APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS, WRP
Dear Mr.
You have our approval, in accordance with the attached conditions and those listed below, to place fill
material in acres of wetlands and linear feet of streams for the purpose of at

application, we have decided that this fill is covered by General Water Quality Certification Number
This certification allows you to use Nationwide Permit Number _ when the Corps of Engineers issues it. In
addition, you should get any other federal, state or local permits before you go ahead with your project including
(but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply
Watershed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless
otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application except as
modified below. If you change your project, you must notify us and you may be required to send us a new
application for a new certification. If the property is sold, the new owner must be given a copy of this Certification
and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this
project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC
2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification and
any additional conditions listed below.
1. Deed notifications or similar mechanisms shall be placed on all remaining jurisdictional wetlands and waters to notify the state in
order to assure compliance for future wetland and/or water impact. These mechanisms shall be put in place within 30 days of the
date of this letter or the issuance of the 404 Permit (whichever is later).
'_. An additional condition is that a final, written stormwater management plan shall be approved by this
Office before the impacts specified in this Certification occur. The stormwater management plan
must include plans and specifications for stormwater management facilities designed to remove 8551o
TSS according to the most recent version of the NC DENR Stormwater Best Management Practices
Manual. Also, before any permanent building is occupied at the subject site, the stromwater
management facilities, as approved by this Office, must be constructed and operational, and the
stormwater plan, as approved by this Office, shall be implemented.
We understand that you have chosen to contribute to the Wetland Restoration Program in order to compensate
for these impacts to wetlands and/or streams. In accordance with 15A NCAC 2R .0402, this contribution will
satisfy our compensatory mitigation requirements under 15A NCAC 2H .0506(h). According to 15A NCAC 211
.0506(h), feet of restoration will be required. Until the Wetland Restoration Program receives and clears your check
(made payable to: DENR - Wetland Restoration Program), wetland or stream fill shall not occur. Mr. Ron Ferrell
should be contacted at 919-733-5083 ext. 358 if you have any questions concerning the Wetland Restoration
Program. You have one month from the date of this Certification to make this payment. For accounting purposes,

The purpose of this letter is to request authorization for proposed impacts to jurisdictional
wetlands and waters resulting from the construction of a proposed Senior Citizen Residential
Development located in Mecklenburg County. The property is owned by Mr. John Woodley
Wallace and is located on Eastfield Road near the Cabbarus County line; the site is located
on the attached Cornielius, NC Quadrangle (attachment 1). Mr. Wallace is closing the family
dairy and fertilizer / composting facilities located on the site and replacing them with the
proposed development.
Site development will replace approximately 5 acres of existing animal waste treatment
lagoons with approximately 5 acres of water quality ponds that include littoral plantings. Site
development maintains high-grade channels on the site while directing impacts toward low-
grade relocated channels. Littoral plantings will likely increase the acreage of jurisdictional
wetlands on the site. Linear footage of channels will be lost; however, these low-grade
channels are not assessed to be important in aquatic function due to the absence of aquatic
life.
Site Conditions:
The development site is located entirely within areas utilized for dairy farming and
composting operations. The wetland surface hydrology of the site has been significantly
altered in the vicinity of non-jurisdictional waste treatment lagoons as part of the agricultural
operations. The attached Cabarrus County Soil Survey (1976 aerial photo) shows no
impounded water or channels on site (attachment 2). The agricultural operation pre-dates
cattle exclusion BMPs and therefore all jurisdictional features on site exhibit degraded
characteristics associated with heavy use by cattle, erosion, and farming equipment (see
attached wetland and channel data forms).
The three large lagoons located in the center of the site have been determined by the Corps
to be non-jurisdictional waste storage and treatment lagoons installed for compliance with
the Clean Water Act. Surface water flow from the area above the lagoons has been diverted

to an excavated ditch running along the slope located west of the lagoons. A small watering
hole is located below an offsite pond. This feature is excavated in high ground, and has no
connection with the jurisdictional channel below.
The "1000 series" pond, approximately 0.7 acre in size, appears to be used by cattle for
drinking and bathing, has poor water quality, and is not anticipated to support aquatic life
(no aquatic life was observed on site visit). A ditch excavated in high ground along the slope
north of the pond conveys any excess flow off site.
Channels associated with the 200 series are in their best condition off site down stream of
the power right-of-way. The channel has not received the heavy use by cattle as the other
channel series. When evaluated, there were no fish or crayfish present in the channels
associated with flag series 100, 200, 300, or within any of the relocated channels. Site
development will redirect relocated channels back into the drainage where the lagoons are
located and restore the historic hydrology of the basin.
Proposed Impacts:
The project requests impacts under NW Permits 14 and 26 and their 401 Water Quality
Certifications. Impacts proposed under Nationwide 26 include:
• Approximately 300 linear feet of fill in intermittent channel 100 (unimportant in aquatic
function) (attachment 3)
• Fill within the entire length of the 200 series channel (approximately 650 linear feet of
unimportant channel, no crayfish or salamanders observed) (attachment 4)
• Fill the entire length of the "excavated ditch" and highly degraded channel located west
of the lagoons. (attachments 5 and 6)
• Fill and flooding associated with the 300 series channel for the purpose of constructing
storm water BMP (attachment 7)
• Removal of the 1000 series pond (approximately 0.5 acre, low water quality)
Impacts proposed under Nationwide 14 include:
• Approximately 149 linear feet of fill within the intermittent channel located above the
lagoons (not important in aquatic function, no salamanders of crayfish observed.
• Approximately 0.1 acre of fill of the 2000 series wetland polygon (low quality)
The existing animal waste lagoons are to be closed using guidelines in the Natural Resources
Conservation Service, Interim Standard for the Closure of Abandoned Waste Treatment
Facility (Code No. 702), for the safe removal and treatment of existing waste. Once all of
the sludge is removed, the ponds will be redesigned or refurbished and utilized as freshwater
ponds and storm water detention for a large portion of the site.
All impacts are assessed to be entirely to waters that are not important in aquatic life and
water quality functions. However, as a mitigative measure, storm water for the largest
portion of the site and remaining drains will be redirected to the ponds for detention.
Proposed Development Plan:
Attachments 8 and 9 illustrate the pre-construction and post-construction conditions,
respectively. The pre-construction illustration clearly depicts the non-jurisdictional waste
lagoons and further identifies relocated channels and other jurisdictional features. Post-
construction illustrates the preservation of the surface area of the lagoons as storm watew
ti?
BMPs. This illustration also depicts a road crossing up stream of the proposed ponds; the
crossing passes through an existing wetland. This road continues in a westerly direction
down the channel identified with the 200 series flags in a looping fashion. This road and
development in this, the western portion of the site, will be nearly level so that it will be
"senior citizen friendly". A connector road passes through a lagoon from west to east and
provides required connectivity (dictated by the County) to the retail, office and multifamily
portion of the site. A low quality pond (demarked with the 1000 series) will be replaced by
parking that is required for the high-density development.
The illustration does not clearly illustrate that the relocated channel that parallels the lagoons
will be re-directed into the drainage that supports the lagoons thus restoring hydrology to
the channel off site. Nor does the illustration clearly depict areas suitable for wetland
plantings.
The site will be served by a storm water detention facility.
Avoidance and Minimization:
Impacts have been avoided to the extent practicable for the equitable development of the
sites for its proposed use as a Senior Citizen Residential Development. The sites proposed
use requires low-grade inclines that are compatible with the Americans with Disabilities Act
for wheel chair access. Mass grading will be used to accomplish the near level site condition
that is required.
Impacts to the 300 series channel have been avoided to the extent practical; but because of
a storm water requirement these impacts are needed. Waste lagoons will be refurbished as
storm water facilities and maintain these surface waters in a greater functional state.
Increased function will be achieved by removing animal waste and by planting a littoral shelf.
Mitigation:
Mitigation is not anticipated because wetland impacts do not exceed 1.0 acres and impacts
to channels are to those channel that were observed to be uninhabited by fish and crayfish.
Though not specifically required by statute, the applicant proposes planting a littoral shelf
along the edges of the storm water ponds as a mitigative measure. Littoral shelves serve a
dual purpose for water quality and safety.

SUBJECT: Review of 404/401 Application by Wetland and Natural Resource Consultants, Inc. for
Wallace Site, DWQ 000298, Mecklenburg County
The applicant is requesting a letter of concurrence from the North Carolina Wildlife Resources
Commission (NCWRC) to obtain a 404 Permit and 401 Certification. These comments are provided in
accordance with provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et. seq.) and the Fish and
Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d). Impacts from the
development are indicated to be the conversion of non jurisdictional animal waste treatment ponds to
stormwater ponds and 950 linear feet ofchannel plus 0.5 acres of "1000 series pond".
The North Carolina Wildlife Resources Commission (NCWRC) continues to be concerned about
the fragmentation and loss of forested areas or woodlands as development occurs in areas near the City of
Charlotte and in or near Mecklenburg County. We appreciate the efforts to protect water quality by
providing stormwater detention and treatment. However, the NCWRC does not encourage the utilization
of existing waters or wetlands for water quality treatment facilities. Conversion of these wastewater
facilities may improve water quality. Any efforts to maintain current hydrographic conditions should also
be beneficial where parking lots are constructed for this development. This is particularly true, as efforts
are underway to protect and restore portions of the Clark Creek watershed.
I f relocation of these streams is not economically feasible or practicable, we recommend that the
wet detention facility include vegetated littoral shelves for aquatic edge habitat as routinely required in
401 Certifications. In an effort to restore avian and terrestrial habitats as well as enhance aquatic/detritus
habitats in the detention facility, we recommend that the applicant provide for the restoration of tree and
shrub species similar to those currently found in the area (red maple, sweetgum, tulip poplar, dogwood).
Native species such as wild cherry, hickory and oak may be preferred over the above due to structural
concerns. 'T'hese trees and shrubs should be planted around and on the upper third of the detention
structure, excluding the dam. They should provide habitat benefits that could offset those functions lost
by development, partially restore aquatic habitats, reduce exposure of the water surface to sunlight
thereby minimizing thermal pollution, provide essential summer and winter habitats as well as provide an
aesthetically pleasing green space which should enhance property values. Essentially, these plantings
could provide water quality and habitat benefits as well as provide a park area for residents.

Additionally, instead of using the typical fescue or grasses, the upper interior and exterior of the
structure should be planted with the following mix:
Spring/Summer Mixture, May 1 - Sept. 15 Fall/Winter Mixture, Sept. 15 - April 30

Korean lespedeza* 20 Ibs/a Korean lespedeza* 20 Ibs/a

(Note: Mowing should be limited to early spring and should only occur as needed to prevent tree

Trees and shrubs (1 year bare root seedlings) should be planted randomly at a minimal rate of 100
trees per acre on the top and upper portions of the structure and at a minimal rate of 150 per acre around
the normal water elevation and littoral shelf area. The following list of tree species may assist in
providing habitat benefits:

Other species may be utilized depending on site requirements and availability. Pines* should not
exceed 15% of the reforestation. No more than 20% of the tree species will be of a single
species. An 80% success rate is acceptable over five years. Large or fast growing trees like
Sycamore and Maple** may not be appropriate around detention facilities.
The above recommendations should be considered for the multiple benefits that they can provide
to the community and to the environment. Initial costs should not be prohibitive and the long-term costs
should be reduced, as constant mowing would not be necessary in the naturalized areas. Thank you for
