The Division is unable to concur with your certification of no exposure. Based on an inspection of your facility performed on June 22, 2012 and on last two 2011 Monitoring Reports received, Washington Regional Office staff found that industrial activities or materials on your site either are exposed, or have the potential to be exposed. The facility was found to be in exceptionally clean shape; however the above mentioned Monitoring Reports show exceedances of benchmark values for Copper, Lead and Zinc. During our inspection we discussed the future course of action. It was suggested to you to continue with the monitoring and efforts to try to locate the source of pollution. Once the source of the pollution is found and measures taken to remedy the problem, at the point when you get first monitoring report without exceedances, you can reapply for a No Exposure Certification. At this time the DWQ cannot grant your requested exemption from permit coverage when industrial activities or materials are exposed or have the potential to be exposed. Regulator Marine currently operates under NPDES General Permit Number NCG19000 for marinas and shipbuilding, which expires September 30, 2014. There have been no changes to our outdoor activities related to our manufacturing of sport fishing boats as you observed during your visit. Regulator Marine is, therefore, requesting for a No Exposure Certification for Exclusion determination by the North Carolina Division of Water Quality. Attached to this letter is the No Exposure Certification for Exclusion application (NCGNE000) for your review. Also attached is a site location figure and supporting outdoor activity figures. Regulator Marine stores miscellaneous boat parts, boat molds, and transfer equipment outside. Some portions of the boat molds may be coated with polyester resin or gel coat from overspray. However, the polyester material has cured prior to outdoor storage and does not breakdown to water exposure. The 55-gallon drums pictured are empty and sealed drums previously containing gel coat material. Any gel coat present in the sealed drums has cured. The drums are stored temporarily prior to vendor retrieval for recycle/reuse. The outside of the drums are free from oil or grease. Not pictured is an enclosed emergency/peak generator, which has a double -walled belly tank for fuel storage. Regulator Marine understands that re -certification for No Exposure is required annually. A No Exposure Certification must be provided for each facility qualifying for the no exposure exclusion. We have recently established a new policy to allow sampling throughout the calendar year. We have not publicly announced this change in policy, but we plan to do so in a newsletter soon. We would like to advise you that you have 12 months after you receive your Certificate of Coverage (CoC) to perform your monitoring. In your case, your CoC was issued June 9, 1995 so you will have until June 9, 1996 to perform your monitoring. However, you are still required to submit any data collected during the calendar year by January 31 of the succeeding year. In your case if you don't perform any monitoring until calendar year 1996, you will have until January 31, 1997 to submit that data to the Division of Environmental Management.
