APPROVAL of 401 Water Quality Certification
Dear Ms. Grubenhoff:
You have our approval, in accordance with the attached conditions, to place fill in 0.006 acre of waters of Lake Wylie
for shoreline stabilization measures on your property in Mecklenburg County, as described in your application received by
the Division of Water Quality on June 26, 2001. After reviewing your application, we have decided that this fill is covered by
General Water Quality Certification Number 3280, which can be downloaded from our web site at
http://h2o.enr.state.nc.us/ncwetlands . This Certification allows you to use Regional Permit Number 198200030 when the
Corps of Engineers issues it. In addition, you should get any other federal, state or local permits before you go ahead with
your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water
Supply Watershed regulations. Also t1iis approval will expire when the accompanying 404 permit expires unless otherwise
specified in the General Certification. f
This approval is only valid for the purpose and design that you described in your application. If you. change your
project, you must notify us in writing and you may be required to send us a new application for a new certification. If the
property is sold, the new owner ust be given a copy of the Certification and approval letter and is thereby responsible for
complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acr%lbompensatory
mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to bevalid, you must follow the
conditions listed in the attached certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act
within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to
Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh,
N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you have

the above referenced property on a Duke Power lake. Duke Power can authorize the
proposed construction/activity, provided-it is completed in accordance with the conditions
required by the Corps of Engineers and the Division of Water Quality, and as described in
the approved application(s). The proposed activity must be completed within twelve
(12) months from the date of this letter of approval by Lake Management.
Please post the enclosed notice at the shoreline during construction so that it will be
visible from the lake. Our office should be notified when construction is complete so a
final inspection may be conducted.

Dear Ms. Grubenhoff:
According to your August 14, 2001 transmittal, we understand that you need to
stabilize approximately 250 linear feet of shoreline due to eroding shoreline banks by
installing riprap. Marla Chambers, District 6 Assistant Fish Biologist visited your site on
August 24, 2001. She determined that the eroding banks are approximately 10-15 feet. in
height above the beach area.
Your lot frontage may be partly in an Impact Minimization Lone (IML) because
of shallow water habitats, Lake Use Restrictions for the IMZ require that stabilization
activities are not to take place during the months of March - June to limit impacts to fish
spawning. Also, the Wildlife Resources Commission is accorded the opportunity to
recommend mitigation requirements for stabilization in areas classified as an 1MZ.
We recommend that the following measures be implemented to minimize impacts tit
fish and wildlife habitats:
l . Riprap should not extend beyond the point necessary to stabilize the eroding banks.
The beach area and normal pool shoreline should remain undisturbed. Riprap should
be placed up to the edge of the forest floor (top of the existing bank).
2. Clearing for access along the banks should be limited to the minimum necessary to
install the riprap. Any temporary roads through the buffer zone should be no more
than 10 feet in width. Using barges f-or the project would reduce impacts to the
existing vegetated buffer zone.

3. Other than those trees removed for temporary access, any remaining vegetation
within the buffer should be maintained for stabilization and habitat: benefits.
Replacing removed trees with native species such as river birch, serviceberry, black
willow or other native small diameter trees should improve habitat quality for some
species of birds and wildlife.
These comments are provided according to provisions of the Federal Power Act (16
U.S.C. 791a et seq.) and the Dish and Wildlife Coordination Act (48 Stat. 401, as

SUBJECT: Nevin Community Park Dam, Mecklenburg County
These comments are provided in accordance with provisions of the Clean Water Act of
1977 (33 U.S.C. 466 et. seq.), the Fish and Wildlife Coordination Act (48 Stat. 401, as amended,
16 U.S.C. 661-667d) and the Dam Safety Law of 1967 (GS 143-215.23 et. seq.).
We have reviewed the subject project and find no cause for objecting to the design and
specifications of the dam with the following provisions:
I) Minimum flow requirements as established by the NC Division of Water Resources are
effective immediately downstream of the dam.
2) Project sponsors should be contact the US Army Corps of Engineers (COE) and the NC
Division of Water Quality (DWQ) to determine if a COE 404 permits and DWQ 401
certifications are required.
3) Any stream or wetland mitigation required at this sight should be should be coordinated
with the COE and DWQ.
4) An Environmental Assessment (EA) or a Finding of No Significant Impact (FONSi) may
be necessary if public funds are involved.
We will provide additional comments to the appropriate permitting agencies when
