FROM: Bob Stroud SUBJECT: Requestfor Minor Modification Permit#29-01 (Paul,& Mona re Black) DATE: July 31, 2002 We have received a request from Land Management Group, Inc. on behalf of the Permittees to modify the existing permit in order to allow for the re-configuration of the existing approved dock and pier plan. The original plan indicated that a total of forty eight 20' slips would be provided. Two multi-slip piers were to provide 24 slips each. These were both aligned so as to be 15' from the riparian corridor to either side of the permittees property. Neither of these two structures have been constructed and the permittees are now requesting that the configuration be modified in order to provide a single pier providing for twenty-two 35' slips and a "T" head to provide for transient docking. The proposed pier is shown as approximately 195' long. A total of 10 finger piers measuring approximately 4'x 35' will be attached to the proposed pier. The "T" head will be approximately 116' long x 8' wide. This structure is aligned so that the "T"-head is 15' in from the riparian corridor to the north and approximately 40' in from the riparian corridor to the south. The finger piers are approximately 40' in from the riparian corridor to the north and approximately 60' in from the south. We have received an informal inquiry from the neighbor to the north who has expressed a concern with respect to his fair-way being impacted by the modification request. Based on the comparison of the authorized project and the proposed project it appears that there will be an increase in the clear zone between his pier(s) and the proposed change. To extend a bulkhead by 123 feet; 2. To backfill behind the bulkhead approximately 823 sgft or 0.01 ac of wetlands. This approval is only valid for the purpose and design that is listed above and that you described in your CAMA application dated August 15, 2001, and the addendum letter dated September 18, 2001, and addendum map dated revised September 1, 2001, which was received by the Division of Water Quality. After reviewing your application, we have determined that this activity is covered by General Water Quality Certification Number 3274. This Certification allows you to use your CAMA Permit when it is issued by the NC Division of Coastal Management. Please keep in mind that there may be additional Federal, State and Local regulations applicable to your project, such as (but not limited to) Sediment and Erosion Control, Non-Discharge, Water Supply Watershed regulations and Coastal Stormwater. In addition, this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the General Certification. All new development shall be located, designed, constructed, and maintained to have minimal disturbance to protect water quality to the maximum extent practicable through the use of best management practices; 5.
