Changing to corrugated metal pipe (CMP) in lieu of reinforced concrete pipe (RCP) reduced the velocity at the end of the culvert. However, the velocity was still to high for the Land Quality Section to approve the elimination of the rip rap velocity dissipation pad. We were able to reduce the length of the pad from 28 feet to 26 feet and significantly reduce the size of the rip rap from 20" average diameter to 6". With the smaller size rip rap, the area should return to a more natural look much faster. The enclosed revised Figure 2 and the revised Culvert Outlet Protection Detail reflect the design changes. Box 256 Gibson, NC, 28343-0256 APPROVAL of 401 Water Quality Certification Dear Mayor Pearson: You have our approval, in accordance with the attached conditions, to fill in 0.046 acre of wetlands and 50 linear feet of streams in order to construct an access road and irrigation force main in Scotland County, as described in your application received by the Division of Water Quality on March 14, 2001. After reviewing your application, we have determined that this fill is covered by General Water Quality Certification Numbers 3288 and 3289. This Certification allows you to use Nationwide Permit Numbers 12 and 14 when issued by the U.S. Army Corps of Engineers. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. The road crossing and force main have been realigned to cross at 90 degr ees in the most narrow part of the drain. This stream is intermittent at best and fed by a seasonal "sa g" at the head of the drain. Access to this part of the spray field is not available due to pro ey lin es on one side and larger wetland areas downstream of the proposed crossing. Storm water man agement is not an issue since there is very little impervious area involved. F Additional Information - Application for Department of the Army Permit - 33 CFR 325 Town of Gibson Wastewater Treatment Facilities Improvements Block 18 - Nature of Activity The overall project is to expand the capacity of the wastewater treatment facilities of the Town of Gibson. The existing plant consists of a treatment and storage lagoon and a land application field for the effluent. The expansion consists of the construction of a second treatment lagoon and a second land application field. A 40.5 acre site immediately east of the existing site will be acquired for the second land application field. A tributary of Joe's Creek separates the existing and proposed land application fields. This permit application is for the crossing of the tributary with a 6" irrigation force main and a gravel access road. The force main and the road will both cross the stream at the same location. The force main will be installed first and will cross the stream approximately two feet below the stream flow line. The culverts will be placed in the stream above the pipe crossing. The length of the dual culverts will be 65 feet including flared end sections at each end. Some 28 linear feet of rip rap will be placed in the stream at the downstream end of the culverts for velocity dissipation. An excavator will be used for placement of the force main and the culverts. Fill over the culverts will be placed with an excavator and/or a bulldozer. Fill material will come from the construction of the second treatment lagoon. Block 19 - Proposed Project Purpose The purpose for the project is to provide additional wastewater treatment capacity for the Town of Gibson. Due to lack of this capacity, the Town has been under a moratorium on additional sewer connections for five years, stifling growth in the Town. The stream crossing is required to access the additional land needed for the project expansion. Work will begin in the summer of 2001 and be completed by spring of 2002. The site is east of NC Highway 381, just north of its intersection with NC Highway 79. Figure 1 shows the location of the site on a USGS topographic quadrangle. EXECUTIVE SUMMARY We have determined that wetlands and jurisdictional waters (i.e., streams, ponds, or lakes) exist on the site. The accompanying wetland sketch map depicts the approximate location of wetlands and jurisdictional waters identified on the site. Please refer this map and the results and recommendations section below for more detailed information. SCOPE OF WORK The detailed wetland delineation consisted of pedestrian reconnaissance of the property to examine the soils, vegetation, and hydrology for the presence of areas that meet the criteria for jurisdictional wetlands by the procedures described in the Corps of Engineers Wetlands Delineation Manual (January 1987 - Final Report). Proof of wetland hydrology would be the existence of hydric soils with oxidized root channels in the upper 12 inches of the "A' horizon, mucky modified surface texture, water borne deposits, drift lines, scour marks, drainage patterns, regional indicators of soil saturation, etc. Surface waters such as intermittent and perennial stream channels, ponds, and lakes, which are also subject to regulation by the US Army Corps of Engineers (USACE) as waters of the US, were also identified. These surface waters may also be referred to as jurisdictional waters to indicate that they are within the jurisdiction of the USACE. It is important to note that wetlands are also classified as waters of the US and regulated by the USACE. RESULTS & RECOMMENDATIONS The results of the detailed jurisdictional waters and wetland delineation are discussed below. Wetlands and Jurisdictional Waters: We have determined that wetlands and jurisdictional waters (i.e., streams, ponds, or lakes) exist on the site. The wetland sketch map depicts the approximate location of wetlands and jurisdictional waters identified on the site. Onsite jurisdictional waters of the U. S. consist of the stream feature flagged with the 100 to 106 flag series. Onsite jurisdictional wetlands consist of riparian areas adjacent to the stream, which were flagged with the 01-033 flag series. No other wetlands or jurisdictional waters were found within the project boundaries. All S&EC flags comprising the wetland and jurisdictional waters delineation should be surveyed and a Wetland Delineation Map generated for use in USACE approval and permitting. The Wetland Delineation Map should include all of the information listed on the attached `Requirements for Wetland Delineation Maps'. S&EC delineation flag numbers should be shown on the wetland survey. Please have the property owner complete the attached agent authorization form if you would like S&EC to act on their behalf for requesting approval of the wetland delineation. This form will also be used in preparing a permit application for impacts to wetlands or surface waters when we are provided with a plan showing the proposed impacts. S&EC cannot conduct correspondence with the USACE unless we have agent authorization (see attached Agent Authorization). This authorization form must be filled out in its entirety by the current landowner and sent to S&EC (a faxed copy is acceptable). REGULATIONS Regulations that apply to jurisdictional wetlands and waters present on the site are discussed below. Wetland Permittin Wetland impact permits are issued on a per-project basis as determined by the USACE. The USACE has determined that impacts on parcels sub-divided from larger tracts are sometimes considered to be cumulative to existing impacts for the large tract. If this is the case, then thresholds as discussed below may not apply and impacts to wetlands must be considered in light of existing permits. Preconstruction notification to the USACE is not required for impacts less than 1/10 acre. Preconstruction notification and approval by the USACE is required for wetland impacts that/exceed 1/10 of an acre and /or anv stream channel impacts. If development impacts are greater than 1/3 acre of wetlands or 150 linear feet of stream and impervious area is 30% or more, then stormwater treatment to meet the pollutant removal design standard of 85% removal of total suspended solids (i.e., wet detention basins, stormwater wetlands, sand filters, bioretention areas, etc.) will likely be required by the NC-DWQ. The maximum permanent impact allowed per project under the nationwide permits is 1/2 acre of wetland or waters of the US Nationwide 39 has a maximum stream impact threshold of 300 linear feet of USACE important stream channel. Nationwide Permit 39 limits above-grade fills within 100-year floodplains specifically prohibiting above-grade fill within the floodway. Additionally, Nationwide Permit 39 limits stream channelization and relocation to streams with an average annual flow of less than 1cfs. Impacts to vegetated wetlands in excess of 1 acre of wetlands or 150 linear feet of stream channels containing "significant aquatic function" may require mitigation by the NC-DWQ. The USACE may require mitigation for any wetland/jurisdictional waters impacts. Wetland mitigation is a complex process that requires planning and monitoring. S&EC will discuss mitigation issues with you if we believe your project may require mitigation. Impacts to channels containing "significant aquatic function" in excess of the notification thresholds may require mitigation. Channel mitigation is typically intended to replace lost significant aquatic functions and values. Relocating channels is considered to be an adverse impact and typically results in mitigation within the new channel. Therefore, this type of mitigation usually requires that meanders be created within constructed channels. Side-slopes and beds be vegetated; rip-rap is discouraged. A complete NC-DWQ 401 Water Quality Certification application has a maximum 60-day processing period while Individual Permit applications submitted to the USACE have no maximum processing periods. The USACE require that all impacts to wetlands or Waters of the US, less than 1/10 acre, be reported to the USACE within 30 days of the completion of construction. A complete USACE Nationwide Permit application has a 45-day processing period. Nationwide Permits can potentially be utilized if the project is designed to have impacts up to 1/2 acre of jurisdictional wetlands or waters of the US including a maximum of 300 linear feet of important stream channel impact under NWT 39. Impacts over these nationwide thresholds will require an individual permit. Individual Permits require an analysis to determine that the proposed impact is the least environmentally damaging practical alternative, typically require compensatory mitigation, notification to adjacent property owners, and a public notice. All impacts greater than 1/10 acre require justification. .4 ADDITIONAL SERVICES If you choose to have us perform additional work, the following is a listing of additional services: (1) Request that the USACE verify our delineation, and (2) Notification to the USACE regarding impacts to jurisdictional areas and permitting issues, if required.
