Fax: 336-835-9840 General Information: This is the fifth PAR submitted and the following two IUP's are in YVSA's pretreatment program: • Pittsburgh Glass Works, LLC (PGW) which began operation in early March 2013 and, • Weyerhaeuser NR Co., which was issued an IUP May 20, 2019, but has not discharged any pretreatment flow since the issuance. The AT, STMP, HWA, SUO, ERP, IWS and permits are up to date. All dates on the Division's Pretreatment Program Info Database Sheet are correct. Site inspections of the PGW facility were completed by the YVSA staff on 9/26i 19 and 12i17/19. IU Information: PGW's IUP renewal effective and expiration dates are 8r21i 19 and 3;`6;`21, respectively. The IUP was modified on 8i21-19 in which the annual average flow was increased from 0.150 mgd to 0.210 mgd. Weyerhaeuser's IUP renewal effective and expiration dates are 4! i 19 and 11.31 '20, respectively. As stated in the 2018 PAR, PGW was in Significant Noncompliance (SNC) for both 6-month periods. However, the second six-month period SNC's were still being evaluated into 2020. The following notice of violation (NOV) and civil penalty was issued to PGW on July 19, 2019 for the second six-month period in 2018. The civil penalty was prompted due to PGW consistently exceeding the grit limit and not addressing in a timely manner. A press release for the SNC was issued on 3/6/19 (enclosed). During 2019, PGW was in SNC for both 6-month periods due to excessive grit or other material resulting from their process discharge. Exceedances were document for the first 6-month period for five months (January through May) even though filter cleaning was implemented and additional filters were installed. Exceedances for the second 6-month period were recorded for all months except November. Around August 2019, PGW staff had consulted with their attorneys as well as contracted environmental engineers to evaluate options and provide corrective action to address the 7/19/19 NOV. From this time and still ongoing (through the present), PGW staff has provided that a different methodology needs to be utilized as a substitution for the sampling and analysis methods for current Permit parameter Grit (defined as fixed solids retained on 65 mesh, i.e. 210 micron). Furthermore, PGW staff has noted for their DMRs from August through December 2019 that they would have been in compliance as a result of some newer methodology analysis through the help of their environmental engineers and as provided by their attorneys. The facility is also found to be in violation of Part i Section F of the IUP, which provides the monthly average grit limit should not exceed 12 mg/L. Please note that there has been multiple findings of grit and/or garnet residual in the collection system line coming from the Pittsburgh Glass Facility. Furthermore, staff has been diligently cleaning the line from the facility for the past few months (since the end of September 2018 and as has been completed since September of 2017 as noted in the previous NOV and CPA). An invoice for these cleanings is included in this packet as Invoice # 20-1009. The facility was found to be Noncompliant for the months of July through December 2018 for exceeding their monthly grit limit of 12.0 mg/L. These violations constitute Significant Noncompliance (SNC). [Please note that another NOV along with another assessment for the first six months of 2019 (January through June 2019) will be issued later this year as an assessment of this data is completed.] Although YVSA understands that several corrective action steps have been implemented to correct for this violation of the permit, a civil penalty assessment has been issued to Pittsburgh Glass Works, LLC, in accordance with our Enforcement Response Plan: $75,000.00 _ TOTAL CIVIL PENALTY_ } YVSA requests that Pittsburgh Glass Works, LLC, submit payment of this penalty within thirty (30) days of receipt of this notice. In addition, Federal regulations found in 40 CFR 403.8 (f) (2) (viii) requires that a Public Notice of industrial users in significant noncompliance be published annually. Pittsburgh Glass will be included in that notice. Per Section 10 of the Sewer Use Ordinance, any user issued a civil penalty assessment has the right to an adjudicatory hearing upon making written demand to the POTW Director within thirty (30) days of receipt of the civil penalty assessment. (Vitro) CONSENT ORDER AND COMPLIANCE SCHEDULE Pursuant to provisions of the Sewer User Ordinance of the Yadkin Valley Sewer Authority, this Consent Order is made effective the 1st day of March, 2020, between Pittsburgh Glass Works (PGW), Inc. (hereinafter the "User") and the Yadkin Valley Sewer Authority (hereinafter the "Authority"). The User and Authority hereby stipulate and agree as follows: User holds Yadkin Valley Sewer Authority Pretreatment Permit No. IWP001 (hereinafter the "Permit", which shall refer to User's existing permit and any subsequent renewals or modifications thereof) for the operations of existing pretreatment units and discharges from said treatment works into the Authority's sewer system. 2. User has submitted test results that indicate User has not consistently met the permit limitations for Grit set forth in its Permit. Based upon those test results, the Authority has issued a Notice of Violation & Civil Penalty Assessment for the period July 2018 through December 2018. Based upon more recent test results, User believes that the prior testing was fundamentally flawed. 3. The Authority believes that achievement of these limits will require resolution of existing problems in the present treatment train and possibly, development of alternative solutions to alleviate noncompliance, including but not limited to the construction of additional pretreatment facilities as well as the preparation of plans and specifications as necessary. User believes that, if accepted, the new testing methodology will establish that User is in compliance with all terms of its Permit. 4. User hereby agrees to do and perform all of the following: a. Meet and comply with all terms and conditions of the Permit (except as modified by the Order) provided, however, subject to the terms and conditions of the Consent Order, the following shall apply: Parameter Daily Max (mciIL) _Monitoring Frequency "Grit No limit` Monthly "There will be no monthly average limit for grit during this consent order and compliance schedule. This may be changed to a different reporting parameter as mentioned in (b)(ii) below if NCDEQ will allow approval of change for the IUP. For this to be completed for the interim, a modification for the IUP must be completed to show no limit for grit during this Consent Order timeline. "After the expiration date of this Consent Order and Compliance Schedule (July 31, 2020), the final grit limit of 12 mg/L (monthly average) will become effective on August 1, 2020. The definition of Grit in the permit shall be modified to acknowledge that Grit is material with a specific gravity of greater than 2.65 (U.S. E.P.A. 1987), Unless and until Compliance is achieved, the User will undertake activities necessary to ensure that User is in Compliance in accordance with the following schedule: COMPLIANCE SCHEDULE Activities Deadline for Completion (i) Provide documentation about the new April 1, 2020 pretreatment system just installed for User to provide verification of pretreatment system costs (i.e. invoices, engineering costs, etc.). (ii) Submit to the Authority alternative sampling April 1, 2020 and analysis methods for consideration as substitution for current Permit parameter Grit (defined as fixed solids retained on 65 mesh, i.e. 210 micron). Any substitute methods should meet the objective of identifying excessive solids in the wastewater that may be abrasive or may tend to accumulate within the Authority's collection system. (iii) Provide sample analysis of new pretreatment April 20, 2020 system to demonstrate effort towards meeting final compliance with the Permit by the end of this Order. (iv) Provide documentation of above said effort July 30, 2020 towards meeting final compliance with the Permit from January 1, 2020 through June 30, 2020. C. User shall perform each of the activities set forth in subparagraph (b) on or before the dates established thereby unless such dates are extended by agreement of User and the Authority may request such extensions for good cause, and the Authority will not unreasonably withhold its consent to such extensions. d. User shall submit a comprehensive written report within five (5) days following each milestone date specified in subparagraph (b). Each such report shall be in narrative form, shall state in detail the activities undertaken since the last report to achieve Compliance, and shall indicate whether User has met the due date for the relevant milestone established in this Consent Order. If any report contains notice of failure to meet a milestone date, the report shall also include a statement explaining the cause of the failure, any remedial actions taken, and the probability of meeting the next milestone. During any period of construction, User shall submit on or before the 20th day of each month, detailed construction progress reports stating therein in narrative form the work performed during the month and the percentage of completion of the project. All reports required by the Consent Order shall be submitted to the Authority by Certified Mail, Return Receipt Requested, addressed to: Nicole Johnston Executive Director Yadkin Valley Sewer Authority PO Box 828 Elkin, NC 28621 e. The User shall pay the Authority $30,000, no later than July 30, 2020, for the apparent Significant Non -Compliance during the July through December 2018 reporting period (which is a reduction of the original civil penalty assessment of $75,000). If compliance is achieved with the permit from January 1, 2020 through June 30, 2020, the Civil Penalty Assessment for the Significant Non -Compliance for January 2019 through June 2019 will be abated. The Authority reserves the right to issue a Notice of Violation for any portion of the period July 2019 through December 2019 in which User exceeds the grit discharge allowed under its Permit, based upon the test results submitted by User. If User achieves compliance for the period January 1, 2020 through June 30, 2020, any Civil Penalty Assessment for Significant Non -Compliance for any portion of the period July 2019 through December 2019 shall also be abated. 5. Any violation of the terms of this Consent Order shall subject the User to the enforcement authority outlined in the Sewer Use Ordinance and according to the Enforcement Response Plan. Such action may include, but is not limited to such fines, penalties and assessments as may be set forth in the Enforcement Response Plan of the Yadkin Valley Sewer Authority, as amended from time to time. In lieu of other penalties, the User acknowledges that the Authority has the right under the Ordinance to impose civil penalties for violations of the User's limits or failure to meet a milestone date under this Consent Order, or failure to achieve full compliance with Consent Order.
