NPDES Stormwater General Permit — NCG020248, provides coverage for the subject quarry. The site drains to Allen's Creek, a Class C-Trout waterbody, located in the French Broad River Basin. VIOLATIONS Stormwater Permit NCG020248 Conditions — The DWQ site visit conducted June 22, 2010 revealed violations of the following stormwater permit conditions: a. Part III. Section A. — Stormwater Pollution Prevention Plan - all stormwater discharge outfalls were not identified as required by the Permit. As DWQ staff indicated, there are 3 additional areas that discharge stormwater (SD03, SD04, SD05). b. Part III. Section B. — Analytical Monitoring — all storm water'outfalIs were not monitoring, as required, c. Part Ill. Section D. — Qualitative Monitoring — all stormwater outfalls were not visually inspected, as required. Part III. Sections B & E. — The discharge shall not cause the turbidity of the receiving waters to exceed Water Quality Standards. Sampling conducted June 16, 2010 in Allen's Creek above and below the mine site indicated a violation of the water quality standard for turbidity. During the site visit, DWQ staff concluded that referenced outfall SDO3 likely contributed to the violation (this outfall was not identified to be analyzed and visually monitored by Harrison personnel). e. Part IL Section B — "In the event that a facility fails to perform satisfactorily, including the creation of nuisance conditions, the permittee shall take immediate corrective action.... " Violation of the water quality standard for turbidity created nuisance conditions, therefore, Harrison must evaluate the need for new treatment facilities. f. Part IV. Section E.B. — The permittee shall report to the central office or the appropriate regional office any noncompliance which may endanger health or the environment. Harrison failed to notify DWQ regarding the turbidity violation. If. Stream Standard Violation — DWQ sampling conducted June 16, 2010 indicated a violation of the turbidity standard of 10 NTU for trout waters [ref. 15A NCAC 02B .0211 3(k)]. The following results were obtained: Upstream - 6.1 NTU (above quarry site -- near Little Cove Road) Upstream - 11 NTU (above culvert receiving SDO3) Downstream - 1000 NTU (below culvert receiving SDO3) Downstream - 310 NTU (below quarry site -- near Fuller Drive) REQUIRED RESPONSE This Office requests that you respond in writing by July 26, 2010. Your response should be sent to the attention of Susan A. Wilson, Division of Water Quality, 2090 US HWY 70, Swannanoa, NC 28778. Your response should address the following items: I. Stormwater Permit NCG0020248 a. Please detail the events that resulted in non-compliance with the above -mentioned NCG020408 permit conditions. b. Please explain how and when you anticipate being in full compliance with the NCG0020248 Permit. c. Division of APAC, Waynesville Quarry NPDES No. NCG020248 Inspection Summary Division of Water Quality staff (Linda Wiggs and Susan A. Wilson) met with Don Mason, Jeff Mathis, Darrell Mathis, "Todd Quigg, and Harold Kelly (Harrison staff) at the site on June 22, 2010. Kristin Flicklin and Shawna Riddle (Division of Land Quality) were also present during the majority of the site visit. The primary reason for the inspection was to evaluate the exterior of the facility, observing the potential stormwater exposure areas, outfalls, and site conditions. DWQ did a general overview of records while on -site. DWQ stated that record keeping should be more thorough and BMP inspections, as well as maintenance activities, should be more specific and documented more thoroughly. DWQ also stated that an onsite person(s) should be trained to sample, inspect, and maintain the BMPs. DWQ highlighted that BMP maintenance activities are of primary importance in attaining compliance with the stormwater permit. Approximately 48 acres of the site is disturbed/exposed (per Don Mason). Currently, Harrison staff has identified two outfall locations. Samples are collected for Outfall 001 (near the northwest corner of the site off New Allen's Cove Road). Per Harrison staff, there had been no discharge from Outfall 002 (east side — Allen's Cove Road), so no samples had been taken (several detention traps in series are prior to Outfall 002). Please note that not sampling or recording "ND" (no discharge) because personnel are not available during discharge event, is not an acceptable practice. Any vehicle maintenance is conducted in an enclosed garage. DWQ observed no potential stormwater issues due to vehicle maintenance. Secondary containment surrounds the fuel storage tanks. DWQ identified other Stormwater Discharge Outfalls (SDOs) that will require monitoring. Three additional outfalls were noted by DWQ and referred to as SD03, SD04 and SD05 (please refer to attached map). As discussed with Harrison personnel, the outfall area along New Allen's Creek Road, upstream of their identified Outfall 001, referred to as SD03 by DWQ, should be monitored for parameters outlined in the general stormwater permit (Mining SW permit). This outfall appears to receive pit water (mine dewater), process water, and stormwater runoff. It is recommended that a thorough evaluation of this entire drainage area take place, including the feasibility of separating mine dewatering, stormwater runoff, and process water from comingling. It likely will be necessary to install engineered stormwater control structures that will sufficiently treat waters to maintain compliance with effluent limits and/or benchmarks. This area is the likely contributor of turbidity during DWQs sampling event on June 16, 2010. It was pointed out during the inspection that monitoring at SD03 should be conducted prior to comingling with the other stormwater contributions from offsite (i.e., prior to mixing with the other culverts). DWQ also identified two additional outfalls, one north of Outfall 002, near Allen's Creek Road and the entrance road, referred to as SD04 by DWQ. This outfall receives stormwater from the mine road area, as well as runoff from an asphalt waste pile. Although this outfall is associated with mining haul road, due to the asphalt waste pile contribution SD04 should be monitored under the guidelines for the Asphalt Plant (stormwater Permit NCG160024), which includes Total Petroleum Hydrocarbons (TPH) monitoring. Due to potential turbidity contributions from the mining haul road, this SD04 should also be monitored for turbidity. The Division is requiring that Harrison monitor for turbidity in conjunction with the analytical monitoring. Another outfall was identified near the asphalt waste piles (across from the asphalt plant), referred to as SD05 by DWQ. This outfall should be monitoring in accordance with the Asphalt Plant (Stormwater Permit NCG160024). Due to time constraints, DWQ was unable to conduct an inspection at the asphalt plant. Please review your Asphalt site again (in light of DWQs inspection of the mining facility) and ensure that all pertinent outfalls are identified and monitored as required. Regarding the turbidity sampling conducted June 16, 2010, during a rain event, turbidity measurements in Allen's Creek were in violation of DWQ's turbidity standard (results of those tests are attached). DWQ is requiring that Harrison conduct monthly monitoring at all five discharge locations identified (and as -listed below in Table 1). Monthly monitoring should continue until such time that this office notifies Harrison otherwise. In addition, monthly instream monitoring for turbidity should be conducted upstream and downstream of the site (in Allen's Creek). DWQ understands there are other contributing sources in the watershed, however, Harrison staff should determine the appropriate downstream monitoring point(s) and consult with DWQ staff. At minimum, sampling should be conducted upstream on Allen's Creek near Little Cove Road and downstream near Fuller Drive. Table 1. The permit process that began early last spring finally resulted in a 13-acre modification and expansion will allow Harrison officials to perform remediation work in what used -to be a buffer zone. Consequently, a new buffer area was also created. Although officials won't actually be mining any additional land, the company's entire mining plan has been reconfigured, shifted slightly to the east, to allow for the cleanup of a massive March rock slide that affected land outside of permit parameters. Under the newly modified permit, the company's permit area was enlarged by 13-acres, to include a total 315.5-acres, of which only 154-acres may be disturbed. The new permit also requires that certain remediation work follow specific recommendations of state regulators. The significance of recently approved modifications is a matter of perspective, said company president, Todd Quigg. "From the perspective of our neighbors, they saw this as a major. change. It's because we were moving closer to the Lickstone Road community, and those folks particularly saw this as major change," said Quigg. "Historically, we go to the limit of the buffer and work back toward ourselves. Moving the buffer back meant we were getting closer to the community and they saw that as major change in what we had done. As for (company officials), this was not our original mining plan. Prior to the slide, we were -going to continue (mining) within the current boundaries already approved for our permit, but due to the slide we had to start from scratch and change our plan. Obviously, we had a lot of outside input from (state geologists and engineers), so this was a big thing for us too." 1 The company's request to have its permit modified to allow for the expansion was met with " resistance from members of the neighboring community and a regional environmental group who voiced a variety of concerns ranging from ground -shaking blasting to truck traffic on narrow residential roads to heavy dust and water woes. Community concerns attracted the attention of two separate agencies within the N.C. Department of Environment and Natural Resources, including regulators within the divisions of land resources and water quality who issued a list of corrective measures Harrison officials would need to take to address cited deficiencies and/or recommended plans that should be followed in the course of remediation work. After a lengthy process that started last spring in which the public became heavily involved, Harrison officials were granted the modified permit earlier this month. In a letter dated Jan. 7, a section chief with the NCDENR notified the company their permit modification, including the expansion, has been approved. The modification also allows for the construction of an access road to allow for the removal of slide debris, expansion of a debris disposal area and a separate pit area and requires that certain work follow the recommendations of state regulators with respect to slope stability and'erosion and sediment control measures. Michael Rogers, head of the West Waynesville Environmental Protection Group, an organization formed to express ongoing concerns about the company's operations and the permit process, said he recently received a letter that the permit was approved, but has not had a chance to look at it closely. Rogers didn't want to provide a detailed comment until he met with the group and fully examined permit specifics. Along the way, community members cited a number of concerning issues they wanted to see addressed. Rogers is awaiting clarification about how those concerns were handled. "I assume they have (addressed noted concerns), we just want to know what kinds of answers were given," he said, adding he was personally contacted by Harrison President, Todd Quigg, regarding a problem with his well. Quigg agreed to put in writing a pledge to drill a new well if the old well runs dry, said Rogers. "That was one issue, so I guess it's been addressed, but I don't know about the other ones," he said: "That's what we're waiting to hear back." Quigg said recently changes specifically addressed concerns noted by state regulators and may or may not have included all of those identified by quarry neighbors. However, community concerns are no less of importance, he said. "We have in fact obviously answered the concerns of DENR, and we are continuing to engage our neighbors in trying to work through their concerns that fell outside of the permit process," 2 f ® 0 Qu,tgg said. "We will work to assure them that in what we are doing we are trying to minimize our impact on them, and we want to be a good neighbor." Quigg said he intends to meet with community members in coming months to further discussions about their concerns. "Now that the permit has been granted, we want to get that group together to make sure their issues and concerns are on our radar screen," he said. "Admittedly we didn't do a good job up front to explain and alleviate their fears and make sure they know what is going on." Mining "is not a sexy industry," said Quigg. But the public's reaction to recent changes came as an eye-opener to unsuspecting company officials, particularly considering how little public feedback was voiced in 2008 when a far more sizeable modification that included a 132-acre acre expansion was applied for and approved. "In 2008, nobody said a word and we kind of got lulled to sleep on this," Quigg said. "When the response (to most recent modifications) was so public, we kind of had to regroup and retrench and figure out an appropriate course of action ...I won't say I'm done. I still have some relationship building and fence mending to make sure that at the end of the day, we're being a good neighbor. We want our neighbors to understand that we bring benefit to the community. We don't want to be a hindrance. But we've got to earn their respect and can't just take for granted that they understand the positive benefits we bring and what we're doing." The March slide and ensuing remediation process caught company officials off guard on several different levels, he continued. But good things are coming out of the experience — changes that will make the company and its relationship with the community better. "Obviously, we have changed some of our mining practices because of it," said Quigg. "And we thought prior to our permit modification request that we had tried to reach out to the community and historically we thought we were a good neighbor. This process showed us that we can do more to be more proactive and get better information out about the work we are doing. If we've learned one lesson it's that we've got to do better job about getting information and facts out and partnering with the community.... So, this been hard thing to live and learn through, but I'd like to think we're a better neighbor for having been through it." Monitoring results conducted to date were in compliance with permit benchmark values (and instream values were below water quality standards). The site had been significantly reconfigured to reduce turbidity and other water quality impacts since the previous site visit in June 2010. The mine pit water has been completely piped and separated from any other impacts (no turbidity impacts were noted during the site inspection). No monitoring will be required from this outfall at this time. SDO1 is now a series of 4 basins designed to contain a 25 year, 24 hour event (and not expected to discharge). A similar arrangement is planned for SD02 (and this outfall currently only discharges when planned). SD04 and SDO5 have been eliminated (DWQ observed the topographical modification and concurs with the request to eliminate these previously designated outfalls). Harrison added basins (and skimmer) for SDO6 (near the entrance) and will monitor/inspect this outfall (monitor, should a discharge occur). The site appeared to be much improved (from a water quality perspective) since the June inspection, and Harrison has done a considerable amount of work to try and eliminate any adverse water quality impacts from the site. Hydroseeding was being conducted at various areas during the site visit (to further stabilize the site). Upstream and downstream from the site appeared clear with no turbidity problems noted (at Allen's Creek and the side stream along Allen's Creek Road). The follow-up site visit was conducted after a rain event the previous day. Waynesville Quarry R=TMlA11; . L As requested in the July 8, 2010 letter from Roger C. Edwards to Don Mason, following is Harrison Construction Company Division of APAC Atlantic, Inc.'s ("Harrison") response. In an effort to correct some misperceptions that seem to be present in the July 8, 2010 letter, Harrison is providing a map showing the actual location of the quarry pit as well as purported and anticipated discharge points. Purported outfalls SD04 and SD05 have never been intended to be actual outfalls and Harrison does not believe there has ever been a discharge from S1005 although it understands that a well meaning employee may have dug a hole at SD04 recently that resulted in a discharge. The topography at both of these points is being changed, including the removal of an access road, to prevent any future discharge at these locations. Revised mine maps are being submitted which will show the removal of these outfalls. To prevent future employee assistance of this nature, on site management and operational personnel are being given training regarding the plan and the importance of not changing the topography. The proper sampling location for SD03 is shown on the attached map. In past DWQ inspections, this location was not considered to be of concern due to the pristine nature of water. In order to preserve the water quality and prevent any commingling, it is now being piped from the mine pit to the discharge point. Monitoring results from this discharge are enclosed and show a level of 2.4 NTU. Also shown on the map is a new potential discharge location, SD06. There has not been a discharge from this location to date; however, it is a potential future discharge point and is being added to the revised maps being submitted. Also included in the revised maps are several new ponds. These ponds are expected to prevent any future discharge from SD01 and further minimize any discharges from SD02 and S006. Ponds in place for SD06 and planned for SD02 will allow discharges only when planned and after on -site turbidity sampling to ensure compliance with permit limits. Collected stormwater is recycled for dust control purposes and assists in the goal of making the quarry a zero discharge facility. Any discharges from the outfalls shall be inspected and monitored on a monthly basis until DWQ directs otherwise. These modifications, submittals, and actions will bring the facility into compliance. With regard to turbidity, the letter notes that the standard is that the mine shall not "cause" the turbidity of the receiving waters to exceed Water Quality Standards. Although this is the standard, Harrison is purportedly being issued a NOV for having "contributed" to the violation. The data, taken without context, would seem to indicate that Harrison has caused the violation but that is only because there is not context given. It is Harrison's understanding that the sampling data relied upon by DWQ in issuing the NOV was taken by a member of the Aquifer Protection Section rather than a DWQ inspector familiar with the sources and permits applicable to the area. The sampler did not actually enter Harrison property, to the best of our knowledge, and therefore could not take a representative sample of the actual discharge. Our understanding, based on the map included with the July 8t' letter, is that the sample taken was downstream of the inlets and numerous sources in addition to the mine. It is Harrison's understanding that the sampler did not perform sampling of any of the individual inflows or sources but merely of the cumulation of these. Had the sampler investigated further, he would have found that the discharge at SD03 is of a very nominal volume whereas the stream is of a significant volume; it would not be possible for the discharge at issue to Impact the stream to the degree implied by the sampling data. It is unknown what sampling and testing methodology was used; however, it appears that the sample was actually taken on the property of a construction company site where soils are stockpiled. This site and the intervening outlets were more likely to be the cause of the issue. Taken in context, the June data do not demonstrate a violation by Harrison. This is further supported by sampling performed last week at the Harrison outfall and up and downstream. The sampling data from the July 12t' rainfall event is enclosed. As noted, the discharge at S1303 at that time was at 2.4 NTU. The upstream measurement was at 1.5 NTU and down stream measurements were at 24 and 155 NTU. Accordingly, although the Harrison discharge was only approximately one -fifth of the turbidity standard for trout waters, the downstream waters were more than 15 times the standard due to the intervening inlets and sources. Harrison Is not responsible for the downstream levels measured on July 1 V and should not be given a NOV for the purported exceedance from June 16P. Given the foregoing discussion, it does not appear that Harrison has a need for treatment facilities at present and does not anticipate a future need although it will inspect and watch data for unexpected levels andlor noncompliances. Given the facts and data, Harrison does not believe was it necessary to notify DWQ of having endangered health or the environment in regards to the June sampling information. Part II Section B — "In the event that a facility fails to perform satisfactorily, including the creation of nuisance conditions, the permittee shall take immediate corrective action.... " Violation of the water quality standard for turbidity created nuisance conditions, therefore, Harrison must evaluate the need for new treatment facilities. f. Part IV. Section E.8. — The permittee shall report to the central office or the appropriate regional office any noncompliance which may endanger health or the environment. Harrison failed to notify DWQ regarding the turbidity violation. 11. Stream Standard Violation — DWQ sampling conducted .tune 16, 2010 indicated a violation of the turbidity standard of 10 NTU for trout waters [ref. 15A NCAC 02B .0211 3(k)]. The following results were obtained: Upstream - 6.1 NTU (above quarry site -- near Little Cove Road) Upstream - 1 I NTU (above culvert receiving SD03) Downstream - 1000 NTU (below culvert receiving SD03) Downstream - 310 NTU (below quarry site — near Fuller Drive) REQUIRED RESPONSE This Office requests that you respond in writing by July 26, 2010. Wilson) met with Don Mason, Jeff Mathis, Darrell Mathis, Todd Quigg, and Harold Kelly (Harrison staff) at the site on June 22, 2010. Kristin Hicklin and Shawna Riddle (Division of Land Quality) were also present during the majority of the site visit. The primary reason for the inspection was to evaluate the exterior of the facility, observing the potential stormwater exposure areas, outfalls, and site conditions. DWQ did a general overview of records while on -site. DWQ stated that record keeping should be more thorough and BMP inspections, as well as maintenance activities, should be more specific and documented more thoroughly. DWQ also stated that an onsite person(s) should be trained to sample, inspect, and maintain the BMPs. DWQ highlighted that BMP maintenance activities are of primary importance in attaining compliance with the stormwater permit. Approximately 48 acres of the site is disturbed/exposed (per Don Mason). Currently, Harrison staff has identified two outfall locations. Samples are collected for Outfall 001 (near the northwest comer of the site off New Allen's Cove Road). Per Harrison staff, there had been no discharge from Outfall 002 (east side — Allen's Cove Road), so no samples had been taken (several detention traps in series are prior to Outfall 002). Please note that not sampling or recording "ND" (no discharge) because personnel are not available during discharge event, is not an acceptable practice. Any vehicle maintenance is conducted in an enclosed garage. DWQ observed no potential stormwater issues due to vehicle maintenance. Secondary containment surrounds the fuel storage tanks. DWQ identified other Stormwater Discharge Outfalls (SDOs) that will require monitoring. Three additional outfalls were noted by DWQ and referred to as SD03, SD04 and SD05 (please refer to attached map). As discussed with Harrison personnel, the outfall area along New Allen's Creek Road, upstream of their identified Outfall 001, referred to as SD03 by DWQ, should be monitored for parameters outlined in the general stormwater permit (Mining SW permit). This outfall appears to receive pit water (mine dewater), process water, and stormwater runoff. It is recommended that a thorough evaluation of this entire drainage area take place, including the feasibility of separating mine dewatering, stormwater runoff, and process water from comingling. It likely will be necessary to install engineered stormwater control structures that will sufficiently treat waters to maintain compliance with effluent limits and/or benchmarks. This area is the likely contributor of turbidity during DWQs sampling event on June lb, 2010. It was pointed out during the inspection that monitoring at SDO3 should be conducted prior to,comingling with the other stormwater contributions from offsite (i.e., prior to mixing with the other culverts). DWQ also identified two additional outfalls, one north of Outfall 002, near Allen's Creek Road and the entrance road, referred to as SDO4 by DWQ. This outfall receives stormwater from the mine road area, as well as runoff from an asphalt waste pile. Although this outfall is associated with mining haul road, due to the asphalt waste pile contribution SDO4 should be monitored under the guidelines for the Asphalt Plant (Stormwater Permit NCG160024), which includes Total Petroleum Hydrocarbons (TPH) monitoring. Due to potential turbidity contributions from the mining haul road, this SDO4 should also be monitored for turbidity. The Division is requiring that Harrison monitor for turbidity in conjunction with the analytical monitoring. Another outfall was identified near the asphalt waste piles (across from the asphalt plant), referred to as SDO5 by DWQ. This outfall should be monitoring in accordance with the Asphalt Plant (Stormwater Permit NCG160024). Due to time constraints, DWQ was unable to conduct an inspection at the asphalt plant. Please review your Asphalt site again (in light of DWQs inspection of the mining facility) and ensure that all pertinent outfalls are identified and monitored as required. Regarding the turbidity sampling conducted June 16, 2010, during a rain event, turbidity measurements in Allen's Creek were in violation of DWQ's turbidity standard (results of those tests are attached). DWQ is requiring that Harrison conduct monthly monitoring at all five discharge locations identified (and as listed below in Table 1). Monthly monitoring should continue until such time that this office notifies Harrison otherwise. In addition, monthly instream monitoring for turbidity should be conducted upstream and downstream of the site (in Allen's Creek). DWQ understands there are other contributing sources in the watershed, however, Harrison staff should determine the appropriate downstream monitoring point(s) and consult with DWQ staff. At minimum, sampling should be conducted upstream on Allen's Creek near Little Cove Road and downstream near Fuller Drive. Table 1. Waynesville Quarry Dear Ms. Wilson: As requested in the July 8, 2010 letter from Roger C. Edwards to Don Mason, following is Harrison Construction Company Division of APAC Atlantic, Inc.'s ("Harrison") response. In an effort to correct some misperceptions that seem to be present in the July 8, 2010 letter, Harrison is providing a map showing the actual location of the quarry pit as well as purported and anticipated discharge points. Purported outfalls SD04 and S1305 have never been Intended to be actual outfalls and Harrison does not believe there has ever been a discharge from SD05 although it understands that a well meaning employee may have dug a hole at SD04 recently that resulted in a discharge. The topography at both of these points is being changed, including the removal of an access road, to prevent any future discharge at these locations. Revised mine maps are being submitted which will show the removal of these outfalls. To prevent future employee assistance of this nature, on site management and operational personnel are being given training regarding the plan and the importance of not changing the topography. The proper sampling location for SD03 is shown on the attached map. In past DWQ inspections, this location was not considered to be of concern due to the pristine nature of water. In order to preserve the water quality and prevent any commingling, it is now being piped from the mine pit to the discharge point. Monitoring results from this discharge are enclosed and show a level of 2.4 NTU. Also shown on the map is a new potential discharge location, SD06. There has not been a discharge from this location to date; however, it is a potential future discharge point and is being added to the revised maps being submitted. Also included in the revised maps are several new ponds. These ponds are expected to prevent any future discharge from SD01 and further minimize any discharges from SD02 and SD06. Ponds In place for SD06 and planned for SD02 will allow discharges only when planned and after on -site turbidity sampling to ensure compliance with permit limits. Collected stormwater is recycled for dust control purposes and assists in the goal of making the quarry a zero discharge facility. Any discharges from the outfalls shall be inspected and monitored on a monthly basis until DWQ directs otherwise. Training of on -site management and operational personnel is intended to 0 ® dt assist with notification internally of rainfall sufficient to trigger a discharge such that appropriate monitoring can be performed. These modifications, submittals, and actions will bring the facility into compliance. With regard to turbidity, the letter notes that the standard is that the mine shall not "cause" the turbidity of the receiving waters to exceed Water Quality Standards. Although this is the standard, Harrison is purportedly being issued a NOV for having "contributed" to the violation. The data, taken without context, would seem to indicate that Harrison has caused the violation but that is only because there is not context given. It is Harrison's understanding that the sampling data relied upon by DWQ in issuing the NOV was taken by a member of the Aquifer Protection Section rather than a DWQ inspector familiar with the sources and permits applicable to the area. The sampler did not actually enter Harrison property, to the best of our knowledge, and therefore could not take a representative sample of the actual discharge. Our understanding, based on the map included with the July r letter, is that the sample taken was downstream of the Inlets and numerous sources In addition to the mine. It is Harrison's understanding that the sampler did not perform sampling of any of the individual inflows or sources but merely of the cumulation of these. Had the sampler investigated further, he would have found that the discharge at SDO3 is of a very nominal volume whereas the stream is of a significant volume; it would not be possible for the discharge at issue to impact the stream to the degree implied by the sampling data. It is unknown what sampling and testing methodology was used; however, it appears that the sample was actually taken on the property of a construction company site where soils are stockpiled. This site and the intervening outlets were more likely to be the cause of the issue. Taken in context, the June data do not demonstrate a violation by Harrison. This is further supported by sampling performed last week at the Harrison outfall and up and downstream. The sampling data from the July 12' rainfall event is enclosed. As noted, the discharge at SD03 at that time was at 2.4 NTU. The upstream measurement was at 1.5 NTU and down stream measurements were at 24 and 155 NTU. Accordingly, although the Harrison discharge was only approximately one -fifth of the turbidity standard for trout waters, the downstream waters were more than 15 times the standard due to the intervening inlets and sources. Harrison is not responsible for the downstream levels measured on July 12°i and should not be given a NOV for the purported exceedance from June 16'". Given the foregoing discussion, it does not appear that Harrison has a need for treatment facilities at present and does not anticipate a future need although it will inspect and watch data for unexpected levels and/or noncompliances. Given the facts and data, Harrison does not believe was it necessary to notify DWQ of having endangered health or the environment in regards to the June sampling information. The present owners and/or operators of the quarry are APAGAtlantic, Inc., Harrison Construction Company in Franklin, Macon County, North Carolina. The company has applied for a permit to expand its quarry operations which would involve over 100 acres of jand and come witlain 1,000 feet of the Town of Waynesville watershed. The modification permit has been submitted to the Division of Land Resources which requested further information or proof substantiating some of the conclusions in the permit application. Mr. Rick Wooten, Senior Geologist for Geohazards and Engineering Geology, raised some questions about past overburdened slope practices. 1 have personally seen photographs of the water runoff from the quarry into Allen's Creek then into Richland Creek, and into Lake Junaluska that has a continuing problem with silt accumulation. The lake was dredged about ten years ago and is in severe need of dredging again because of the increased sill. Waynesville and Haywood Counties have made a concentrated effort to eliminate the silt runoff into Richland Creek. Page Two August 12, 2010 Secretary Cansler and Freeman The dust from the quarry operation poses continuing and very severe health problems for the persons living in the area. Deaths of persons in the area and who did not smoke or work in industries with unhealthy air problems have died from lung failure. The blasting which occurs to crack the rock seams have created issues with the wells of persons living in and outside the area. Dr. Garrett Smathers, highly recognized and respected expert in the field of environmental matters, with special emphasis on drinking watershed protection, recently attended a meeting of concerned citizens living in the Allen's Creek community together with elected public officials. He also has concerns with the drinking water. It is his recommendation, to which I totally concur, to address the serious environmental and health issues associated with the quarry and its proposed expansion, that each of your departments cooperate in the preparation of an Environmental impact Statement to fully address the issues raised by the expansion of this project and its impact on the community. I understand and appreciate that there are a great many demands on your departments, but because of the significance in long-range impact to the environment and health of the community in Haywood County, I would certainly hope that preparation of the Environmental Impact Statement could proceed in the immediate future. Both said they had not gotten any complaints that related to health issues concerning the quarry. ARO-SWP, however, has sited Harrison Construction for stream violations under their General Stormwater Permit. Apparently there has been a public hearing run by the Land Resources folks, specifically Judy Wehner, assistant mining specialist here in Raleigh. The public hearing was for a proposed expansion to the quarry, which was directed by Land Resources as a result of a land slide which buried a drill rig. The expansion is suppose to address instability of the quarry wall that failed. During this public hearing the residents , who are apparently against the expansion, made complaints about the dust caused (air quality), as well as cancer clusters. Harrison failed to notify DWQ regarding the turbidity violation. IL Stream Standard Violation — DWQ sampling conducted June 16, 2010 indicated a violation of the turbidity standard of 10 NTU for trout waters [ref. 15A NCAC 02B .0211 3(k)]. Wilson) met with Don Mason, Jeff Mathis, Darrell Mathis, Todd Quigg, and Harold Kelly (Harrison staff) at the site on June 22, 2010. Kristin Hicklin and Shawna Riddle (Division of Land Quality) were also present during the majority of the site visit. The primary reason for the inspection was to evaluate the exterior of the facility, observing the potential stormwater exposure areas, outfalls, and site conditions. DWQ did a general overview of records while on -site. DWQ stated that record keeping should be more thorough and BMP inspections, as well as maintenance activities, should be more specific and documented more thoroughly. DWQ also stated that an onsite person(s) should be trained to sample, inspect, and maintain the BMPs. DWQ highlighted that BMP maintenance activities are of primary importance in attaining compliance with the stormwater permit. Approximately 48 acres of the site is disturbed/exposed (per Don Mason). Currently, Harrison staff has identified two outfall locations. Sarimples are collected for Outfall 001 (near the northwest corner of the site off New Allen's Cove Road). Per Harrison staff, there had been no discharge from Outfall 002 (east side — Allen's Cove Road), so no samples had been taken (several detention traps in series are prior to Outfall 002). Please note that not sampling or recording "ND" (no discharge) because personnel are not available during discharge event, is not an acceptable practice. Any vehicle maintenance is conducted in an enclosed garage. DWQ observed no potential stormwater issues due to vehicle maintenance. Secondary containment surrounds the fuel storage tanks. DWQ identified other Stormwater Discharge Outfalls (SDOs) that will require monitoring. Three additional outfalls were noted by DWQ and referred to as SD03, SD04 and SD05 (please refer to attached map). As discussed with Harrison personnel, the outfall area along New Allen's Creek Road, upstream of their identified Outfall 001, referred to as SD03 by DWQ, should be monitored for parameters outlined in the general stormwater permit (Mining SW permit). This outfall appears to receive pit water (mine dewater), process water, and stormwater runoff. It is recommended that a thorough evaluation of this entire drainage area take place, including the feasibility of separating mine dewatering, stormwater runoff, and process water from comingling. It likely will be necessary to install engineered stormwater control structures that will sufficiently treat waters to maintain compliance with effluent limits and/or benchmarks. This area is the likely contributor of turbidity during DWQs sampling event on June 16, 2010. It was pointed out during the inspection that monitoring at SD03 should be conducted prior to comingling with the other stormwater contributions from offsite (i.e., prior to mixing with the other culverts). DWQ also identified two additional outfalls, one north of Outfall 002, near Allen's Creek Road and the entrance road, referred to as SD04 by DWQ. This outfall receives stormwater from the mine road area, as well as runoff from an asphalt waste pile. AIthough this outfall is associated with mining haul road, due to the asphalt waste pile contribution SD04 should be monitored under the guidelines for the Asphalt Plant (Stormwater Permit NCG 160024), which includes Total Petroleum Hydrocarbons (TPH) monitoring. Due to potential turbidity contributions from the mining haul road, this SD04 should also be monitored for turbidity. The Division is requiring that Harrison monitor for turbidity in conjunction with the analytical monitoring. Another outfall was identified near the asphalt waste piles (across from the asphalt plant), referred t6 as SD05 by DWQ. This outfall should be monitoring in accordance with the Asphalt Plant (Stormwater Permit NCG160024). Due to time constraints, DWQ was unable to conduct an inspection at the asphalt plant. Please review your Asphalt site again (in light of DWQs inspection of the mining facility) and ensure that all pertinent outfalls are identified and monitored as required. Regarding the turbidity sampling conducted June 16, 2010, during a rain event, turbidity measurements in Allen's Creek were in violation of DWQ's turbidity standard (results of those tests are attached). DWQ is requiring that Harrison conduct monthly monitoring at all five discharge locations identified (and as listed below in Table 1). Monthly monitoring should continue until such time that this office notifies Harrison otherwise, In addition, monthly instream monitoring for turbidity should be conducted upstream and downstream of the site (in Allen's Creek). DWQ understands there are other contributing sources in the watershed, however, Harrison staff should determine the appropriate downstream monitoring point(s) and consult with DWQ staff. At minimum, sampling should be conducted upstream on Allen's Creek near Little Cove Road and downstream near Fuller Drive. ® a Table 1. I became aware of issues at the Waynesville quarry last week andlas coordinator of the Richland Creek restoration project felt obligated to see the problem for myself and do appropriate monitoring. The DWQ, EPA and several partners are heavily invested in the watershed with ongoing restoration projects, the fecal coliform source abatement project and the Richland Creek fish reintroduction project. The level of sediment runoff from the quarry I witnessed yesterday, June 16`h, could pose considerable risk to our restoration efforts. The following is a report of my visit to the site: I've been in contact with Suzanne Hendricks 828.246.2309, local resident and concerned citizen. I instructed her to call me when a significant rain event was taking place, so I could come out and monitor. Yesterday 6/16 at 3:30 pm I got the call. The Waynesville Reservoir and water plant, located just upstream of the quarry, recorded the rain event to be 0._`s" in one hour. The rain stopped about the time I got on scene. The attached photos speak for themselves ( there are more photos on G:WPDATA:SHARE:Allens creek quarry sediment 6 16). Sediment was running off the quarry site and into Allens Creek at several locations. I have specific locations in my notes. I obtained turbidity samples below the last quarry impact zone, below a culvert releasing a particularly heavy load, upstream of that culvert, and % mile upstream of the quarry (see attached map). Allens Creek is classified as C; Trout waters with a turbidity standard of 10 ntu's. The site does have issues with regard to water quality and will receive a NOV. ARO DLR has been copied on the NOV which went out last week. With regard to DWQ permit the site isn't terrible but does need some attention and I am confident Harrison can gain compliance by then end of the year, if not sooner. Beginning this month the NOV will require the site to start monitoring monthly at all Stormwater Discharge Outfall (SDO) locations. We are looking for the site to maintain effluent limit or benchmark compliance for 3 consecutive months. Once they can show compliance for 3 months running then DWQ will advise them they can drop back down to the required monitoring frequency. They will also be required to sample for Turbidity upstream and downstream of their facility in association with their SDO monitoring events. The facility thought they had 2 SDOs; they have 5 SDOs, DWQ pointed out 3 other SDOs to Harrison personnel. All 3 of these newly designated SDOs will require monitoring as well as an evaluation the drainage areas, the type of water associate with each drainage area and how they are going to treat that water to avoid water quality problems. I do not see how this facility is going to avoid installing new BMPs, so I guess DLR will be seeing a modification request. It is possible one of the newly identified SDO locations can eventually be tied into the Asphalt plant, but for now we have them monitoring it monthly as well. The reporter for Smokey Mountain News spoke with me today regarding our inspection, her article should appear this Wednesday, hopefully it won't be too bad. Our office has been to this site several times over the last year or so as a courtesy to the complainants ... and to convey information to the state, as it is a state issue. Our people did not go onto the mine ... but just to the area at the public road that could be considered the discharge point of concern. Over the last few months, I think Jennifer sent some photos out, and I think some of the state folks have had some dealings with the mine on this concern. For Hartwell, Land Quality Section permits mines in the state under the State Mining Act ... and that includes erosion and sediment control as part of the requirements for a mine permit ... so my office does not have any authority over any aspect of this mine. Questions regarding mining compliance should be directed to Land Quality Section. Also, discharges of sediment into trout waters would likely be a violation of the NPDES permit, which is enforceable by the Division of Water Quality and the USEPA. I'm only aware of one time in the last ten years when the USEPA representative came to Haywood County on a complaint for alleged NPDES violations. (I think that particular complaint went to the Atlanta Office of the USEPA.) I'm certain that the state regularly monitors NPDES logs. If you have any questions, feel free to contact me. I became aware of issues at the Waynesville quarry last week and as coordinator of the Richland Creek restoration project felt obligated to see the problem for myself and do appropriate monitoring. The DWC, EPA and several partners are heavily invested in the watershed with ongoing restoration projects, the fecal coliform source abatement project and the Richland Creek fish reintroduction project. The level of sediment runoff from the quarry I witnessed yesterday, June 16`4, could pose considerable risk to our restoration efforts. The following is a report of my visit to the site: I've been in contact with Suzanne Hendricks 828.246.2309, local resident and concerned citizen. 1 instructed her to call me when a significant rain event was taking place, so I could come out and monitor. Yesterday 6/16 at 3:30 pm I got the call. The Waynesville Reservoir and water plant, located just upstream of the quarry, recorded the rain event to be 0.5" in one hour. The rain stopped about the time I got on scene. The attached photos speak for themselves ( there are more photos on G:WPDATA:SHARE:Allens creek quarry sediment 6 16). Sediment was running off the quarry site and into Aliens Creek at several locations. I have specific locations in my notes. I obtained turbidity samples below the last quarry impact zone, below a culvert releasing a particularly heavy load, upstream of that culvert, and % mile upstream of the quarry (see attached map). Allens Creek is classified as C; Trout waters with a turbidity standard of 10 ntu's.
