Deane Brunson KBB Developers, Inc. 10800 Sike Place, Ste 250 Charlotte, NC 28277 Dear Mr. Brunson: You have our approval, in accordance with the attached conditions and those listed below, to place fill material in 197 linear feet of streams for the purpose of constructing a road crossing at Stratford on Providence, Phase 2 in Union County, as you described in your application dated July 6, 2001, revised on May 14, 2001 and revised August 20, 2001. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3289. This certification allows you to use Nationwide Permit Number 14 when the Corps of Engineers issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non- Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This Certification replaces one issued to you on August 8, 2001. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions, if total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. 1. Deed notifications or similar mechanisms shall be placed on all remaining jurisdictional wetlands and waters to notify the state in order to assure compliance for future wetland and/or water impact. These mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is later). 2. A low Flow channel shall be provided with the culvert which must be sunk at least one foot into the stream bed. 3. Upon completion of the project, the applicant shall complete and return the enclosed "Certification of Completion Form" to notify DWQ that all the work included in the 401 Certification has been completed. The responsible party shall complete the attached form and return it to the 401/Wetlands Unit of the Division of Water Quality. We understand that you have chosen to contribute to the Wetland Restoration Program in order to compensate for these impacts to wetlands and/or streams. In accordance with 15A NCAC 213 .0402, this contribution will satisfy our compensatory mitigation requirements under 15A NCAC 2H 0506(h). According to 15A NCAC 2H .0506(h),197 feet of stream mitigation will be required. Until the Wetland Restoration Program receives and clears your check (made payable to: DENR - Wetland Restoration Program), wetland or stream fill shall not occur. Mr. Ron Ferrell should be contacted at 919-733-5083 ext. 358 if you have any questions concerning the Wetland Restoration Program. You have one month from the date of this Certification to make this payment. For accounting purposes, this Certification authorizes the fill of 197 feet of streams, in 030838 river and subbasin and 197 linear feet of stream restoration are required. Please be aware that the Wetland Restoration Program (WRP) rules require rounding of acreage amounts to one-quarter acre increments (15A 2R.0503(b)). If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. In the aforementioned letter the Div. of Water Quality states that the culvert construction can proceed with four additional conditions. Condition number 3 says "Lots 66 and 36 (and their adjoining lots if necessary must be reconfigured to be buildable without stream fill." Two maps were sent with the application. The environmental consultant who conducted a natural systems assessment for stream and wetland conditions used an old sketch plan dated 11-22-99 as a base map to draw upon. More up-to-date plans were available when the study was performed. It is unfortunate that current plans were not requested. The consultant drew the jurisdictional streams on the old sketch plan. The second map sent was a Preliminary Plan for the lot layout as of the date the application was submitted. The lots shown are different on the two maps. Lot 66 shown on the old sketch plan is drawn with an intermittent stream bisecting the lot. The Preliminary Plan layout shows two lots 75 and 76 with the drainage channel running between and across the edges of both lots. No fill will be required for residential driveways to these two lots. Each lot will be capable of having a driveway at road grade. Lot 36 is lot already platted in Stratford on Providence Phase 1. No crossing of a stream was necessary in Phase 1. The roadway stopped at the property line between Phase 1 and 2 before crossing the stream. Phase 2 is under separate ownership from Phase 1. Lot 36 consists of a hilltop bordered on the north and east by two un-named creeks. Lot 36 also has a 20 foot high bluff abruptly sloping to the creek channels and creek valley. The lot must be accessed from the road at the top of the hill, as the only buildable portion of the lot is on the hill. Just north of lot 36 there is a confluence of 2 smaller streams into the creek, which our road must cross. A major roadway for Union County is planned to cross over this stream confluence at an undetermined date. Local planners refer it to as the Rea Road Extension. NCDOT has no plans for it at this time. A record plat of Lot 36 is enclosed. The road crossing was not designed when this plat was recorded. A revised record plat will show a Flood Protection Elevation and 100 year flood easement based on the roadway culvert and roadway fill required for Phase 2. There will be no fill required for driveway access to Lot 36 as the house must be on the hill. I spoke with you on the telephone about this Aug. 20"' 2001. You suggested that I write this letter to explain why Lots 36 and 66 would not result in driveway fill in the stream areas. You said you would • Page 2 August 20, 2001 amend the "Approval of 401 Water Quality Certification and Additional Conditions, WRP" to reflect this information. This letter summarizes our findings concerning environmental features and general permit issues associated with development of the site. Physical Features The approximately 80-acre site is located approximately 1 mile south of the Town of Weddington on Providence Road (NC Highway 16) between Weddington Road (NC 84) and New Town Road (SR 1315) in Union County, North Carolina. The site is bordered by existing or proposed residential subdivisions to the west, a stream named Mundy's Run to the east, agricultural land to the north, and forested land to the south. The landscape is characterized by stream bottonlland along the southern, eastern, and western property boundaries, with gradual slopes rising to the northern and central portions of the site. Elevations range from a high of 650 feet along a ridge in the northeastern portion of the site to a low of 570 feet in the southern portion of the site. The entire site supports a contiguous stand of pine and mixed hardwood forest. EcoScience Cotporalion Mr. Randy Allen April 5, 2001 Page 2 The side slopes of the site interior are dissected by five southward flowing drainage depressions. Four of the drainageways are considered to be waters of the U.S. under jurisdiction of the Army Corps of Engineers (COE). The remaining drainage is ephemeral, meaning it typically holds surface water less than 90 total days within one year. Final jurisdictional status of these streams will be determined by a COE representative (Mr. Steve Chapin of the Asheville COE field office). Mr. Chapin will not be contacted until you notify us of intent to proceed with site development. According to the Union County soil survey, the upland areas and side slope drainages of the site are mapped as Cecil gravelly sandy clay loam, while areas of the site within the Mundy's Run floodplain are mapped as Tatum gravelly silt loam. Tile Cecil series consists of gently sloping, well drained, moderately permeable soils located on ridges that are dissected by intermittent drainage ways. The National Resources Conservation Service considers the Cecil series to be non-hydric in Union County. The Tatum series consists of well drained, moderately permeable soils located on ridges and side slopes. The National Resources Conservation Service considers the Tatum series to be rion- hydric in Union County. Biological Features The site is entirely wooded by a plant community intermediate between mesic bottomland forest and upland oak-hickory forest. Stand age is approximately 50 years. Tile forest overstory includes American beech (Fagus grandifolia), willow oak (Quercus phellos), white oak (Quercus alba), tulip poplar (Liriodendron tulipifera), sweetgum (Liguidambar slyraciflua), shortleaf pine (Pinus echinata), loblolly pine (Pinus laeda), elm (Ulmus sp.), and hickory (Carya sp.). The understory includes eastern red cedar (Juniperus virginiana), flowering dogwood (Corn tisflorida), American holly (Ilex opaca), red maple (Ater rubrum), white oak, and hickory. The herbaceous layer is sparse and consists of Japanese honeysuckle (Lonicera japonica), Christmas fern (Polystichum acrostichoides), blackberry (Rebus sp.), microstegium (Microstegium viminium), giant cane (Arundinaria gigantea), wild ginger (Hexaslylis sp.), and muscadine grape (Vilis rotund folia). The site is expected to be valuable to wildlife because it comprises a moderately large area of contiguous woodland, provides wildlife food, water, and cover, and lacks extensive development in neighboring areas. One mammal species, eastern gray squirrel (Sciurus carolinensis), and signs of white tailed deer (Odocoileus virginianus) and raccoon (Procyon lolor), were observed during the recent visit. Bird observations include downy woodpecker (Pico ides pubescens), northern cardinal EcoScience Corporation Mr. Randy Allen April 5, 2001 Page 3 (Cardinalis cardinalis), Carolina chickadee (Poecile carolinensis), Carolina wren (Thryothorus ludovicianus), dark-eyed junco (Junco hyemalis), eastern phoebe (Sayornis phoebe), bluejay (Cyanocitta cristata), and golden-crowned kinglet (Regulus satrapa). Amphibians observed were spotted salamander (Ambysioma maculatum) and southeastern chorus frog (Pseudacris feriarum). No reptiles were observed. Federally protected species listed for Union County are Schweinitz's sunflower (Helianthus schweinitzii) and Carolina heelsplitter (Lasmigona (lecorata). Schweinitz's sunflower typically occurs on upland, interstream flats in open areas protected from shade or excessive competition. Disturbances such as fire maintenance or regular mowing help sustain preferred habitat. According to N.C. Natural Heritage Program (NHP) records (as of March 8, 2001), the nearest documented occurrence of Schweinitz's sunflower is 1.7 miles west of the site. However, habitat for Schweinitz's sunflower does not occur within the study site, so the proposed project should not be expected to result in any adverse impact to this species. The Carolina heelsplitter (a freshwater mussel) occurs in small to large streams and rivers characterized by mud, muddy sand, and muddy gravel substrate along stable, well-shaded stream banks. In Union County, this species is presently known to survive in the Pee-Dee and Catawba River systems. The nearest surviving population of this species occurs in a section of the Waxhaw Creek sub-basin of the Catawba River system, approximately 9 miles south of the study site. Although the heelsplitter is not known to occur in this sub-basin, Mundy's Run and Unnamed Tributary #1 to Mundy's Run (see attached mapping) provide suitable habitat for the Carolina heelsplitter. The U.S. Fish and Wildlife Service (FWS) may request a protected species survey of the site before a federal permit will be issued for impacts to site streams. No other federally protected species or unique or rare natural areas occur within 1.0 mile of the study site. Jurisdictional Area Delineation Jurisdictional streams have been delineated with sequentially numbered, solid orange and solid blue flagging. See attached mapping for jurisdictional area locations and selected flag numbers. Streams on the attached mapping have been labeled Mundy's Run and Unnamed Tributaries to Mundy's Run numbers 1 through 3. COE Routine Onsite Wetland Delineation data forms and DWQ stream forms were completed for delineated streams to justify jurisdictional calls. There are no jurisdictional, vegetated wetlands on the site. EcoScience Corporation Mr. Randy Allen April 5, 2001 Page 4 USGS topographic mapping (Mathews, NC and Weddington, NC-SC quadrangle) indicates two streams within the property boundary, Mundy's Run and Unnamed Tributary #I to Mundy's Run. Field surveys conclude that site jurisdictional areas include these two streams as well as two additional streams (Unnamed Tributary #2 and Unnamed Tributary #3) that are not shown on topographic mapping (see attached mapping). Unnamed Tributary #2 drains upland areas throughout the middle portion of the property and empties into Unnamed Tributary #I outside the site boundary. Unnamed Tributary #2 is formed by two intermittent drainages (CA and CB flag lines). Unnamed Tributary #3 (WA flag line) drains in a southeast direction across the northeastern corner of the site and merges with Mundy's Run outside of the site boundary. Permitting if you are planning to apply for only one stream crossing, as I believe is the case, your stream permit issues will be with the U.S. Army Corps of Engineers (COE) and the N.C. Division of Water Quality (DWQ). If the amount of stream impacted by the crossing is less than 0.33 acre in area and less than 200 linear feet in length, the crossing can be permitted under COE NWP #14. The COE will not need to be notified for use of this permit so long as 1) no vegetated wetlands are impacted, 2) less than 0.1 acre and 200 linear feet of stream are impacted, and 3) the proposed project is "separate and complete" from any other development that accrued jurisdictional area impacts (such as Stratford on Providence, Phase I) - this fact needs to be clear. No mitigation for impacts is required by the COE if no notification is required. However, the COE permit is not valid until the DWQ has issued a Section 401 Water Quality Certification for the project. The DWQ will require 1) a completed application and 2) a $200.00 fee. Work on the proposed project may not begin until you have received formal, written acceptance of the application by DWQ. Based on the nature of the proposed impacts, DWQ may or may not require mitigation. Although not required, I recommend that you also provide a copy of the jurisdictional area delineation (this does not need to have been surveyed) and a plan view of the stream crossing (this plan view can be conceptual). Summary • The site is located in a rapidly suburbanizing area of western Union County. Development pressures are likely to continue in the area. In accordance with 15A NCAC 2H .0506, a thorough inspection of the site has been conducted by staff of the DWQ Mooresville Regional Office. Based on this review, we have determined that significant uses would be removed or degraded by this project. Since you propose to impact greater than 150 linear feet of perennial streams, compensatory stream mitigation will be required in accordance with 15A NCAC 2H .0506(h). You have the following options for satisfying the mitigation requirements associated with this project: 1. Payment into the North Carolina Wetland Restoration Program, if the WRP will accept the responsibility for conducting this mitigation work, or 2. Preparing and implementing a stream mitigation plan.
