2019 Update
MSD has 22 SIU's, 15 of which are categorical. MSD updated the Long -Term Monitoring Plan
(LTMP) in August of 2019 and received state approval October 21, 2019. MSD pretreatment staff
completed the Industrial Waste Survey (IWS) and submitted it to DWR on October 31, 2019. The
IWS has not been approved by the state at this time. Mr. Peter Weed retired in 2019, and Mr.
Roger Edwards accepted the position of Director of Operations & Pretreatment.

2 019 Pretreatment Annual R
Metropolitan Sewerage District of Buncombe County (MSD)
NPDES Permit # NC0O24911
Arcadia (5-078)
Arcadia was issued a SIU permit #5-07849 on February 1, 2019. DWR approved
the permit on January 28, 2019. A Consent Agreement was issued at the time of
permit issuance. On Apri18, 2019, two NOVs were issued. The first NOV was issued
for failing to meet four milestone dates from the Consent Agreement, as well as
failure to notify. A civil penalty of $1500 was assessed. The second NOV issued on
April 8, 2019, was for failure to report self -monitoring data on time, as well as a
BOD limit violation on February 19, 2019, and a TSS violation on February 27,
2019. A civil penalty of $300 was assessed. On April 10, 2019, the Consent
Agreement was terminated by MSD, and Arcadia was put under an Administrative
Order. On June 14, 2019, a NOV was issued Co failure to obtain flow data, pH data,
and required BOD/TSS samples in the month of April. The NOV also addressed a
BOD violation on March 27, and TSS violations on March 27th and April 3rd. A civil
penalty of $5,250 was assessed. On August 28, 2019, a NOV was issued for failing to
meet milestone four of the Administrative Order. A civil penalty of $2000 was
assessed. Arcadia hired Black &Veatch which helped them make multiple process
changes to obtain compliance with the permit. There were no limit violations in the
second half of the year and the previously mentioned Administrative Order ended
on December 31, 2019.

Balcrank now Samoa (S-071)
Balcrank's permit was modified on August 1, 2019, to reflect change of ownership
and change the company name to Samoa Corporation. The new permit included all
QP
state approved changes to our SIU permit template in 2018. DWR approved the
permit on August 1, 2019. Samoa is a batch discharger. Samoa only discharges
wastewater from the metal finishing process four to five times per year. In October
2019, sampling analysis showed a Zinc violation of 1.3 mg/l. The Zinc limit for
Samoa is 1.0 mg/l. This is above the TRC limit. Samoa only discharged twice
during the second half of 2019, which places them in SNC for Zinc limit violation.
Samoa Corporation has not changed the process for metal finishing and has not
had a violation for Zinc since they began sampling for that parameter in 2010. MSD
conducted sampling in January 2020, and the Zinc was below the limit. MSD
waited to issue a NOV for the Zinc until the laboratory could verify the results. The
SNC Report is included with the PAR as well as the Public Notice. MSD does not yet
have a copy of the Affidavit of Publication. MSD will submit it to the sate as soon as
we receive it.
Blue Ridge Metals (S-060)
On March 7, 2019, a NOV was issued for a zinc violation on January 23, 2019. No
civil penalty was assessed.

Day International Inc. (5-057)
Day international Inc. had three consecutive flow violations at monitoring point 04
on June 8, 9, and 10, 2019. This was due to a line blockage, therefore, the now
readings were not accurate. No NOV was issued, and no civil penalty was assessed.
On OctoberDay International Inc. had a TSS violation at monitoring point
A The cause of the high TSS was not determined and there have been no
subsequent violations.
GF Linamar, LLC (5-076)
On February 26, 2019, MSD sent GF Linamar a NOV for an 0&G violation on
January 11, 2019. No civil penalty was assessed. On January 6, 2020, a NOV was
issued for flow violations on November 5, 9, and 27; for a pH violation on
November 10, 2019; for an 0&G violation on November 27. No civil penalty was
assessed. On February 20, 2019 a NOV was sent for flow violations on December 9,
18, 25, and 27; for 0&G violation on December 5, 2019; for Phenols on December 5,
13, 17, and 23. No civil penalty was assessed. GF Linamar continues increase
production; therefore, they have submitted a new permit application. MSD is
working with GF Linamar to update the permit to reflect the increase in
production. Flow and phenol limits will be increased in the upcoming permit
modification. GF Linamar is working to pinpoint the 0&G issue.

Jacob Holm Industries, America (S-067)
At the start of 2019, Jacob Holm Industries (America) was under a Consent
Agreement with MSD. On January 5, 2019, there was a flow violation due to line
flushing. MSD sent a NOV on March 4, 2017) and a verbal response was deemed
sufficient. On September 4, 2019, MSD sent a NOV for three TSS violations in July of
2019, as well as three spills that occurred in June -July of 2019E A civil penalty of
$6,350 was assessed. On September 26, 2019, a NOV was sent for two TSS
violations that occurred in July -August, as well as 3 spills that occurred from
August - September. A civil penalty of $16,500 was assessed. On October 7, 2019, a
NOV was sent for a spill that occurred on September 23, 2019E A civil penalty of
$20,000 was assessed. On October 18, 2019, Jacob Holm Industries (America) was
placed under an Administrative Order.
Mission Hospital LLLP (5-068)
Mission Hospital LLLP's permit was modified on September 6, 2019) to reflect
change of ownership. MSD also added a COD monitoring requirement to determine
if chlorine is affecting the BOD results, and to develop a COD:BOD ratio if needed.
This modification also includes all state approved changes to our SIU permit
template in 2018E DWR approved the permit on September 9, 2019E
New Belgium Brewing Company (S-075)
New Belgium Brewing Company's SIU permit was modified on April 8, 2019, to
reflect the completion of Phase Two of their pretreatment system. This
modification also includes all state approved changes to our SIU permit template in
2018E DWR approved the permit on April 10, 2019E

Prince Manufacturing (5-065)
On April 4, 2019, MSD issued a NOV for flow violations that occurred on February
20, 21, 26, and 27. No civil penalty was assessed. On April 29, 2019, MSD issued a
NOV for flow violations that occurred on March 11, 13, and 19. No civil penalty was
assessed. On July 5, 2019, a NOV was issued for flow violations that occurred on
May 5, 9, 19, 20, 21, and 26. No civil penalty was assessed. These flow violations
caused no problems at MSD. Prince Manufacturing ramped up production to catch
up producing products for customers. Flows are now back to normal. In the future
their flow limit will be increased if needed. On February 2, 2020, a NOV was issued
for failure to report and failure to respond. Self -Monitoring data was not received
on time in October 2019, or December 2019. When the reports were received each
contained errors. Prince also failed to respond in a timely manner to the request
for missing data and yearly inspection. A civil penalty of $100 was assessed.
Payment has not yet been received (overdue). The payment will be collected with
possible further enforcement.

period of July 1 thru December 31, 2019. In accordance with national pretreatment regulations, 40 CFR

The Pretreatment, Emergency Response, and Collection Systems Unit (PERCS) of the Division of
Water Resources has reviewed the new Industrial User Pretreatment Permit (IUP) for the
following Significant Industrial User (SIU) submitted by Buncombe MSD. The draft IUP was
received by the Division on November 19, 2018. Additional information was requested and was
received on January 7, 2019 and the signed copy was received on January 28, 2019.

minimum requirements of 15A NCAC�2H .0905 and .0916 and 40 CFR 403.8(f)(1)(iii). Ther

1. Please submit a copy of the most recent onsite inspection form by April 30, 2019.
2. Please have the SIU sign the updated application and submit a copy to the PERCS' file by
April 30, 2019.
3. The submitted allocation table did not include Arcadia's flow, BOD and TSS in the
industrial total formula. It was corrected and attached to the letter, please keep a copy
the corrected version in your file.

THIS CONSENT AGREEMENT, entered this r day of February 2019 between the IVletrogolitan
Sewerage District of Buncombe County (MSD). and ArcadiaTatms LLC (Arcadia) at 34 Arcadia
Farms Road Arden, North -Carolina 28704.
WHEREAS, the•MSD isaPnblicly Owned Treatment"VVorlc responsible -for the imlilemetri$tion.and
administration. of the Pretreatment Program for Industrial Waste mandated by. the Clean Water Act;
+ + ,the MSD regulates the .discharge of wastewater into the sewerage system Through the
issuance of Permits to Discharge Industrial Waste and the MSD Sewer -Use. Ordinance (SUO);.
+ - + ,the MSD -issued a Permit To - Dischazge Industrial .Waste numbered S-0"�8-19- on
February 1" to Arcadia (hereinafter ieferred to as-."the_Permit" );
WHEREAS, the Permit establishes, rater alia, effluent limitations for the wastewater discharged by
Arcadia Farms It c, and requires certain self -monitoring and reporting requ}rements;
WHEREAS, Arcadia will complete: action's addressed in this agreement to ensure compliance with
the Permit is achieved by the dates agreed upon-. '
WHEREAS,. Arcadia Farms Inc. has resolved to take -the following, actions with.; the corresponding
due. dates:
1. By -February 15; 2019 shall have its pH-_acijustment system online and operating. The
Authorization to Construct for this equipment was sent on 1VIay
Z. Arcadia shall sulimitm a significant -industrial user application within 30 days of the pH
adjustment.system coming online.
3. Arcadia will gather/collect the necessary information (flow, BOD, .etc.) to engineer. a BOO
control. solution frotri the period of•systerri initial operation to March 1, 2019.
4. Based on' collected information, Arcadia will engineer a solution to reduce BOD-to level§
specified in the Permit and. shall submit such plans to MSD by March 15, 2019. .

Arcadia Farrns, LLC (Arcadia) was issued Significant Industrial User (SIU) Permit # S-078, which tools effect
on February 1, 2019. Arcadia could not meet lie SIU permitted limits at the tune the pernut took effect.
Therefore, MSD 'and Arcadia entered 'into a Consent Agreement which also tools effect on February 1,
2019. The Consent Agreement allowed for higher effluent limits for BOD and TSS temporarily while
Arcadia continued to move forsvar•d in installing pretreatriient equipment.
The Consent Agreemenlincluded milestone dates for the completion of the pretr•eatrnent.system that is
currently being installed as well as data collection completion dates and a date which Arcadia was required
to submit engineered plans for the next phase of pretreatment.
As stated in llre Consent Agreement; due dates could only be modified Witlr prior approval fiom MSD.
Arcaclia fouled to,rrieet all of the completion dates set forth for them under the Consent Agreement. Arcadia
also failed to notify MSD of the missed completion dates.
Per the Consent Agreement, MSD is irnposuig a fine of two hunched fifty dollars ($250.00) per violation for
failure to meet the Consent Agreement deadlines. Failure to Notify MSD of all four Hissed milestone dates
is a Tier 3 Violation. MSD is issumg a five hundred dollar civil penalty ($500..00) for Failure to Notify. The
total civil penalty fine that Arcadia must pay per this Notice of Violation is One thousand five hundred
dollars ($1,500.00). The civil penalty shall be submitted to MSD no later than April '20, 2019 along with a
detailed explanation of the violations.
Failure
to meet the milestone dates set forth ui the Consent Agreement as well as Failure to Notify MSD of
the missed completion dates nullifies the Consent Agreement.. Therefore, MSD �•vill be :issuuig an

Per Pexznit S-078, self -monitoring reports must be submitted uo later thau the 20�' clay of die month

the month. pH is required to be monitored at a nninnnum of daily. pH should be
monitored continuously and the value closest to the ' limit or above or below the limit is
recorded daily and reported monthly. Monthly monitoring reports are required to be
submitted no later than the 20" of the follolving month.
BOD and TSS are required to be sampled. at a minimum .of twice per iveelc according to the
90 day compliance schedule listed in Part II B 1. I (b) and the Aclzninistrative Order. Failure

Dear Mr. Edgerly,
Tlne Admirnishative Order issued oii April 10, 2019; states that Arcadia will engineer a
solution to reduce BOD to levels specified in the. Permit and shall submit such plans to' MSD
by July 5, 2019. The -plans -were not submitted by the deadline.
A Civil Penalty of up' to $250.00 (tnvo hundred. fifty dollars) for each day the milestone is
exceeded may be assessed per the Administrate Order.
Based upon the failure to meet the milestone date, MSD is issuing a civil, penalty of $2,000
(two thousand dollars). Arcadia Farms, LLC is working with MSD. and Black & Veatch
Engineering Firm to correct the issues and move forwvard in designing adequate
pretreatment. Because of the progress made and all requested updates r6ceivedq in a timely
manner; MSD has chosen -to cap the violation for failure to meet this milestone date at the
above mentioned $2,000, MSD will hold in abeyance continuing fines per day for this
milestone date, so long as continual advancement is made with all other milestone dates
being met.. .
A total civil penalty of $2,000 (two thousand dollars) must be remitted to The Metropolitan
Sewerage District of Buncombe County no later than September 13, 2019.

THIS ADMINISTRATIVE ORDER, issued by the Metropolitan Sewerage District of Buncombe '
County (MSD) to and Arcadia Farms LLC (Arcadia) at 34 Arcadia Farms Road Arden, North
Carolina 28704, on the 1 Oth day of April, 2019.
WHEREAS, the MS D is a Publicly Owned Treatment Works responsible. for the implementation
and administration of the Pretreatment Program for Industrial Waste mandated by the ,Clean Water
Act;
WHEREAS,, the MSD regulates the discharge of wastewater into the sewerage system fihrough the
issuance of Permits to Discharge Industrial Waste -and the MSD Sewer Use Ordinance (SUO),
WHEREAS; the MSD issued a Permit To Discharge Industrial Waste' numbered 5-078-19 on
February. Ist to Arcadia (herein after refers d to as the Permit"); -
WHEREAS, the Permit establishes, inter alia, effluent limitations for the wastewater discharged by
Arcadia Farms Inc. and requires (certain self -monitoring and reporting requirements;
WHEREAS, Aicadta will complete actions addressed in this order to ensure compliance with the
Permit is achieved by the dates agreed upon.
WHEREAS, Arcadia. Farms Inc. has. resolved to take the following actions with the corresponding_
due dates:
1. ' .By April 19`h, 2019 •shall have its pH adjustment. system online and operating. The
Authorization to Construct for this equipment was sent on May 29, 2018.
2. Arcadia shall submit a significant industrial user application within 30 ,days of the pH
adjustment system coming online,.
3. Arcadia Will gather/collect`the necessary information (flow, BOD, etc.) t1.o ,engineer. a BOD
F.control solution from the period of system initial operation. to June 19ths 2019.1.
• 4. Based on the collected information, Arcadia will engineer a solution to reduce BOD to levels
specified in the Pei�i}it and shall submit such plans to MSD by July Sth; 2019.
5. MSD will conduct an initial Plan Review no later than July 7th, 2019:

Resources has reviewed the Industrial User Pretreatment Permit (IUP) modification for the following

on May 15, 2019, with additional information received on June 24, 2019 and July 18, 2019. Signed IUP was

effectively control and document the discharge of wastewater from Significant/Categorical Industrial
Users to the POTW. It is the POTW's responsibility to ensure that these objectives are consistently met.

This morning we had another episode of extremely high water flow rates. I observed it myself and believe the issue is
somewhere downstream from our flume meter causing levels to be much higher than they should be for our current
flow. For example, with zero process water flow we are showing 150 gal. per minute.
I spoke with Angel and just now spoke with a gentleman from MSD who is coming out to take a look.
I'm asking that MSD use their high pressure unit to clean out the line between the street and our meter. MSD has done
this in the past although some time ago.
If MSD is not able I will be contacting someone like Mr. Rooter to do the same as quickly as possible.
Just wanted to give you a heads up on the issue. It will be noted in the July report.
Let me know if I need to do anything else at this point.

Line was flushed out this afternoon and did help quite a bit but still reading somewhat high. Gentleman from MSD would
be back with larger high pressure cleaning "hose/nozzle". Found several cloth rags in the line along with some
gravel. The rags can only come through our sanitary waste stream since there is no way for rags to pass through our
water treatment process. We will attempt to deal with this issue. Not sure about the gravel.
Will keep you posted.
Did check our flume reading again today to be sure it is reading correctly and it is.

FYI. MSD recently cleaned out the drain line again from our flume meter to the street. My understanding from one of the
MSD technicians is that there may be a problem with the line due to excessive dirt/gravel they are seeing with the
camera.

I wanted to make you aware of the violations noted within our December MSD monthly report.
We experienced flow volumes that exceeded our S-076 permit's limit on: gin 251n, and the 271n
%s of right now, the &076-18 permit only considers 4 of the 8 DCMs implemented and MSD is
aware of this. Our permit is currently being revised to account for the additional DCMs we've
installed on the production floor. Since the new machines have led to an increase in the
amount of wastewater discharged, our updated permit has a new, proposed flow limit of
06019181167 MGD.
Phenol levels on December 51n 13tn 17tn and the 231d exceeded our permit's limit of 0.024
mg/I. Much like the flow issue, though, this will be resolved once the updated permit is
approved. Permit limits will increase to account for all waste streams containing Phenols.
Oil & Grease levels on December 5tn reached 66 mg/l. This is outside our permit limit of
37mg/I. To prevent this issue from re -occurring, we will continue to work over the next few
weeks to pinpoint what oil is evaporating with the water and ending up in the distillate tank.
Once results are known, this will be communicated with MSD.
pH values were all within permit limits and were taken from Vacudest' internal pH monitor
inside the distillate tank. The pH neutralization system is proving to work effectively as we
haven't seen pH underruns since implementation in November.

Consent Agreement

Metropolitan Sewerage District of Buncombe County, NC
THIS CONSENT AGREEMENT is a continuation of the previous agreement entered into on June 12,
2018 between the Metropolitan Sewerage District of Buncombe County (MSD) and Jacob Holm
Industries (America), Inc. at 1265 Sand Hill Road, Candler, North Carolina with updated conditions,
WHEREAS, MSD is a Publicly Owned Treatment Wor•lc responsible for the implementation and
administration of the Pretreatment Program for Industrial Waste mandated by the Clean Water Act;
WHEREAS, MSD regulates the discharge of wastewater into the sewerage system through the issuance .
of Permits to Discharge Industrial Waste and the MSD Sewer Use Ordinance (SUO);
WHEREAS, MSD issued a Permit To Discharge Industrial Waste' numbered S-067-17 to Jacob Holm
Industries (America), Inc, on January 1, 2017. and was modified on 'Jt1ne 11, 2018 (herein after referred to
as "the Permit"); .
WHEREAS; the Permit establishes, hater aria, effluent limitations for the wastewater discharged by
Jacob Holm Industries (America), Inc. and requires certain self -monitoring and reporting requirements of
Jacob Holm Industries (America), Inc.;
WHEREAS, Jacob Holm Industries (America), Inc, entered into a Consent Agreement with MSD on the
12°i day of J11ne, 2018, which was to expire on the lst day of DCtObet•, 2018.
WJFIEREAS, Jacob Hohn Indush•ies (America), Inc, met with MSD Industrial Waste Staff on the 251h day

Act;
WHEREAS,. the MSD regulates the .discharge of wastewater into the sewerage system through, the
issuance of Permits to Discharge Industrial Waste and the MSD Sewer Use Ordinance (SUO)s
WHEREAS, the MSD, issued a Permit To Discharge Industrial Waste numbered S-06747 on June
11th, 2018 (herein after referred to as "the Permit"),
WHEREAS, the.'Permit establishes effluent limitations for the wastewater discharged by Jacob
Holm Industries (America), Tnc.4 and requires certain self -monitoring and reporting requirements,
WHEREAS, Jacob Holin Industries (America), Inc. will 'complete actions addressed in this order to
ensure compliance with the Permit is achieved by the dates agreed upon. .
WHEREAS, Jacob Holm Industrieg (America), Inc, will. take the following actions with the+
corresponding due dates;
1. By October 23`d, 2019 shall have a temporary dewatering -system in place to reduce TSS,
until the screw press is back online.
2. By. -January: 7t" , 2020 will` submit plans for a pretreatment .system that will. increase
reaction/holding time . of slugs and/or spills. , MSD will review within 10 business days of
submittal.
3. By March Z011, 2020 will have the screw press repaired and will have replacement .parts on
site.
4. Within 120 days of _MSD approval; but no later than June 1" 2020, the, pretreatment system
addressed in item 2 shall be installed.
Due Dates can only be changed or inodifled with the approval from the Metropolitan Sewerage
District of Buncombe County WQ prior to the scheduled date.

$5001.00 will be imposed for each violation, If Jacob Holm Industries (America), Inc. fails to meet the
milestone dates, the Metropolitan Sewerage District will impose, a fine of up to $500.00 per day for
each day he milestone is exceeded. Any spills or slug Ioads inay carry a fine of $1,g00 per hour.
If Jacob Holm Industries (America), Inc. does not follow the action deadlines outlined they may be
subject to additional -civil penalties , in additra ion. to penalties. which may be assessed under this

Re: Notice of Violation(NOV) -Failure to Report &Failure to Respond, Permit # S-065
Dear Mr. Smith,
Prince Manufacturing is required to report effluent flow and sampling data on the Self -Monitoring
Monthly Report Forms on MSD's website, as well as submit signed hardcopies of the forms and supporting
lab analysis to the MSD. Self -Monitoring Report Forms must be postmarked no later than the twentieth
day of the month following the month in which the samples were taken. It is the industry's responsibility
to maintain the records and report the Self -Monitoring Data in the proper format and in a timely manner.
MSD staff did not receive the October 2019 Self -Monitoring Report on time and conducted a site visit in
November. At the time it was noted that the EHS staff position was eliminated. Therefore, MSD staff
conducted training and education on the permit and reporting requirements with Mr. Andy Smith. MSD
did not issue an official NOV at the time, however issued a verbal notification along with the education.
After the visit, the October 2019 and November 2019Self- Monitoring Data was received. The monitoring
reports received did not have all data entered properly. MSD was made aware of the issues with entering
the data for those months and made the corrections in the database without issuing an official NOV. MSD
was told that the issues would not continue.
The Self -Monitoring Report for December 2019, was due no later than January 20, 2020. The report has
not been submitted as of February 3, 2020. MSD staff attempted to contact Prince Manufacturing by
phone and by email. A voicemail was left and an email sent regarding the failure to report on January 28,
2020. In the January 28, 2020 email MSD staff also requested to complete the annual inspection. No
response has been received regarding the Self -Monitoring Report or the request for an inspection.
MSD is issuing this Notice of Violation for failure to report the December Data as well as failure to respond
to notifications of the missing data and failure to respond to the request for an inspection.
December's failure to report is the second time in a six-month period and is a Tier 2 Violation. The civil
penalty for a Tier 2 failure to report violation is one hundred dollars ($100.00).
MSD will forgo the civil penalty for failure to respond at this time, however if Prince Manufacturing fails
to respond to further notifications a civil penalty will be issued for this occurrence as well as the next.

Please be advised that civil penalties may be issued with a maximum civil penalty of twenty-five thousand
dollars per day per violation in accordance with the Sewer Use Ordinance,
Prince Manufacturing is required to submit a letter of response and corrective actions as well as the
civil penalty no later than February 21, 2020. Prince is also required to submit the December Self -
Monitoring Report in the correct format no later than February 7, 2020.
