February 24, 2014 Mr. Ken Pickle NCDENR, Stormwater Permitting Unit 1617 Mail Service Center Raleigh, NC 27699-1617 Subject: Boggs Paving, Stafford Street Asphalt Plant, Union County Dear Mr. Pickle: I am writing as a follow-up to our recent meeting concerning the Boggs site on Stafford Street in Monroe, Union County, NC. As you may recall, this site received a Notice of Violation for NPDES Stormwater permitting issues. I appreciate the opportunity to have met with you and discuss the permitting of the site. At our meeting, I expressed that it was my understanding that this site is to be used as an asphalt plant, and the stockpiles " and graded areas were part of that operation. After further investigation, Boggs Paving has confirmed that this site is in use as an asphalt plant. The stockpiles of materials are raw materials to be used in the asphalt production, and the site has been graded for the installation of the asphalt plant equipment. Boggs Paving applied for and received an Air Quality Permit from NCDENR for construction of the plant in 2013, and intends to construct the plant in the very near future. The stockpiles of materials onsite will be used in production of asphalt at this location. It is very common for asphalt plants in North Carolina to stockpile and recycle paving asphalt and roofing shingles. This site is very similar to most other asphalt plants in North Carolina. Therefore, we request that Boggs Paving be allowed to apply for coverage under the NPDES General Permit NCG160 for Asphalt Plants. There is no need for an Individual Permit because all activity at this site is consistent with asphalt plant operation. The processing and recycling of shingles and asphalt pavement is quite common at asphalt plant sites all over North Carolina. I have attached a copy of the approved Air Quality Permit issued by NCDENR in 2013, which includes a detailed list of equipment that will be installed at this site.
