Applicants are encouraged to visit DWQ's 401/Wetlands Unit website at http://h2o.enr.state.nc.us/ncwetlands to read about current requirements for the 401 Water Quality Certification Program and to determine whether or not Riparian Buffer Rules are applicable. The applicant is also advised to read the full text of the General Certification (GC) matching the specific 404 Permit requested. In some cases, written approval for some General Certifications is not required, provided that the applicant adheres to all conditions of the GC. Trout Waters Coordination - Special coordination with the North Carolina Wildlife Resources Commission (NCWRC) is also required for projects occurring in any of North Carolina's twenty-five counties that contain trout waters. In such cases, the applicant should contact the appropriate NCWRC regional coordinator (listed by county on the last page of this application). DCM will determine whether or not the project involves a designated Area of Environmental Concern, in which case DCM will act as the lead permitting agency. In such cases, DCM will require a Coastal Area Management Act (LAMA) Permit and will coordinate the 404/401 Permits. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The existing substation location severelv limits the feasibilitv of avoidine wetland impacts. However, several steps were taken by CP&L to minimize impacts to wetland and potential threatened and endangered species (T&E) habitat. The large, forested wetland encompassing the majority of the eastern half of the property was scaled down pertaining to wetland impacts by CP&L for the expansion on the east side of the existing substation. The original site plan proposed impacts to two naturalized ditch (linear) wetlands and a larger portion of the aforementioned large, forested wetland. Upon completion of the T&E habitat evaluation, it was determined that a portion of the large, forested wetland proposed for impact was potential T&E habitat. The original site plan was ultimately altered to avoid the potential T&E habitat, Page 7 of 12 includes impacts to three naturalized ditch (linear) wetlands and a small portion of the large, forested wetland near Blue Clay Road, after altering site plans twice to avoid a majority of the forested wetland systems and all of the potential T&E habitat. VIII. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Navigation. No activity may cause more than a minimal adverse effect on navigation. 2. Proper Maintenance. Any structure or fill authorized shall be properly maintained, including maintenance to ensure public safety. 3. Erosion and Siltation Controls. Appropriate erosion and siltation controls must be used and maintained in effective operating condition during construction, and all exposed soil and other fills must be permanently stabilized at the earliest practicable date. 4. Aquatic Life Movements. No activity may substantially disrupt the movement of those species of aquatic life indigenous to the waterbody, including those species which normally migrate through the area, unless the activity's primary purpose is to impound water. 5. Equipment. Heavy equipment working in wetlands must be placed on mats or other measures must be taken to minimize soil disturbance. 6. Regional and Case-by-case Conditions. The activity must comply with any regional conditions which may have been added by the Division Engineer and any case specific conditions added by the Corps. 7. Wild and Scenic Rivers. No activity may occur in a component of the National Wild and Scenic River System; or in a river officially designated by Congress as a "study river" for possible inclusion in the system, while the river is in an official study status. Information on Wild and Scenic Rivers may be obtained from the National Park Service and the U.S. Forest Service. 8. Tribal Rights. No activity or its operation may impair reserved tribal rights, including, but not limited to, reserved water rights and treaty fishing and hunting rights. 9. Water Quality Certification. In certain states, an individual state water quality certification must be obtained or waived. 10. Coastal Zone Management. In certain states, an individual state coastal zone management consistency concurrence must be obtained or waived. 11. Endangered Species. No activity is authorized under any NWP which is likely to jeopardize the continued existence of a threatened or endangered species or a species proposed for such designation, as identified under the Federal Endangered Species Act, or which is likely to destroy or adversely modify the critical habitat of such species. Non-Federal permittees shall notify the District Engineer if any listed species or critical habitat might r -2- be affected or is in the vicinity of the project and shall not begin work on the activity until notified by the District Engineer that the requirements of the Endangered Species Act have been satisfied and that the activity is authorized. Information on the location of threatened and endangered species can be.obtained from the U.S. Fish and Wildlife Service and National Marine Fisheries Service. 12. Historic Properties. No activity which may affect Historic Properties listed, or eligible for listing, in the National Register of Historic Places is authorized, until the District Engineer has complied with the provisions of 33 CFR 325, Appendix C. The prospective permittee must notify the District Engineer if the authorized activity may affect any historic properties listed, determined to be eligible, or which the prospective permittee has reason to believe may be eligible for listing on the National Register of Historic Places, and shall not begin the activity until notified by the District Engineer that the requirements of the National Historic Preservation Act have been satisfied and that the activity is authorized. Information on the location and existence of historic resources can be obtained from the State Historic Preservation office and the National Register of Historic Places (see 33 CFR 330.4(g)). 13. Notification. a. Where required by the terms of the NWP, the prospective permittee must notify the District Engineer as early as possible and shall not begin the activity: (1) until notified by the District Engineer that the activity may proceed under the NWP with any special conditions imposed by the District or Division Engineer; or (2) if notified by the District or Division Engineer that an individual permit is required; or (3) Unless 30 days have passed from the District Engineer's receipt of the notification and the prospective permittee has not received notice from the District or Division Engineer. Subsequently, the permittee's right to proceed under the NWP may be modified, suspended or revoked only in accordance with the procedure set forth in 33 CFR 330.5(d)(2). b. The notification must be in writing and include the following information and any required fees: (1) Name, address and telephone number of the prospective permittee; (2) Location of the proposed project; -3- (3) Brief description of the proposed project; the project's purpose; direct and indirect adverse environmental effects the project would cause; any other NWP(s), regional general permit(s) or individual permit(s) used or intended to be used to authorize any part of the proposed project or related activity; (4) Where required by the terms of the NWP, a delineation of affected special aquatic sites, including wetlands; and _ (5) A statement that the prospective permittee has contacted; (a) The USFWS/NMFS regarding the presence of any Federally listed (or proposed for listing) endangered or threatened species or critical habitat in the permit area that may be affected by the proposed project; and any available information provided by those agencies. (The prospective permittee may contact Corps District Offices for USFWS/NMFS agency contacts and list of critical habitat.) (b) The SHPO regarding the presence of any historic properties in the permit area that may be affected by the proposed project; and the available information, if any provided by that agency. 14. Water Supply Intakes. No discharge of dredged or fill material may occur in the proximity of a public water supply intake except where the discharge is repair of the public water supply intake structures or adjacent bank stabilization. 15. Shellfish Production. No discharge of dredged or fill material may occur in areas of concentrated shellfish production, unless the discharge is directly related to a shellfish harvest activity authorized by nationwide permit. , 16. Suitable Material. No discharge of dredged or fill material may consist of unsuitable material (e.g., trash, debris, car bodies, etc.) and material discharged must be free from toxic pollutants in toxic amounts. 17. Mitigation. Discharges of dredged or fill material into waters of the . United States must be minimized or avoided to the maximum extent practicable at the project site (i.e., on-site), unless the District Engineer has approved a compensation mitigation plan for the specific regulated activity. 18. Spawning Areas. Discharges in spawning areas during spawning seasons must be avoided to the maximum extent practicable. 19. Obstructions of High Flows. To the maximum extent practicable, discharges must not permanently restrict or impede the passage of normal or expected high flows or cause the relocation of the water (unless the primary purpose of the fill is to impound waters). -4- 20. Adverse Impacts from Impoundments. If the discharge creates an impoundment of water, adverse impacts on the aquatic system caused by the accelerated passage of water and/or the restriction of its flow shall be. minimized to the maximum extent practicable. 21. Waterfowl Breeding Areas. Discharges into breeding areas for migratory waterfowl must be avoided to the maximum extent practicable. 22. Removal of Temporary Fills. Any temporary fills must be removed in their entirety and the affected areas returned to their preexisting elevation. NOTES: 1. Qualification for and issuance of a nationwide permit does not relieve the applicant of the need to obtain any other required State or local permits. 2. Should all or part of a proposed activity be located within an Area of Environmental Concern (AEC) as designated by the North Carolina Coastal Resources Commission, a CAMA permit is required from the North Carolina Division of Coastal Management. Should an activity within or potentially affecting an AEC be proposed by a Federal agency, a consistency determination pursuant to 15 CFR 930 must be provided to the North Carolina Division of Coastal Management at least 90 days before the onset of the proposed activity. REGIONAL CONDITIONS 1. All fill material authorized by this permit must be obtained from an upland source. 2. Use of this permit for livestock and domestic animal waste treatment facilities is not allowed. STATE CONSISTENCY CONDITIONS 1. All fill material authorized by this permit must be obtained from an upland source. 2. Use of this nationwide permit for waste disposal facilities is not authorized. 3. Established erosion control practices shall be utilized to prevent violations of the appropriate turbidity water quality standard (50 NTU's in streams and rivers not designated as trout waters by the North Carolina Division of Environmental Management; 25 NTU's in all saltwater classes and all lakes and reservoirs and 10 NTU's in trout waters). -5- 4. Proposed fill of greater than one acre in SA, trout, ORW, WS-1 and WS-2 HQW watersheds requires public notice and an individual Section 401 Water Quality Certification from the North Carolina Division of Environmental Management. 5. For activities resulting in the loss of waters of the United States greater than 1/3 of an acre, the applicant must receive written concurrence from the North Carolina Division of Environmental Management that the proposal is certified under the Section 401 Water Quality Certification Program. 6. Failpre to do so will be considered a violation of this approval. 5. Any borrow material brought onto this site must be from a legally operated mine or other approved source. A single use borrow site or an area to waste material is only permissible if it is operated under total control of the Financially Responsible person or firm who is developing this site and a plan modification is submitted to this office that includes the area in question. 6. GENERAL The project site is located east of the Town of Castle Hayne and west of 1-40. The site is bounded on the northwest side by Blue Clay Road (N.C.S.R. 1318) and on the other three sides by CP&L property. The project area is located on the upper north side of the CP&L property. The drainage area of the project site consists of approxitmaly 9.34 acres. The total CP&L property is 46 acres. The intent of this project is to construct a new 200' X 235' substation pad to replace an existing 170'X 140' pad and to replace an existing gravel drive with two new 20' wide gravel drives that will connect the site to NCSR # 1318. 2. EXISTING SITE The existing drainage area of the project site is approximately 9.34 acres in size and consist of the 115/23 kV yard. The 115/23 kV yard and the surrounding area within the CP&L property has been used as an electric substation since the 1950's. The site is relatively flat and drains into a network of wetlands, open channels and roadside drainage ditches that surround the site. According to the environmental survey conducted by Environmental Services, Inc, (see attached document) approximately 1.37 acres of delineated wetland and Threatened and Endangered (T&E) Species areas are within the existing project site, though the T&E area will not be impacted at all. Permitting with the US Corps of Engineers and NCDENR is currently in progress for the wetlands. In addition, the Threatened and Endangered Species permitting is on going as well. 3. PROPOSED IMPROVEMENTS The proposed improvements include expanding the existing 115/23 kV yard, constructing two 20' wide gravel entrances, installing two 15" culverts, grading proposed and existing swales to utilize the existing drainage system and incorporating two level spreaders and a forested filter strip to attenuate any peak stormwater flows. See attached calculations and drawings for more detail. 4. EROSION CONTROL CONSIDERATIONS Erosion control considerations are integrally tied to the existing storm drain system. All culvert inlets will be protected with inlet protection and the outlets will have rip rap dissipater pads to eliminate sediment migration through the storm drain system. In addition, silt fencing will be located on the low side of the affected areas which will not impede the flow of storm water. The proposed drainage swales will be properly lined with erosion control matting. Temporary construction entrances will be located at the entrance/exit points of the new work area. All erosion control measures are documented on the erosion control plan and detail sheet. 5. OPERATION AND MAINTENANCE PLAN Contractors shall be responsible for periodic inspection and maintenance of all indicated erosion control devices. In addition, inspection and any necessary maintenance will be required immediately following any significant storm event. Any measure that fails to function as intended shall be repaired immediately. Upon completion of construction, the property owner shall be responsible for site maintenance. According to the April 1999 edition of the Stormwater Best Management Practices manual, maintenance for the Grassed swales include the following: • At least once annually, remove excess sediment, especially from the upstream edge, to maintain original contours and grading. • At least once annually, repair any erosion and regrade the swale to ensure that the runoff flows evenly in a thin sheet through the swale. • At least once annually, inspect vegetation and revegetate the swale to maintain a dense growth of vegetation. • Grassed swales shall be mowed at least twice annually to maximum height of six inches According to the April 1999 edition of the Stormwater Best Management Practices manual, maintenance for the a Primarily natural, woody vegetation strip includes the following: • At least once annually, remove deposited sediment, especially from the upstream edge, to maintain original contours and grading. • Repair channels that form and regrade the filter strip to ensure that the runoff flows evenly in a thin sheet above the filter strip • Repair level spreader whose disrepair can cause the formation of channels in the filter strip. • Reseed and regrade the filter strip to maintain a dense growth of vegetation, especially if the strip has been used for sediment control. • Grassed filter strips shall be mowed at least twice annually to maximum height of six inches. 6. DESIGN APPROACH According to the New Hanover County Storm Water Management Ordinance Adopted September 5, 2000, section 6.4, redevelopment activity shall provide sufficient management of post-redevelopment runoff from a 10-year frequency storm such.that the discharge rate of post-redevelopment stormwater runoff does not exceed the pre- development rates. Pre and post calculations indicate that storm water runoff will increase from an existing 26.34 cfs to a proposed 29.04 cfs. The increase in stormwater runoff from the existing conditions to the proposed conditions is 2.7 cfs over a 9.34 acre area of which 15% of the area is covered with wetlands. Due to the limited area of the site, the wetlands and Threatened and Endangered areas and the small increase in runoff, the use of existing and new grassed swales to direct the runoff to two level spreaders then to a forested filter strip is the design approach chosen. First, three primary grassed swales will be used to catch the runoff from the proposed gravel pad. Because of the flatness of the existing terrain, the grassed swales are sloped 1 percent or less, slowing the velocity of the runoff, retarding peak flow rates, and allowing infiltration of the runoff water into the soil. The runoff is then routed thru two stone-filled trench level spreaders then on to a forested filter strip. The level spreaders and the filter strip will be used in combination with the grassed swales to provide a TSS removal of up 85%. We feel these prepared measures will properly control and attenuate the insignificant increase in post construction stormwater runoff and meet New Hanover County's section V objectives: • To prevent the creation of new flood prone areas. • To reduce the discharge of pollutants to the maximum extent practicable by controlling storm water discharge rates and encouraging the use of best management practices, structural and/ or nonstructural storm water quantity and quality control measures and other provisions. • To reduce erosion associated with storm water runoff. • To provide for inspection and proper maintenance of structural and nonstructural storm water facilities. • To prohibit non-storm water discharges and require the removal of illicit discharges. Erosion and Sedimentation Control 1.01 General: The contractor shall be responsible for erosion and sedimentation control within the construction limits; for prevention of sediment laden runoff leaving the construction limits or entering ditches, streams or water impoundment's; and for implementation of necessary erosion and sedimentation control measures to meet the requirements of the North Carolina Department of Environment, Health, and Natural Resources. The Contractor shall also be responsible for all damages or fines resulting from erosion or sediment laden runoff in the execution of his contract. 1.02 Construction Sequence: While the use of erosion and sedimentation control devices is especially important on areas of steep topography, easily erodible soils and sites in close proximity to water courses throughout the construction period, the control measures should be installed prior to the commencement of land clearing and shall be fully maintained and periodically inspected until final restoration and stabilization is completed. Unrestored cleared areas shall be kept to a minimum. Disturbed areas ahead of construction shall only be accomplished on those segments for the shortest practical distance as required for continual progress. Final restoration shall not be delayed until completion of the project but will be carried out in phases as the work proceeds. Under no circumstances will any areas be left denuded for more than (30) thirty calendar days without some form of stabilization until final restoration is complete. 1.03 Sedimentation: Control Measures: The following are some of the sediment control devices or measures that may be required to prevent sedimentation of streams, water courses, or drainage structures: 1.
