of Water Resources (DWR) visited and inspected the permitted waste management system of the Liberty Farm. We appreciate Mr. Eugene Nethercutt being present and assisting us with the inspection. You are hereby notified that, having been permitted to have a non -discharge permit for the subject animal waste management system pursuant to 15A NCAC 2T .13 04, you have been found to be in violation of your Certified Animal Waste Management Plan (CAWMP) and the Swine Waste System General Permit No. AWG 100000 as follows: Violation 1: i Failure in monitoring and recording the waste level in each lagoon weekly on forms supplied by or approved by the Division in accordance with Condition III. 2. a. of the Swine Waste System General Permit No. AWG 100000, as. stated below: Highly visible Iwaste-level gauges shall be maintained to mark the level of waste in each lagoon/storage pond that does not gravity feed through a . free flowing transfer pipe into a subsequent structure. The gauge shall have readily visible permanent markings. i The waste level in each lagoon with a waste level gauge shall be monitored and recorded weekly on forms supplied by or approved by the Division. 1 The Director may require more frequent monitoring and recording of waste levels based on the facility's compliance history for freeboard violations. The Permittee shall also record removal of solids and document nutrient loading rates if disposed of on -site, or record the off --site location(s). These records must be on forms supplied by, or approved by, the Division in accordance with Condition III. 6. of the Swine Waste System General Permit No. AWG 100000. j During the annual compliance inspection, irrigation records were found to be incomplete. Required Corrective Action for Violations: .i You are required to provide a written response to this Notice by January 15, 2017. Please provide to our office, a description of the corrective action(s) you will take or have taken to resolve this issue.
