We have received a request from Land Management Group, Inc. on behalf of the
Permittees to modify the existing permit in order to allow for the re-configuration of
the existing approved dock and pier plan. The original plan indicated that a total of
forty eight 20' slips would be provided. Two multi-slip piers were to provide 24 slips
each. These were both aligned so as to be 15' from the riparian corridor to either side
of the permittees property. Neither of these two structures have been constructed
and the permittees are now requesting that the configuration be modified in order to
provide a single pier providing for twenty-two 35' slips and a "T" head to provide for
transient docking. The proposed pier is shown as approximately 195' long. A total
of 10 finger piers measuring approximately 4'x 35' will be attached to the proposed
pier. The "T" head will be approximately 116' long x 8' wide. This structure is
aligned so that the "T"-head is 15' in from the riparian corridor to the north and
approximately 40' in from the riparian corridor to the south. The finger piers are
approximately 40' in from the riparian corridor to the north and approximately 60' in
from the south. We have received an informal inquiry from the neighbor to the north
who has expressed a concern with respect to his fair-way being impacted by the
modification request. Based on the comparison of the authorized project and the
proposed project it appears that there will be an increase in the clear zone between
his pier(s) and the proposed change.

You have our approval, in accordance with the attached conditions (WQC #3274) and the conditions listed below,
to conduct the following at 930 St. Joseph Street, Carolina Beach, New Hanover County:
1. To extend a bulkhead by 123 feet;
2. To backfill behind the bulkhead approximately 823 sgft or 0.01 ac of wetlands.
This approval is only valid for the purpose and design that is listed above and that you described in your CAMA
application dated August 15, 2001, and the addendum letter dated September 18, 2001, and addendum map dated revised
September 1, 2001, which was received by the Division of Water Quality. After reviewing your application, we have
determined that this activity is covered by General Water Quality Certification Number 3274. This Certification allows you
to use your CAMA Permit when it is issued by the NC Division of Coastal Management. Please keep in mind that there
may be additional Federal, State and Local regulations applicable to your project, such as (but not limited to) Sediment and
Erosion Control, Non-Discharge, Water Supply Watershed regulations and Coastal Stormwater. In addition, this approval
will expire when the accompanying CAMA Permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purposes and designs that you described in your CAMA application dated August
15, 2001,and the addendum letter dated September 18, 2001, and addendum map dated revised September 1, 2001. If you
change or modify your project, you must notify the Division (DWQ) in writing and you may be required to send us a new
application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and
approval letter and is thereby responsible for complying with all conditions. If total wetland fill for this project (now or in
the future) exceed one acre; compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this
approval to be valid, you must follow the conditions listed in the attached certification and the additional conditions listed
below:
1). Turbidity controls must be maintained throughout construction, so that turbidity does not exceed
25 NTUs outside the project area.
2). The attached Certificate of Completion (COC) must be submitted to the Division upon final construction
of the site.

GENERAL CERTIFICATION FOR PROJECTS ELIGIBLE FOR CORPS OF ENGINEERS GENERAL
PERMIT NUMBER 198000291 (ISSUED TO THE NORTH CAROLINA DIVISION OF COASTAL
MANAGEMENT) AND NEUSE/TAR-PaMLICO BUFFER RULES
This General Certification is issued in conformity with requirement of Section 401, Public Laws
92-500 and 95-217 of the United States and subject to the North Carolina Division of Water Quality
Regulations in 15 NCAC 2H, Section .0500 and 15 NCAC 2B .0200 for the discharge of fill material as.
described in General Permit 198000291 and for the Neuse and Tar-Pamlico Buffer Rules (15A NCAC 2B
.0233 and .0259). This Certification replaces Water Quality Certification Number 3025 issued on
September 6, 1995 and Water Quality Certification Number 3112 issued on February 11, 1997. This WQC
is rescinded when the Corps of Engineers reauthorizes Regional General Permit 0291 or when deemed
appropriate by the Director of DWQ.
The State of North Carolina certifies that the specified category of activity will not violate
applicable portions of Sections 301, 302, 303, 306 and 307 of the Public Laws 92-500 and 95-217 if
conducted in accordance with conditions hereinafter set forth.
Conditions of Certification:
1. Activities authorized by CA`Lk major permits require written concurrence from the
Division of Water Quality as well as compliance with all conditions of this General
Certification;
2. Activities authorized by Coastal Area Management Act (CAMA) Minor or General Permits
do not require written authorization from the Division of Water Quality as long as they
comply with all other conditions of this General Certification;
3. In accordance with North Carolina General Statute Section 143-215.3D(e),
any request for written concurrence for a 401 Water Quality Certification
must include the appropriate fee. If a project also requires a CAMA Permit, one payment to
both agencies shall be submitted and will be the higher of the two fees. The fee shall be
collected and distributed between the two agencies in accordance with agreements reached
between the Division of Water Quality and the Division of Coastal Management;
4. Impacts to any stream length in the Neuse and Tar-Pamlico River Basins
requires written concurrence from DWQ in accordance with 15A NCAC 2B.0233 and 15A
NCAC 2B .0259. New development activities located in the protected 50-foot wide riparian
areas (whether jurisdictional wetlands or not) within the Neuse and Tar-Pamlico River Basins
shall be limited to "uses" identified within and constructed in accordance with 15A NCAC
2B .0233 and 15A NCAC 2B .0259. All new development shall be located, designed,
constructed, and maintained to have minimal disturbance to protect water quality to the
maximum extent practicable through the use of best management practices;
5. All sediment and erosion control measures placed in wetlands or waters shall
be removed and the natural Q*ade restored after the Division of Land
Resources has released the project;
6. If an environmental document is required, this Certification is not valid until a
Finding of No Signficant Impact (FONSI) or Record of Decision (ROD) is issued by,
the State Clearinghouse. All water quality-related conditions of the FONSI or ROD
shall become conditions of this Certification;

An environmenO assessment was required for this project PrOpOsal p3ior to the acceptance bf the major
permit application. The applicant submitted an envnror mental assessment, document that rcceivcd a FONSI
(Finding of No Significant Impact) an or around June 26, 2001. The proposed project also received
clUrance'from State Clearinghouse Review on August 10, 2001.
The Carolina Beach Yacht Basin is inundated with marinas, ct pnercW piers, single family Piers and
municipal doclrs aloes most of it's shorefte. The property is alas-dfxxed as Marina by the Carolina Beach
Land Use Plan. The adjacent slaters are not designated primary nursery area by the Division of Marine
Fisheries and are closed to the ta'ldng of shellfish. The adjacent waters are classilod $B by title Division
of Water Quality.
The Met is bordered on the west by St. Joseph's street and on the east by Carolina. Beach Yacht Basin
WyxPle Grove Sound). Single family residences are to the nort4 and south of tine property. The tract is
appxaximately 150 feet wide at' St. Joseph's street and extends Approximately 527 f bet to aaaeau high
water. The'iot is 155 feet wide along the watu vard property lice but contains approximately 233 feet of
sh0=11ne when measured along NEW, The upland portion of the Unct closest to the street is characterized
by mahnepine, oak-and magnolia trees. The=maiving majority of the tract contains low 1* gramSes
that are maintained in a mowed state. Recently, grassed portions of the tract have been used to stoaTile
dredged material from maintenance dredgingprojects in the yacht basin-'The northern watma•ward porfaou
of the property is "balkheaded..and it Wends aparoxbnately 2/3 the width of the property. Uowever, the
soathem vat:erwarrd portion of the property is not bulkheaded. A drainage pipe which `transports
stormwater from St Joseph 'St=et and the shopping center suns along the southern boundary of the -tract.
It T= .approximately 30 feet from and paw:to the property line from the street to Myrtle Grove
Sound. A ditch has developed waterward of the drainage pipe outfall which is inundated with coastal.

between the ditch and the southern property Ike. 'The ditch is -reported to have developed from erosion
caused t"e used run-;off from scent storms and the heavy amount of stozmwater.generated from

extends within -the ditch towards St. JosTh's Sixeet until it reaches the outfall end of the draiua a pipe
which is .about 220 feet landward of the concrete bulkhead. The area, landward of the pipe end bas also
eroded from around thee . 'Tie pipe appears to be poorly functioning and is collapsed in several areas.
Excluding the wet]and vegetation within the ditch area, the w ater$ of Myrtle Grove Sound._adjaeent to the
property contain no vegatatdd wetlands. 'The substrate beilow mean lose water is cit=cteaized as
predominantly sand•to•mnddy sand andbas been-previously dredged.

Please find enclosed Mgures G & 10 of the above referenced per t application. These figures
have been revised following a 9111/2001 site visit with NC Division of Coastal Mauagement and
NC Division, of Water Quality staff: During this visit, it was round the figure was not scaled
correctly to did not reflect the intended location of the bulkhead alignment. The revised figures
reflect a Meld-measured bulkhead allgoment which places tho bulkhead landward of all coastal
marsh, This bass always been the intended location, of the bulkhead, and the change simply
corrects a draining error.
The area of nom coastal marsh wetland fill has also been reduced, following this c1=go. The
correctcd area of wetland fill is based on the Corps-signed wetland delineation,.
