Stevens Division of Water Quality May 3, 2001 DWQ# 01-0612 Craven County McKim & Creed 2625 Dillard Drive, Ste 117 Cary, NC 27511 APPROVAL of 401 Water Quality Certification and Neuse River Buffer Rules with Additional Condition Dear Mr. Sirs: You have our approval, in accordance with the attached conditions, to place temporary fill in waters to construct a waterline at Tucker Creek in Craven County, as described in your application received by the Division of Water Quality on April 4, 2001. After reviewing your application, we have decided that this work is covered by General Water Quality Certification Number 3289, which can be downloaded from our web site at http://h2o.enr.state.nc.us/ncwetlands. This Certification allows to use Nationwide Permit Number 14 when the Corps of Engineers issues it. This approval is also valid for the Neuse River Buffer Rules (15A NCAC 213 .0233). In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge, State Stormwater and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification and the additional condition listed below: 1. An additional condition is that stormwater shall be directed to diffuse flow at non-erosive velocities through the protected stream buffers. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. The project consists of 47,000 linear feet of new 4", 6", 8", and 12" PVC water line within the NCDOT rights-of-way along US Highway 70 in Craven County, two new 16" HDPE directional drill waterway crossings, three pre-engineered package booster pump stations and electrical and telephone telemetry improvements. The two proposed creek crossings to be directional drilled are both located wholly within the N.C. Department of Transportation right-of-way at Tucker Creek and Sandy Run on US Highway 70. Tucker Creek is considered Public Trust Waters and requires a CAMA general permit. We have contacted and received response from the adjacent landowners to Tucker Creek and submitted our request for the CAMA general permit on March 15, 2001. Scott Jones with CAMA inspected the Sandy Run crossing the week of March 19-23, and informed us that the crossing is not considered navigable and therefore is not in CAMA's jurisdiction and will not require CAMA permitting. In addition to the two creek crossings, we have identified five additional drainage swales that will require perpendicular waterline crossings at a point below the US Highway 70 culvert outlet near the base of the highway embankment. We met with Debra Sawyer from the DWQ Washington, NC Regional office at the project site on March 21, 2001 to determine permitting requirements for these five proposed drainage crossings. Per Ms. Sawyer's guidance, all five crossings would be considered non-electric utility waterway crossings and are therefore exempt under the NC Department of Water Quality Administrative Code (T15A: 02B.0200). It is our understanding that these crossings will therefore not require certification or mitigation, since they will be perpendicular to the channels and less than 40 linear feet in length (with a 10 foot maintenance corridor). However, per the 401 Water Quality Certification we are submitting pertinent drawings and design details of the crossings for your review and concurrence. 0)_061? Based on the information provided, we have determined the submitted plan for the installation of 45,500-+ feet of pipe along US 70 from SR 1131 to SR 1746 and along SR 1176 and SR 1182, if properly implemented, will meet the minimum requirements of the Act. We, therefore, issue this LETTER OF APPROVAL WITH the following MODIFICATION. In the event of a conflict between the requirements of the Sedimentation Pollution Control Act, the NCDOT encroachment agreement and the contract specifications, the more restrictive-requirement shall prevail. In 1973, the Sedimentation Pollution Control Act (copy available upon request) was enacted. It established a performance oriented program requiring a project owner or developer to protect adjoining natural resources and properties, both during and after construction, from the effects of accelerated erosion. This approval and the financial responsibility/liability cited in it does not automatically transfer with a change in project ownership. Be advised that to ensure compliance with the approved plan and the program requirements, unannounced periodic inspections will be made. If it is determined that the implemented plan is inadequate, this office may require the installation of additional measures and/or that the plan be revised to comply with state law. (Note: Revisions to the scope of this project without prior approval of the plan showing the changes can be considered a violation). Failure to comply with any part of the approved plan or with any requirements of this program could result in the taking of appropriate legal action against the financially responsible party (Board of Directors, Craven County Water and Sewer Districts). One option is the assessing of a civil penalty of up to $5000 for the initial violation plus up to $5000 per day for each day the site is out of compliance. In recognizing the desirability of early coordination of sedimentation control, we believe it would be beneficial for you and your contractor to arrange a preconstruction conference to discuss the requirements of the approved erosion and sedimentation control plan It would be appreciated ifyou would contact this office to advise Mr. Bill Crew (252-946-6481, ext. 374) of the construction start-up date, contractor and on-site contact person or, please, complete and return the attached Project Information Sheet to the above named. Acceptance and approval of this plan is conditioned upon your compliance with Federal and State water quality laws, regulations and rules. In addition, the land disturbing activity described in this plan may also require. approval or permitting from other agencies - Federal, State or local. These could include the U.S. Army Corps of Engineers under Article 4.0.4. jurisdiction, the Division of Water Quality - Surface Water Section under stormwater regulations (contact Mr. Bill Moore, 252- 946-6481, ext. 264), county, city or town agencies under other local ordinances, or other.approvals that may be required. This approval does not supersede other approval or permit. Please be advised that a temporary rule to protect and maintain existing buffers along watercourses in the Neuse River Basin became effective on July 22, 1997. The Neuse River Riparian Area. Protection and Maintenance Rule (15ANCAC 2B.0233) applies to all perennial and intermittent streams, lakes, ponds and estuaries in the Neuse River basin. In riparian areas in the first 30 feet directly adjacent to the stream and/or coastal wetland vegetation, the rule prohibits land disturbance, new development and fertilizer use. Clearing, seeding and a one-time fertilizer use to establish the grass is allowed.
