On February 25, 2020, Isaiah Reed from the Asheville Regional Office of the Division of Energy,
Mineral and Land Resources (DEMLR), conducted a site inspection of the Fairfield Chair Company
facility located at 606 Kincaid Circle, Caldwell County, North Carolina. A copy of the Compliance
Inspection Report is enclosed for your review. The site visit and file review revealed that the
subject facility is covered under NPDES Stormwater General Permit NCG180000 by Certificate of
Coverage NCG180189. Permit coverage authorizes the discharge of stormwater from the facility to
receiving waters designated as Gunpowder Creek, a Class C waterbody in the Catawba River Basin.
As a result of the site inspection, the following permit condition violation is noted:
Secondary Containment
Secondary containment has not been provided and maintained for all bulk storage of liquid
materials, including hazardous waste storage.
Other Observations:
Please refer to the enclosed Compliance Inspection Report for additional comments and
observations made during the inspection.
Requested Response:
You are asked to respond to this office, in writing, within 30 calendar days from receipt of this
notice. Your written response should include a reasonable explanation as to why the
aforementioned violation(s) have occurred as well as a Plan of Action to prevent this/these
violation(s) from recurring.

Inspection Summary
On February 25, 2020 this facility was inspected for compliance. I met with Rick Peirce and Mickey James on site. During
the inspection, he following items were noted:
1) The secondary containment structure provided for the storage of hazardous waste on site was cracked a various places
and is not in acceptable condition to qualify as secondary containment. In addition, the condition of the drainage pipes,
which run through the adjacent secondary containment, has removed the potential for that structure to serve as secondary
containment as well. The permittee is directed to immediately begin efforts to evaluate, repair, modify, or replace all
secondary containment at the facility so that it meets all requirements outlined in the NCG180000 General Permit.
2) Additional outfalls may need to be added to the Site plan and monitoring schedule. The permittee is directed to evaluate
the outfall locations for modification and to potentially add an outfall to the monitoring schedule.
Please give the above items your immediate attention. This facility will be re -inspected on or after April 8, 2020. If the above
items have not been addressed, further action will be taken.
