This inspection was performed to determine compliance with the North Carolina Sedimentation Pollution Control Act (SPCA) of 1973 and General Permit - NCG 010000 to Discharge Stormwater Under The National Pollutant Discharge Elimination System for Construction Activities (Construction Stormwater Permit NCG 010000). The inspection revealed a land -disturbing activity of approximately 30.93 acres being conducted. State of North Carolina I Environmental Quality I Energy, Mineral and Land Resources Mooresville Regional Office 1 610 East Center Ave Ste 301 1 Mooresville, NC 28115 704 663 1699 T Notice of Violations City of Concord May 2, 2018 Page 2 of 5 It is our understanding that you and/or your firm are responsible for this land -disturbing activity. The purpose of this letter is to inform you that this activity was found to be in violation of the SPCA, G.S. 113A-50 to 66, Title 15A, North Carolina Administrative Code (NCAC), Chapter 4 and Construction Stormwater Permit NCG 010000. If you feel that you are not responsible for the following violations, please notify this office immediately. The violations of the SPCA that were found are: 1. Failure to conduct a land -disturbing activity in accordance with the approved erosion and sedimentation control plan. G.S. 113A-57(5). 2. Failure when a land -disturbing activity that will disturb more than one acre is undertaken on a tract, to install sedimentation and erosion control devices sufficient to retain the sediment generated by the land -disturbing activity within the boundaries of the tract during construction upon and development of the tract. Failure to install and maintain . all temporary and permanent erosion and sedimentation control measures as required by the approved plan or any provision of the SPCA, and rules adopted thereunder, during or after the development of a site. 15 NCAC 4B .0113. The violations of the Construction Stormwater Permit NCG 010000 that were found are: Failure to dewater sediment basin from the surface, NCG 010000 Section II. B. 4) Sediment basins that have a drainage area of greater than one acre shall have outlet structures that withdraw water from the surface. 2. Failure to install and maintain BMPs and control measures, NCG 010000 Section III. 4) The permittee must select, install, implement and maintain best management practices (BMPs) and control measures that minimize pollutants in the discharge to meet the requirements of this permit. 3. Failure to operate and maintain control measures, NCG 010000 Section IV, 1) Notice of Violations City of Concord May 2, 2018 Page 3 of 5 The permittee shall at all times properly operate and maintain all control measures and systems of treatment and control (and related appurtenances) which are installed or used by the permittee to achieve compliance with the conditions of this general permit. To correct these violations, you must: 1. Coordinate with Alan Johnson of the Mooresville Regional Water Quality Operations Section to remove sediment from the stream. 2. April 28, 2017 Ousmane Sidibe North Carolina Department of Environmental Quality Division of Energy, Mineral and Land Resources 610 East Center Avenue, Suite 301 Mooresville, North Carolina 28115 Subject: Concord Traffic Management Center— CABAR-2017-064 Warren C Coleman Blvd. Response to Comments Mr. Sidibe: We are writing in response to the comments made by the North Carolina Department of Environmental Quality Division of Energy, Mineral and Land Resources on March 27th, 2017 on the above referenced project in Concord, NC. The following items are included with this submittal. One (1) copy of the Property Deed. Two (2) sets of Erosion and Sediment Control Plans One (1) copy of the 401 Water Quality Certification Preliminary Review Comments fF 1. Please provide a copy of the deed for the landowner(s) within the limits of disturbance. [GS 11 3A-54. 1 (a)] Response: A copy of the deed has been added to this submittal. 2. Although the 401/404 application was submitted, be advised that 401/404 permits/certifications may provide authorization to work in the areas subject to those permits/certifications, but they do not grant approval to perform this work without the use of an approved erosion and sedimentation control plan for the activity. Additional measures may be required to perform construction in these areas. The applicant is responsible for the control of sediment on -site. If the approved erosion and sedimentation control measures prove insufficient, the applicant must take those additional steps necessary to stop sediment from leaving this site. Please show measures required to perform construction in these areas such that stream and/or wetland impact is limited to the area of approved impact. [G.S. 11 3A- 57(3),15A NCAC 4B .0115] Response: 401 Water Quality Certification has been approved and has been added to this submittal. H m I ))) H o r n Page 2 3. The construction sequence must be revised on page C1-1 through C1-3: Please be advised that the Land Quality office does not issue grading permits. We issue a letter of approval for the erosion control plans, and once the initial inspection has been completed, we issue a compliant inspection report. We do not issue a permit. Please correct this, and keep it in mind for any other plans in Cabarrus County. [15A NCAC 4B .0106(a)(5)] Response: The construction sequence has been revised on pages C1-1 through C1-3. 4. Additional measures may be required — The applicant is responsible for the control of sediment on -site. The "no disturbance allowed area" (see sheet C1-2) appears to have insufficient erosion and sedimentation control measures, the applicant must take additional steps necessary (i.e. silt fence and/or diversion) to stop sediment from going on "no disturbance allowed" area. [15A NCAC 4B .0106(a)(4)] Response: Additional erosion control measures have been added to the "no disturbance allowed" area. Silt fence along with tree protection fence has been added to phase 1 around the "no disturbance allowed" area. A diversion berm has also been implemented on phase 1 to keep water from entering the "no disturbance allowed" area. Please provide a copy of the deed for the landowner(s) within the limits of disturbance. [GS 113A-54.1(a)] 2. [G.S. 113A-57(3), 15A NCAC 4B .0115] 3. The construction sequence must be revised on page C 1-1 through C 1 -3: Please be advised that the Land Quality office does not issue grading permits. We issue a letter of approval for the erosion control plans, and once the initial inspection has been completed, we issue a compliant inspection report. We do not issue a permit. Please correct this, and keep it in mind for any other plans in Cabarrus County. [15A NCAC 4B .0106(a)(5)] 4. Additional measures may be required - The applicant is responsible for the control of sediment on -site. The "no disturbance allowed area" (see sheet CI-2) appears to have insufficient erosion and sedimentation control measures, the applicant must take additional steps necessary (i.e. silt fence and/or diversion) to stop sediment from going on "no disturbance allowed area. [15A NCAC 4B .0106(a)(4)] 5. A revised plan (2 complete sets) should be submitted to us with the above items changed. Please include with your revised plan a letter that includes a brief discussion of each item listed above. Please reference Project Number CABAR-2017-064 in your cover letter. You are encouraged to contact Ousmane Sidibe at 704-235-2147 with any questions regarding this review. The stream delineation was performed by utilizing sub - meter GPS equipment locate the stream centerline. The proposed project seeks to develop a new Traffic Management Center (approximately 3,200 SF) in a two story building along Warren C. Coleman Boulevard. The site development will consist of the new building, associated parking, pedestrian connections, and landscaping. Additionally this project will include the construction of a 1,500 LF roadway that will serve the overall master plan of the City's property. The proposed project seeks to install a 96-linear foot, 36-inch reinforced concrete pipe (RCP) with rip -rap outlet protection along an unnamed tributary located at approximately 35.379933°N,-80.565770°W. Currently the unnamed tributary is conveyed through an existing 18 linear foot, 15-inch RCP crossing beneath an unpaved, maintained vehicle trail. The existing 15-inch RCP will be removed and replaced by the proposed 36-inch RCP. Permanent stream impacts will be adjusted to account for the 18 linear foot pipe removal/replacement. The project will require 30 linear feet of temporary impacts to install an impervious dike, stone ring, and a pumped diversion to allow for work in dry conditions. The project will result in 98 linear feet of permanent stream impact -net loss of waters of the US and 30 linear feet of temporary stream impacts from the activities necessary to construct the new roadway. The approximately 31 - acre project site is located on Warren C Coleman Blvd. in'" t Concord NC, of which approximately 20.5 acres are disturbed. The project consists of the construction of and operation of a Traffic Management Center. The project consists of the construction of a new public road, driveway, parking lot, a master stormwater BMP, and all associated utilities to serve a new Traffic Management Center. Pads for future development by the City of Concord are also to be mass graded. This report contains calculations for the proposed Erosion and Sedimentation Control Best Management Practices to be utilized during the construction of the proposed facility. Site Description The site is currently wooded with an existing gravel area, approximately 4,000 square yards, used as a solid waste debris site. There is an existing gravel drive connecting the debris site to General Services Drive. There is also an existing gravel drive located towards the western side of the property, extending from the debris site to U.S. Highway 601 Bypass. The existing topography ranges from 645 FT to 570 FT and slopes down toward the south west corner of the property. Generally, stormwater runoff from the site currently flows into the existing swales that run through the center of the site before draining west to the existing creek. Adjacent property The property is bound to the north by U.S. Highway 601 Bypass. There are also two parcels that extend across the north end of the site. One parcel is owned by Okey Tysen and the other by Roman Catholic Diocese of Charlotte, NC. The adjacent property to the west is owned by Bill Krimminger and the property to the east is owned by TC Summerwalk, LLC. To the south, the parcel is bound by the property own by the Board of Light and Water Commission, City of Concord and General Services Drive. Soils The Web Soil Survey for Cabarrus County, North Carolina (published by the United States Department of Agriculture Natural Resource Conservation Service) indicates that there are four primary soil series on the subject site. The soil series at the site consist primarily of the Chewacla Sandy Loam (ChA), Cullen Clay Loam (CuB2), the Cullen Clay Loam Loam (CuD2), and Poindexter Loam (PoF) Soil Series. These soils have Hydraulic Soil Group classifications B/D, B, B, and C respectively. Refer to Figure 3 of this report. Flood plain/Floodway/FIRM Flood Insurance Rate Map Based on the effective FEMA Flood Insurance Rate Map Number 3710553900J (Panel No 5539), dated November 5, 2008 this site appears to be mostly in an unshaded Zone X: areas determined to be outside the 0.2% annual chance floodplain. Towards the south west corner of the site there is a shaded Zone X: areas of 0.2% annual chance floodplain. Located within that shaded Zone X there is a shaded Zone AE: areas of 1% annual chance flood event. Refer to Figure 2 of this report. Streams/Wetlands The site discharges to the named receiving water Irish Buffalo Creek. Irish Buffalo Creek is classified as Class C — Aquatic Life, Secondary Recreation, Free. There are jurisdictional wetlands on the property. There are proposed Impacts to the wetlands and an Army Corps Nationwide Permit has been applied for. Based on available GIS information, the site does discharge to 303D waters. Erosion & Sedimentation Control Calculations City of Concord 26 Union Street South, Concord, NC 25025 EROSION AND SEDIMENTATION CONTROLS Development of this project requires disturbance of approximately 20.5 acres. A variety of storm water pollutant controls are proposed for this project. Some controls are intended to function temporarily during construction, while others will be slightly modified to remain as permanent measures after project completion. Please see below for a detailed description of each measure, and refer to the attached Erosion and Sedimentation Control Plan/Site Maps, Phase 1 and Phase 2 and the Erosion and Sedimentation Control Details in the "Site Development Plans for the Concord Traffic Management Center" prepared by Kimley-Horn and Associates, Inc. (Construction Drawings) for further information. The following measures will be used to control erosion and sedimentation for this project. Please see the calculations for more information on the design of each item. Soil Stabilization The purpose of soil stabilization is to prevent soil from eroding and leaving the site. In the natural condition, soil is stabilized by native vegetation. The primary technique to be used at this project for stabilizing site soils will be to provide a protective cover of grass, pavement, or building structure. Temporary Seeding or Stabilization — All denuded areas that will be inactive for 14/7 days or more must be stabilized temporarily with the use of fast -germinating annual grass/grain varieties appropriate for site soil and climate conditions, straw/hay mulch, wood cellulose fibers, tackifiers, netting and/or blankets. Stockpiles and diversion ditches/berms must be stabilized to prevent erosion and dust issues. Permanent Seeding, Sodding or Mulching — All areas at final grade must be seeded or sodded within 14/7 days after completion of work in that area. Seed immediately after final grade is achieved and soils are prepared to take advantage of soil moisture and seed germination. At the completion of ground - disturbing activities the entire site must have permanent vegetative cover, meeting vegetative density requirements, or mulch per landscape plan, in all areas not covered by hardscape (pavement, buildings, etc.). Seeded areas shall be protected with mulch or a rolled erosion control product. Mulch must be anchored to the soil surface by spray -on tackifiers or crimped by disc or other machinery and/or rolled erosion control products must be installed per manufacturer recommendations. Consideration is given to climate conditions, soil type and native vegetation when designing the final landscaping plan. Note: Crushed/decomposed granite or other non -vegetative cover may be an acceptable final cover in arid climates. To minimize the potential for erosion and maximize seed germination & growth, the General Contractor must evaluate the short and long-term local forecast prior to applying permanent seed or sod. Final site stabilization is achieved when perennial vegetative cover provides an established permanent ground cover sufficient to restrain erosion. This shall be no less than a coverage density of at least 80 percent over the entire area to be stabilized by vegetative cover. Furthermore, "establishment of stabilization" is loosely defined by the State and could include vegetation growing through at least one growing season, based on site and drought conditions at the time vegetation is first established. This area is exclusive of areas that are covered with rock (crushed granite, gravel, etc.) or landscape mulch, paved or have a building or other permanent structure on them. Structural Controls Stormwater runoff will be managed throughout construction through the use of a skimmer sediment basin, silt fences, stabilized construction exits, storm sewer inlet protections, rock check dams, diversion Erosion & Sedimentation Control Calculations City of Concord 26 Union Street South, Concord, NC 28025 ditches and berms, culverts, and stone outlet protection. The erosion and sedimentation control devices were designed using the NCDEQ Erosion and Sediment Control Planning and Design Manual, dated May 2013. Refer to the following detailed descriptions of these erosion control and sedimentation control devices. Silt Fence — Silt fence is a synthetic permeable woven or non -woven geotextile fabric incorporating metal support stakes at intervals sufficient to support the fence (5-feet maximum distance between posts), water, and sediment retained by the fence. The fence is designed to retain sediment -laden stormwater and allow settlement of suspended soils before the stormwater flows through the fabric and discharges off -site. Silt fence shall be located on the contour to capture overland, low -velocity sheet flows and is typically installed with a wire fence backing for additional support. Wire fence backing is required unless the silt fence is installed using the slicing method as the slicing method ensures the silt fence fabric is anchored securely in the ground. Filtrexx Filter Soxx — Filtrexx® SiltSoxx1m is a three-dimensional tubular device made of FilterMedia'" encased in Filtrexx® Mesh1m. It is designed to support stormwater management, sediment & erosion control and pollutant removal Best Management Practices (BMPs). It is generally used in areas where delimiting at risk areas and diverting, cleaning and filtering stormwater runoff is critical. The Soxx are designed to retain sediment -laden stormwater and allow settlement of suspended soils before the stormwater flows through the media and discharges off -site. As an alternative to Silt Fence and Coir Wattles, the Soxx will be stacked to increase the effective height and help prevent sediment discharge offsite. In addition to perimeter control, Filtrexx® SiltSoxx1m will also be used for check dam applications. They are generally used in ditches, channels and swales to protect specific areas by slowing concentrated stormwater flow velocity, reducing bed erosion and filtering sediment, pollutants and other particles. Check dams are highly effective at reducing flow velocities, simple to construct and require very low maintenance. Construction Exit — All access points from the public street into the construction site shall include a construction exit composed of course stone to the dimensions shown on the Construction Drawings detail sheet. The rough texture of the stone helps to remove clumps of soil adhering to the construction vehicle tires through the action of vibration and jarring over the rough surface and the friction of the stone matrix against soils attached to vehicle tires. In addition to the stone at the construction exit, it may be necessary to install devices such as pipes (cattle guard) to increase the vibration and jarring. It may also be necessary to install a wheel wash system. If this is done, a sediment trap control must be installed to treat the wash water before it discharges from the site. All site access must be confined to the construction exit(s). Barricade to prevent use, any locations other than the construction exit(s) where vehicles or equipment may access the site. Use jersey barriers, construction fencing/drums, etc. near construction exit(s) to prevent traffic by-pass or short circuiting. Check Dams — Defined channels subject to concentrated flows in larger quantities and higher velocities may be protected with rock or other manufactured device (coir wattles and Filtrexx Filtersoxx) that can be used as a check dam. The dams impound sediment -laden water and allow for settlement of suspended soil before the stormwater flows over and through the device. Dams shall be placed along the water course at linear intervals in which the elevation of the bottom of the upper most check dam is at the same elevation as the top of the check dam immediately below it. This will allow the most ponding capacity and will not increase the velocity of the water flowing along the channel. Location and spacing of check dams are shown on the Site Maps. Check dams are composed of crushed stone or rip rap or of other manufactured devices. Diversion Ditch/Berm — Diversion ditches (swales) and berms (dikes) are constructed as shown on the Site Maps at locations within the construction site to intercept overland flow and direct or divert flow to Erosion & Sedimentation Control Calculations City of Concord 26 Union Street South, Concord, NC 28025 a sediment basin or other point where discharge can be controlled. Ditches are excavated in the surface soils with the spoils from the excavation typically placed along the downstream edge of the ditch to provide additional capacity. Berms are built up on the surface soils and compacted to create a stable diversion. Sediment Basins — Temporary sediment basins are depressions constructed downslope of construction activity and located such that stormwater runoff from upland areas diverted through the basin. Sediment basins shall be constructed as directed by the SWPPP and shall be constructed as part of the initial Phase I BMPs whenever practical. Baffles are provided within the basin and a skimmer is utilized to discharge flow from the basin. CONCLUSION The proposed erosion and sedimentation control measures were designed using methods prescribed by the aforementioned resources. Based on the analyses provided, the proposed systems address and meet the requirements of the North Carolina Division of Land Resources and Water Quality. The probability that precipitation frequency estimates (for a uration and average recurrence interval) will be greater than the upper bound (or less than the lower bound) is 5%. Estimates at upper bounds are not d against probable maximum precipitation (PMP) estimates and may be higher than currently valid PMP values. refer to NOAA Atlas 14 document for more information. http://hdsc.nws.noaa.gov/hdsc/pfds/pfds_printpage.html?lat=35.3 780&lon=-80.5649&data=... 2/3/2017 r() TH C A KOLIN;A High Performance Living Mr. Zahid S.
