The operation is located at 2242 Sheppard Mill Road in Pitt County, North Carolina. The staff from the Division of Energy, Mineral and Land Resources (DEMLR) of the Washington Regional Office, observed an active mining operation with a couple unpermitted discharge(s) onsite. Accordingly, the inspection and DEMLR file review revealed that your site is in violation'of North Carolina General Statute and North Carolina Administrative Codes. North Carolina General Statute (hereby known as G.S.) 143-215.l(a) (1) requires that no person shall make any outlets into the waters of the State unless that person has received a permit. Permit requirements are outlined in North Carolina Administrative Code 02H .0100 — Point Source Discharges to Surface Waters. Required Response Accordingly, you are directed to respond to this letter in writing within 15 calendar days of receipt of this Notice. Your response should be sent to this office at the letterhead address and include the following: Please explain your efforts to abate the impacts identified above. 2.
