Since the time of the submittal of the application to the US Army Corps of Engineers (USAGE),
it has been decided that the best approach for mitigation for unavoidable wetlands impacts will
be through the NC Ecosystem Enhancement Program's In-Lieu Fee program. Details of this
approach for mitigation are being worked out with Mr. Ronnie Smith of the USAGE.

Carolina Lakes Block T Project
Application for USACE Authorization
Background

The Carolina Lakes "Block T" Project is located at the end of Coachman Way, accessed through
Carolina Lakes off of Buffalo Lakes Road, in Harnett County, NC in the vicinity of the
intersection of HWYs 87 and 24 (see Figure O1 in Appendix). Block T is a proposed new
expansion of the broader existing "Carolina Lakes" development. The last expansion of Carolina
Lakes was in the middle 1990s, and the 1995 4041401 permitting for the work at that time
included the property designated as Block T along with another portion of Carolina Lakes and
the separate "Carolina Hills" development. A copy of the 1995 Department of the Army (DA)
authorization (Action ID No. 199502883) is included in the Appendix, along with other pertinent
correspondence. As things turned out, though the other portion of Carolina Lakes and the
Carolina Hills development were constructed, Block T itself was not developed and that acreage
has remained as mostly natural habitat to the present. The previous property owner, Patten
Corporation, who had obtained the above-referenced 1995 DA authorization, but who did not
develop Block T, has since sold the Block T parcel. The current owner, Carolina Lakes
Development Company, LLC (CLDC), is now seeking to proceed with development of the
parcel, and is planning to develop the property in accordance with the site layout that had been
approved for the 1995 permit. However, because of the time that has passed since the issuance
of that permit, and because there has been a change to the status of nationwide permits, it is
necessary to seek new authorization for the project. The owner has authorized WATER OAK to
assist and serve as agent for the application for 404/401 authorization (see Appendix).
In the course of preliminary review of the project, the USACE has concluded that an Individual
Permit (IP) will be required for jurisdictional wetlands impacts that occur from development of
Block T. This is because these impacts are to be viewed as part of the larger suite of
jurisdictional impacts that have already been part of the general development of Carolina Lakes,
and because those impacts have already exceeded 0.5 acres. While the proposed roadway
impacts for Block T would exceed 0.5 acres, and thereby of themselves necessitate application
for an IP, the current owner had considered dividing the property and modifying the design to
reduce impacts to less than 0.5 acres. However, the USACE stated that even so, any
jurisdictional impacts in the Block T property would require an IP because previous impacts
associated with Carolina Lakes had exceeded 0.5 acres.
Current Status of Block T
WATER OAK investigated the Carolina Lakes Block T property in the fall of 2006. Block T is
142.48 acres of mostly Pine/ Scrub Oak Sandhill community (Schafale and Weakley, 1990).
Dominant species at most of the site are: longleaf pine (Pinus palustris), turkey oak (Quercus
laevis), scrub post oak (Q. margaretta), blackjack oak (Q. marilandica), groundsel bush
(Baccharis halimifolia} and wiregrass (Aristida stricta}. In addition to the above, the lower
profile drainage draws hold a mix of species mare characteristically associated with linear
headwater wetlands of the region. The linear depression wetlands on the site included: red
maple (Ater rubrum), sweet bay (Magnolia virginiana), winterberry (Ilex verticillata), inkberry
(Ilex glabra), sweet pepperbush (Clethra alnifolia), fetter-bush (Lyonia lucida), highbush
blueberry (Vaccinium corymbosum), and giant cane (Arundinaria gigantea). The maples were
young (typically about 3-4 inches diameter breast height; 15-20 feet tall) and the shrubs appeared
predominant. There are no true streams on the site. Representative photos of site conditions are
presented in the Appendix.
As can be seen in the aerial photo (Figure 04 in the Appendix), Block T has already been
modified to some extent by cuts and grading for dirt roadways across the property. Some of
these disturbances are from historic forestry practices, some are from the initial (though never
completed) steps toward development under the 1995 permit, and some are related to maintained
access to the sewage treatment operations adjoining the southeast boundary of the property.
To correctly quantify the extent of jurisdictional impacts associated with development of Block
T, an updated determination of wetland boundaries was necessary. To avoid, if possible, the
significant time and expense required for a new full jurisdictional boundary determination,
verification and survey, WATER OAK proposed to the USAGE a sampling comparison of the
present jurisdictional boundaries with the boundaries that had been verified in 1995. This was
agreed upon, and WATER OAK conducted a field investigation accordingly.
To relate the previous jurisdictional boundary land survey to existing conditions on the property,
WATER OAK utilized mapping data from Harnett County's GIS Department and Maptech
Terrain navigator software to generate reference latitude/longitude coordinates relative to the
1995 boundaries. Using a handheld GPS unit, WATER OAK located in the field the reference
lat/long coordinates to compare present conditions with the 1995 boundaries. WATER OAK
traced along and ran transects across several of the wetland areas on the property and found a
consistent match between current conditions and the jurisdictional boundaries established in
1995. During this investigation, WATER OAK also began identification of where the permitted
impacts to jurisdictional areas had already occurred as a result of the original initial steps toward
development back in the mid 1990s. In a meeting on November 15, 2006, WATER OAK
presented its findings to Mr. Ronnie Smith of the USAGE. To confirm these findings and fully
establish where impacts to jurisdictional areas had already occurred, and where the previously
permitted impacts had not taken place, Mr. Smith went to Block T with Mr. Michael Wolfe of
WATER OAK. Again, using a handheld GPS unit, plus mapping with pre-established lat/long
reference coordinates, field conditions were reviewed and jurisdictional areas confirmed.
Findings and Discussion
In the course of the field investigations it was found that the general jurisdictional boundaries for
the property have not changed. It was also found that 0.333 acres of wetlands had been impacted
under the 1995 permit by initial roadbed preparation for site development. As had been
recognized and approved by the USAGE in the course of authorization No. 199502883, the
original proposed development plan for Block T would have resulted in 3.799 acres of
disturbance to jurisdictional "shrub/small tree" wetlands after efforts had been made to avoid and
minimize impacts. Of those impacts, 1.049 acres were to be permanent impacts due to road
construction for the project, and 2.750 acres were to be impacts associated with sewerline
construction. Half of the width of the sewerline impact was to be temporary construction access,
and was to return to woody growth. The other half of the impact was to be maintained as right-
of-way, but be returned to original grade and maintained as herbaceous wetland. Because CLDC
is proposing to use the same development design for Block T as had been approved under Action
ID No. 194502883, anticipated jurisdictional impacts far road construction for the Block T
project are readily derived by subtracting the area of existing roadbed impacts (0.333 acres) from
the total road impacts that were originally calculated (1.049 acres). Thereby it is seen that the
proposed Block T project will result in 0.716 acres of wetlands impacts due to road construction.
The wetlands impacts total related to sewer construction has not changed, as the design remains
the same and no impacts of this category had previously occurred.
In the process of reviewing the 404/401 authorization requirements and addressing the above-
described field investigations, fresh consideration was given to the original project design and its
acceptability regarding efforts to avoid and minimize impacts. It was determined that there was
no better design for best use of the property that would significantly or substantially reduce the
total area of wetlands impacts. Consequently, CLDC is using the original design and is applying
for authorization to permanently fill 0.716 acres of "shrub/small tree" wetlands for road
construction, and to disturb 2.750 acres of the same type of wetlands habitat for sewer
construction. Following sewer construction, 50% (1.375 acres) of the disturbed sewerline area
will be allowed to regrow as before and the remainder will be maintained as herbaceous wetland
in the sewerline right-of--way. As has been mentioned above, these extents of impacts for the
Block T property have been previously authorized by the USACE under Action ID No.
199502883.
Summary and Conclusions
Carolina Lakes Development Company, LLC is applying for a permit for wetlands impacts that
will be associated with the Carolina Lakes Block T project. Road construction requires
permanent fill of 0.716 acres of "shrub/small tree" wetlands. Sewerline construction would
disturb 2.750 acres of the same type of wetlands habitat; half of that impact area will be
temporary, and half a transition to an herbaceous wetland in the right-of--way. Authorization for
essentially the same extent of impacts to the Block T property for the same project design had
previously been granted in 1495 under DA Action ID No. 199502883. Though other property
wetland areas that had been included with Block T for that permit have been developed, the
Block T property itself was only somewhat prepared with some roadbed grading, but was never
fully constructed. Because o£ 1) the amount of time since the 1995 authorization, and 2) the
changes to the nationwide permits in the interim, and 3) consideration of the extent of
jurisdictional impacts that have already occurred in the contiguous Carolina Lakes development
area -- the USACE has stated that an Individual Permit will be required for this project. CLDC
has prepared this document in support of its application for USACE authorization for the above-
described anticipated wetlands impacts associated with the Carolina Lakes Block T Project.

Dear Mr. Talbot:
Reference our letter of June 12, 1995, verifying Department of the Army
(DA) auY_horization of your impacts to 10.1 acres of wetlands above the
headwaters of Jumpinq Run Creek to f.acl_litate the development of. the Carolina
Lakes and Carolina Woods subdivisions on your property located near Spout
Springs, Harnett County, Nor~h Carolina. Impacts authorized included 5.1 acres
under Nationwide Permit No. 26 and 4.9 acres under Nationwide Permit No. 12.
Although these nationwide permits expired on January 21, 1997, we hereby
verify your activities to be valid ("grandfathered") until January 21, 1998.
This verification is based on our determination that you have made a
significant investment of resources. If your work is not completed before
January 21, 1998, your completion of your proposed activity must be considered
pursuant to a DA individual permit.
Finally, the total amount of wetland impacts on your property authorized
by to Nationwide Permits 12 and ?_6 is now 10.1 acres. Under the provisions of
the new nationwide permits, effective February 11, 1997, any work i.n waters or
wetlands in excess of 3 acres must be authorized by a DA .individual permit.
This applies to the Carolina Hills and Carolina Woods subdivisions, as well as
any future acreage added to the tract. Additionally, compensatory mitigation
must be provided for all further authorized wetland impacts.
Please note that the individual permit requirement also applies to work
in wetlands by private lot owrers. We recommend that you inform all current
and future lot owners of this fact.
