Certificate of Coverage NCG 170307 Cones Mills Corporation-l-laynes Pit Rutherford County Reference is made to your recent request for rescission of coverage under the subject NPDES General Permit. In your letter received on 9/29/2006, you stated that your plant has closed. In accordance with your request, NPDES General Permit NCG 170307 is rescinded, effective immediately. Operating a treatment facility, discharging wastewater or discharging specific types of stormwater to waters of the State without a valid NPDES permit will subject the responsible party to a civil penalty of up to $25,000 per day. Enforcement action will be certain for persons that have voluntarily relinquished permit coverage when, in fact, continuing permit coverage was necessary. If, in retrospect, you feel the site still requires permit coverage, you should notify this office immediately. Furthermore, if in the future you wish to again discharge to the State's surface waters, you must first apply for and receive a new NPDES permit. If the facility is in the process of being sold, you will be performing a public service if you would inform the new or prospective owners of their potential need for NPDES permit coverage. Please be advised that the Asheville Regional Office will be performing NPDES stormwater inspections sometime in the near future. If this office has not previously inspected your facility, you should be prepared to demonstrate compliance with all terms and conditions included in the permit. Specifically, we will be evaluating the following: your stormwater pollution prevention plan, stormwater outfall locations, qualitative and analytical monitoring data and any other activities required by your permit. Please note that any data reported to the State must be analyzed by a facility that has a North Carolina laboratory certification, either as a fill laboratory or as a facility certified to perform on -site field testing.
