In accordance with your application for a discharge permit received on February 4, 2011,
we are forwarding herewith the subject certificate of coverage to discharge under the subject
state — NPDES general permit. This permit is issued pursuant to the requirements of North
Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina
and the US Environmental Protection Agency dated October 15, 2007 (or as subsequently
amended).
Please take notice that this certificate of coverage is not transferable except after notice to
the Division of Water Quality. The Division of Water Quality may require modification or
revocation and reissuance of the certificate of coverage.
Please be aware that mine dewatering at your site has the potential to impact adjacent
wetlands. The specific requirements for mine dewatering at facilities near wetlands can be found
in Part III, Section E of your permit. You must abide by your Operation and Monitoring Plan
approved by the Division.
Please note that mine dewatering wastewater includes wet pit overflows caused solely
by direct_ rainfall and groundwater seepage for this type of mining operation. Any discharge of
this water (and any stormwater commingled with it) is subject to the effluent limitations in this
permit.
This general permit allows the discharge of'stormwater and certain types of wastewater
from your facility. In your application, you specified that only mine dewatering water would be
discharged from this facility. If separate point -source discharges of stormwater occur (i.e.,
stormwater not combined with mine dewatering water), you will be required to adhere to the
conditions in this permit for stormwater discharges.

This letter is in response to your February 14, 2011 letter to me regarding
additional information needed for the NPDES General Permit NCG020000 application
that you received on February 4, 2011 for the Mountain Tract Mine in Bertie County.

Following is responses to the three items that you requested additional information
1. I have enclosed a revised mine map, an aerial photo map with S' and 2' contour
intervals which identifies the surface waters and wetlands. The aerial photo contour
map submitted with the original application had an incorrect scale. The aerial photo
contour map included in this submittal is correct. In the General Permit Application
I checked that there were no wetlands within 400' of the pit area. That resulted
from measurements taken early on in the permit process. After further
investigations it was determined that the closest wetlands are at 367' from the pit.
This is a small area with the remaining wetlands being 400+ feet from the pit.
2. 1 have enclosed a cross-section of the pit from the Northwest to the Southeast which
of SQrs includes a 100' .by 600' dewatering pond. I have also reduced the maximum depth
-"rA of the pit to 40'.

3. The mine map has been revised to show a, l 007by 600' foot dewatering pond within
the permit boundary along the wetlands closest to the pit area. The pond will be
excavated to a depth of 20 feet with a 3 horizontal to 1 vertical slope to the water
line and 2 horizontal to 1 vertical slope to bottom of excavation along the outside
s;f' ���lope. A f discharge/overflow pipe and a stilling basin with a level spreader (See
details) is proposed for the discharge point of the pond. This will be the area that is
excavated first and the pond will not be dewatered.
I have included two copies of the revisions and additional information. I feel
that the measures proposed to protect the wetlands are adequate. If you have any
questions please give me a call.

The Division of Water Quality's Stornwater Permitting Unit received a National Pollutant Discharge
Elimination System (NPDES) permit application for Mountain Tract Mine on February 4, 2011. The
application stated that an associated application for a mining pen -nit was submitted to the Division of Land
Resources (DLR). Please be aware that the issuance of an NPDES pen -nit is contingent upon the issuance of
an associated mining permit from DLR. Our office will process your storrnwater permit application once a
DLR mining permit has been issued for your project.
Please provide the following additional infonnation:
1. The site plan must clearly identify and label all surface water and wetlands.
2. Existing and proposed elevations of the mine pit and the surface waters/wetlands must be shown.
3. Information must be provided to demonstrate that mine dewatering will not have adverse effects
on the wetlands. See below.
Please also be aware that since your project is located near wetlands, your NPDES permit will require
dewatering operations without wetland impacts. The specific requirements for mine dewaterinu at facilities
near wetlands can be found in the text of the general NPDES mining permit number NCG 020000 available
on our website, http://portal.ncdenr.org/web/wq/ws/su/npdessw. See Part III, Section E of the permit. An
approved Operation and Monitoring Plan is required for NPDES-permitted mining facilities and may be
required prior to permit issuance. Discharging mine dewatering wastewater without Plan approval will be
subject to enforcement action. A Plan for your facility must be submitted to the Washington Regional Office
within 60 days of your receipt of an NPDES pen -nit. We encourage you to contact Thom Edgerton at the
Washington Regional Office at [phone] to address any wetland concerns for your facility in order to
ensure a successful NPDES application review.
Additionally, new coastal storrnwater management rules (SESSION LAW 2008-21-1) were implemented
October 1, 2008. Due to these new rules you may be required to apply for an additional State Stonnwater
Pennit if you are adding impervious area. Please contact Scott Vinson in the Washington Regional Office
at 252-946-64811 to determine if you will be required to submit an application for this additional permit.

The following discharges are covered by NPDES general permit NCG520000 instead of NCG020000:
• Point source discharges of stormwater and wastewater from in -stream sand mining operations (i.e., sand
dredging or dipping operations)
For new mining sites that require an authorization to construct (A TC) wastewater treatment facilities: This
NOI Is also an APPLICATION FOR an ATC for new wastewater treatment facilities. ATC requests must be
submitted at least 90 days prior to construction'.
For existin mining sites that require an Authorization to Operate (A TO) wastewater tr fitment facilities:
This NOI is also an APPLICATION FOR an ATO for wastewater treatment facilities in place.
Construction modification or installation of any new treatment cam onents at an existin site requires an
ATC., (If the site is already covered by NCG020000, the ATC request may be submitted without an NOI).
Some wastewater treatment facilities used to treat or recycle wastewater at mining sites will require an ATC rp for
to construction per 15A NCAC 2H .0138. Please see the NCG020000 General Permit for details about which
treatment facilities require an ATC (summarized in Table 1 below). The authorization to construct or continue
to operate will be issued at the same time as the Certificate of Coverage (COC) for the NCG02 permit. Design of
treatment facilities must comply with requirements of 15A NCAC 2H .0138 & .0139.
Construction of wastewater treatment facilities subject to the ATCIATO requirements in the NCG02 permit
at new or existing mining sites requires submission of three (3) sets of plans and specifications signed

For existin mining sites that require an Authorization to Operate (A TO) wastewater treatment facilities:

Construction, modification, or installation of any new treatment components at an existing site requires an

maps along with their corresponding (approximate) acreage. As a reminder, mining permits can
only be issued for up to 10 years; thus, all mine and reclamation neaps must only denote those

The applicant owns 258 acres at the site where the mine will be located. Mine area is
totally located in an active agriculture field. Mining Operations will start in the
northwest end and progress toward the southeast. There will lie no laud clearing or land
preparation in order to prepare the site for mining.
2. Describe specific erosion control measures to be installed prior to land disturbing activities and during
mining to prevent offsite sedimentation (it)clrrde specrfie plans, for sedinietlt and erosion control for urine

installation and schedule for maintenance of the measures. Locate and label all sechment and erosion

Excavation will start on lower portion of mine area. Any storm water draining toward

use area and withdraws more than 100,000 gallons per day.

A buffer will be required between any mining activity and any mining permit boundary or right-of-
way. It may be an unexcavated buffer (no excavation, but roadways, berms and erosion &
sedimentation control measures may be installed within it), an undisturbed buffer (no disturbance
within the buffer whatsoever), or a combination of the two, depending upon the site conditions. Note
that all buffers must be located within the mining permit boundaries.
How wide a buffer will be maintained between any mining activity and any mining permit boundary or
right-of-way at this site? A minimum buffer of 25 feet is recommended, although a wider buffer may
be needed depending on site conditions. Shorn cell buffer loccwions andwidths on the !nine mop(v).
A 25' unexcavated buffer will be provided between the permit boundary and top of pit
slope. Applicant owns sufficient hand surrounding the permit boundary to prevent any
issues wit>li neighboring properties.
b. A minimum 50 foot wide undisturbed buffer will be required between any land disturbing activities
within the mining permit boundaries and any natural watercourses and wetlands unless smaller
undisturbed buffers can be justified. Depending on site conditions, a buffer wider than 50 feet maybe
needed.

The Mountain Tract Mine is located approximately 6 miles southeast of Windsor in Bertie
County. The Mine Permit area is 15.50 acres which includes the access road of 1.75 acres, mine
excavation area of 11.25, unexcavated buffer area of 2.00 acres, and stockpile area of .5 acres.
The mine will have a depth of 40 feet at surface elevation of +24' MSL (upper end) and a depth
of 36' at surface elevation +20' MSL (lower end). The bottom elevation will be set at -16' MSL.
An intermittent stream is located greater than 400' along the west side of the Mountain Tract
Mine with closest wetlands being 367' from the pit area.
DESCRIPTION AND OPERATION OF THE MOUNTAIN TRACT MINE DEWATERING ACTIVITIES:
Excavation activities will begin along the pit boundary at the lower end of the field near the
woods in the northwest end of the mine where a 600' x 100' x 20' deep (approximately 1.3
acres) dewatering pond will be excavated (see mine map last updated on 3-10-2011). The pond
will be provided with 3 horizontal to 1 vertical slope to the normal water level and 2 horizontal
to 1 vertical from waterline to bottom of pond along the outside slope (see cross section of Pit).
The dewatering pond will be wet mined with no dewatering taking place. A 16" gravity flow
drain pipe will be set with top of pipe at 1.5' below the ground elevation at the edge of the
dewatering pond. A stilling basin with level spreader will be constructed at the discharge end
of the 16" drain pipe (see detail of stilling basin and level spreader). The dewatering pond will
act as a recharge system to any wetlands along the north-northwest area below the pond. The
pond will have a capacity of approximately 600,000 cubic feet of total storage and discharge
from the pond will flow into the wetlands closest to the stilling basin and level spreader. A 30'
wide berm will be left along the inside edge of the dewatering pond. The berm wiil have a
minimum of Z horizontal to 1 vertical slopes. Once the dewatering pond has been excavated,
mining will begin in the area just upslope of the berm in a southeast direction. The water pump
that will be utilized is a 12" pump with a capacity of 1700 gallons/minute on the low side. The
intent is not to exceed 500,000 gallons on any given day which will be approximately 5 hours of
pumping time per day. The pump intake will have a float so the intake will be near the water
surface at all times. Please note that mining will take place when the demand is there for the
material mined. There could be times when weeks or months go by with no mining or
dewatering activities taking place. The water pump will be placed near one of the ends of the
dewatering pond (see attached pump location map) with the pump discharge pipe discharging
near the end of the pond. The depth from ground surface to the normal groundwater table, in
the area of the pond, is approximately 10' which will result in 8' of storage above the normal
ground water table which results in around 300,000 cubic feet of storage above the water
table.Stormwater from the field upslope of the pit will naturally drain into the pit. Any other
storm water runoff will drain from the field the way it has always drained.

Monitoring:
All stormwater and wastewater discharges within the permitted boundary associated with land
disturbing activities shall be monitored, analyzed and reported as required by the NPDE5
General Permit No. NCG020000. The intent of the permit is to minimize potential negative
impacts to water quality.

The mine operator shall keep a copy of all records related to inspections, reports, etc. regarding
stormwater/wastewater and provide these records to the Division of Water Quality as required
by the General Permit. The BMP Controls shall be inspected, at least weekly and within 24
hours following a storm event which produces a discharge. All maintenance of these BMP
measures shall be documented. The maintenance shall include, but is not limited to, good
house keeping, repair of measures, stilling basin clean outs, replacement of sediment filled rip
rap, etc., as necessary to prevent downstream impacts. If sediment enters the wetlands or
other negative impacts are observed, operations shall cease, the Division of Water Quality shall
be notified, and adequate preventative measures shall be promptly implemented in order to
correct the problem, prior to resuming the operation.
