VAN DER VAART Secr,mn, TRACY DAVIS May 17, 2016 1)"Cl" Subject: Rescission of No Exposure Permit #NCGNE1090 — UST Warehouse, 141 Duke Street, Forest City, NC ❑ Rescission request denied. Reason: request approved, effective immediatelv. Permit coverage rescinded on the fnllowina hack- ❑ You reported that you have ceased all regulated activity and sold the facility. ❑ You reported that although you retain ownership or control of the facility, you have ceased all regulated qctivity, and there are no materials remainin on site that may resent a risk of stormwater pollution. You reported that continued permit coverage is not required because the site activities are not regulated bv the NPDES stormwater permitting program. ❑ Note other basis: EMLR Regional Office (RO) inspection and concurrence ❑ No RO inspection. We are relying on your representation that a permit is no longer required. Discharging regulated industrial stormwater, discharging wastewater, or operating a treatment facility without a valid NPDES permit will subject the responsible party to a civil penalty of up to $25,000 per day. The Division may pursue enforcement action on persons that have voluntarily relinquished permit coverage when continuing permit coverage was necessary. If in the future you wish to again discharge to the State's surface waters, you must first apply for and receive new coverage under an NPDES permit. If you have questions about our determinations above, please contact the DEMLR Regional Office (copied below), or Lau,,a in the Raleigh Central Office at (919) 807-6368. Sincerely, II for Tracy E. I was able to get to these facilities on 1/26/2016 and here's what I found/recommend: NCGNE1091— Westrock Converting Company —This is only a warehouse for storage of packaged materials. No process or production. NCGNE1089 — Westrock Converting Company —This is only a warehouse for storage of packaged materials. No process or production. NCGNE1090 — Westrock Converting Company —This is only a warehouse for storage of packaged materials. No process or production. I believe the above mentioned permits should be rescinded. I also conducted an inspection of the main Westrock facility. There is a new Env. Mgr. and he's trying to get up to speed. Here's what I found and have questions on: 1. Their current permit appears to still be in the name of Rock Tenn In -Store Solutions, Inc. (COC NCG180003). Was there a request for a name change? If not, can you guide him on this process? 2. He does not find their permit on site (only the cover letter). Can you send this to him? 3. 1 have nothing in our paper or electronic files for a facility in this name or with this CDC and I don't know why it would even be a Textile COC. Can you help me with this? 4. There are currently 3 outfalls per their SWPPP (which is pretty complete). But I think only two are representative of the facility. - 5. The facility is very clean with very little minor production, but without more information I don't know what else to say about the facility. 6. The current contact is: Alan Hooper at 828-248-4921. Please advise me on what to do next with this! He would like to know what he's supposed to be doing. Thanks! (A0A NCDENR Errvnoxr+exr .xo Nmmu AE]dJCES Division of Energy, Mineral and Land Resources Land Quality Section National Pollutant Discharge Elimination System NO EXPOSURE CERTIFICATION for Exclusion NCGNE0000 I'OR AGENCY USE ONLY Dale Receired Yea, Momh Day Cenilienle of Cuveragc NICIGINIE1110 National Pollutant Discharge Elimination System application for exclusion from a Stormwater Permit based on NO EXPOSURE: Submission of this No Exposure Certification constitutes notification that your facility does not require a permit for stormwater discharges associated with industrial activity in the State of North Carolina because it qualifies for a no exposure exclusion. A condition of no exposure at an industrial facility means all industrial materials and activities are protected by a storm resistant shelter (with some exceptions) to prevent exposure to rain, snow, snowmelt, and/or runoff. For permitted facilities in North Carolina, DEMLR must approve your application for No Exposure Certification before this exclusion is effective. Until you are issued a No Exposure Certification and your NPDES permit is rescinded, your facility must continue to abide by the terms and conditions of the current permit. Industrial materials or activities include, but are not limited to: material handling equipment or activities, industrial machinery, raw materials, intermediate products, by-products, final products, or waste products. Material handling activities include the storage, loading and unloading, transportation, or conveyance of any raw material, intermediate product, final product or waste product. A storm resistant shelter is not required for the following industrial materials and activities: drums, barrels, tanks, and similar containers that are tightly sealed, provided those containers are not deteriorated and do not leak. "Sealed" means banded or otherwise secured and with locked or non -operational taps or valves; adequately maintained vehicles used in material handling; and final products, other than products that would be mobilized in stormwater discharges (e.g., rock salt). A No Exposure Certification must be provided for each facility qualifying for the no exposure exclusion. In addition, the exclusion from NPDES permitting is available on a facility -wide basis only —not for individual outfalls. If any industrial activities or materials are, or will be, exposed to precipitation, the facility is not eligible for the no exposure exclusion. By signing and submitting this No Exposure Certification form, you certify that a condition of no exposure exists at this facility or site and are obligated to comply with the terms and conditions of 40 CFR 122.26(g). If approved, your conditional no -exposure exclusion must be self re -certified at least annually. Please see information here: For questions, please contact the DEMLR Regional Office for your area.
