Dear Mr Todd:
On May 1, 2001, the Division of Water Quality wrote to you concerning your plans to impact an unreported
amount of acres of wetlands and/or linear feet of streams in order to construct in Wake County. This letter informed you
that the project was incomplete and was being placed on hold until the additional information outlined in the letter was
supplied. To date, we have not received this additional information. Unless we hear from you in writing within 3 weeks of
the receipt of this letter, we will consider that you no longer want to pursue this project and we will retire the file and
consider the application as withdrawn. Please be aware that reapplication for this project will require a Certification fee
and new applications.

Wake County
In response to your son's phone call on April 24, 2001, staff of the Division of
Water Quality visited your site that afternoon. Staff agrees that relocation of a portion of
the stream is needed in order to prevent the side of your pond from collapsing and then
draining. Relocation of the portion from the large sweet gum tree downstream to the
large pine (as discussed in the field) should be sufficient to protect the pond.
However you will need an approved plan to relocate this channel. This plan must
show the location of the proposed channel as well as it's proposed cross section,
temporary sedimentation and erosion control measures and replanting plans for all
disturbed areas within 50 feet of channel. The Division must approve this plan before
construction begins.

Restoration Institute who may be able to assist with this plan By copy of this letter, I
would ask Greg Jennings to contact Dave Penrose by phone at (919) 733-9502 so we
can expedite this approval. Mr. Jennings can be reached at (919) 515-6771.
In addition a US Army Corps of Engineers 404 Permit will be required for this
work. Please contact Mr. Ken Jolly of the Corps at (919) 876-8441 ext. 22 in this regard.
