APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS

Dear Mr. Pressley:
You have our approval, in accordance with the attached conditions and those listed
below, to place fill material in 0.05 acres of waters for the purpose of constructing rafting
access areas on the French Bread River at Biltmore Estate as described in your application
dated February 5, 2001. After reviewing your application, we have decided that this fill is
covered by General Water Quality Certification Numbers 3257 and 3290. These
certifications allow you to use Nationwide Permit Number 13 and 36 when the Corps of
Engineers issues it. In addition, you should get any other federal, state or local permits
before you go ahead with your project including (but not limited to) Sediment and Erosion
Control, Coastal Stormwater, Non-Discharge and Water Supply Water shed regulations.
This approval will expire when the accompanying 404 or CAMA permit expires unless
otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your
application except as modified below. If you change your project, you must notify us and you
may be required to send us a new application. If the property is sold, the new owner must be
given a copy of this Certification and approval letter and is thereby responsible for complying
with all conditions. If total wetland fills for this project (now or in the future) exceed one acre,
compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and
(7). For this approval to be valid, you must follow the conditions listed in the attached
certification and any additional conditions listed below.
1. Planting plan must be changed to remove Sericea lespedeza and substitute with native
grasses and herbs. -
If you do not accept any of the conditions of this certification, you may ask for an
adjudicatory hearing. You must act within 60 days of the date that you receive this letter.
To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North
Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447,
Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless
you ask for a hearing. -
This letter completes the review of the Division of Water Quality under Section 401 of
the Clean Water Act. If you have any questions, please telephone John Dorney at 919-733-

1. There are no wetlands involved. It is only stream bank.
2. Stream class was listed as WS-IV-CA. Stream class is C.
3. 1 have discussed project with applicant and consultant. Recommended they change
seeding plan from sencea lespedeza to native type grasses and herbs.
4. 1 have no problem with using rounded river stone. It will be class B type
rip rap size.
Discussed possible movement of rocks during flooding but areas adjacent did not show signs of
erossjve affect of rover. Large trees are located up and downstream of nut On and take out.

Rafting Access Areas on French Broad River
Biltmore Estate
Buncombe County, North Carolina
As you and I have discussed on several occasions, the Biltmore Estate wishes to construct
two (2) river rafting access areas on the French Broad River within the Estate's property. These
handicap accessible areas would be used by guests of the new Inn on Biltmore Estate to begin
and end guided rafting trips on the river.
These areas would be constructed in two (2) stages. First, the area outside the river bank
will be excavated for the ramp and adjoining rafting area to provide a dry working environment.
The ramp will then be constructed, and the adjoining bank stabilization (using native rounded
river stones, plantings, and mulch) will then be completed. Second, the actual river bank will be
excavated to allow the river to flow into the completed access area. These excavated slopes will
be immediately protected using the native stone bank protection, and other areas will have
plantings and mulch ground cover. This two (2) stage process should minimize sedimentation
into the river. Also, the use of the round native stones will provide the necessary bank protection
and stabilization while not poring a hazard to the inflatable rafts and/or passengers.
On behalf of the Biltmore Estate, we are transmitting to you the enclosed submittal for a
Nationwide Permit numbers 13 (Boat Ramps) and 36 (Bank Stabilization) to authorize the
construction of these ramps and related bank stabilization. We understand that a Water Quality
Certification will be required from the North Carolina Division of Water Quality due to the use
of "hard structures" for bank stabilization, and we are hereby sending the Raleigh office a total of
seven (7) copies along with the required $475 fee. Also, due to the historic nature of the Estate, a
copy of this application is being sent to the North Carolina Division of Archives and History.
We are transmitting copies of this application to the United States Fish & Wildlife Service and
the North Carolina Wildlife Resources Commission for review and comment.
