On June 12, 2009, Dave Parnell of the Raleigh Regional Office of the Division of Water
Quality, performed a compliance evaluation inspection (CEI) at your gravel mining facility.
The assistance of Mr, Nuwan Wijesuriya and yourself was helpful and appreciated. This
inspection was conducted to determine your compliance with NPDES stormwater general
permit referenced above. The following observations were noted during the Division of
Water Quality inspection:
SITE DESCRIPTION
Gravel products are currently being mined at this facility. There is one stormwater discharge
outfall (SDO) at the facility that discharges to Cedar Creek, a Class C stream in the Tar -
Pamlico River Basin. There was a, discrepancy in the numbering of the SDO in your
recordkeeping, with it being referred to as SDO #1 as well as SDO 002. Please inform this
office of the correct SDO designation. The process wastewater produced from the quarry
operations is discharged using a closed loop recycle system. The process wastewater is not
discharged but is re -circulated. Vehicle maintenance is conducted at this facility but you
report less than 55 gallons of used oil is produced, therefore; analytical monitoring is not
required.

Compliance Evaluation Inspection
INSPECTION SUMMARY
1. The Stormwater General Permit was onsite during the inspection. The permit expires
December 31, 2009. Please note that an application for renewal is required 6 months prior
to expiration of the permit.
2. The Best Management Practices (BMP) plan was available during the CEI. Documented
records of BMP inspections were evaluated. The BMP monitoring was being conducted at
least every seven calendar days as required, but lacked the required inspection within 24
hours of a storm event, resulting in a discharge. Please inspect and document all BMP
within 24 hours of a storm event resulting in a discharge. All other records that are
currently required by the permit were available during the inspection and were found to be
in compliance. The possibility that permit requirements could change in the next permit
cycle was pointed out to you and Mr. Wijesuriya during the site visit.
3. Qualitative and analytical monitoring were conducted as required and was documented.
The records were evaluated during the CEI and found to be compliant. Analytical
monitoring for the vehicle maintenance areas is not required' as stated above.
4. The SDO was visited during the CEI, as was the process wastewater closed loop system.
There were no compliance issues noted with either.

As for the inspection report dated June 17, 2009 you had requested that we do the following:
1) Inform your office of the correct SDO designation.
The correct SDO designation should he SDO #L
In addition, thank you for bringing to our attention the inspection and documentation requirements of
BMPS within 24 hours of a storm event resulting in a discharge. We have already taken steps to train our
onsite personnel of this requirement and we will document any such events on the back of our existing
weekly inspection records.

Mr. Chad Coburn and Mr. Harry Messenger of the Division of Water Quality, Raleigh Regional Office,
conducted an compliance evaluation inspection of the Franklin Quarry for coverage under the NPDES permit
NCG020180 on July 12, 2006. Mr. Nuwan Wijesuriya and Mr. Todd.Bouquin represented Martin Marietta
Materials Inc. during the inspection and their assistance was greatly appreciated. Findings during the inspection
are as follows:
1) The current permit was issued effective February 7, 2005, and expires on December 31, 2009.
2) Stormwater discharges from the site to receiving waters designated as an un-named tributary to
Cedar Creek, a Class WS II, High Quality Water (HQW), Nutrient Sensitive Water (NSW) in the
Tar -Pamlico River Basin.
3) The stormwater pollution prevention plan (SPPP) for the site was reviewed and found to be in
excellent order. A general location map and site map (both to scale) identifying all SDO's, a copy of
the general permit, records of spills, training rosters, emergency contact information, certification
that all SDO's have been evaluated for the presence of non-stormwater discharges, and a list of
potential pollutants.
4) Qualitative monitoring is being performed according to the permit, and records are kept on site in
accordance to the permit requirements.
---• �_ 5) Analytical monitoring is being performed according to the permit, and laboratory records kept at the
company's central office in Raleigh were made available to the inspectors upon request. Monitoring
records are kept on site as well.
6) The quarry sump collects process wastewater and stormwater within a drainage area in the quarry.
The combined water is then pumped from the quarry sump to a primary holding basin for further
settling.

7) Because stormwater runoff is not excluded from -en tering'the`lose loop system," therefore
the system is not technically closed loop in nature. Stormwater that intermingles with any process
wastewater can no longer be classified as "stormwater" and thus becomes process wastewater. The
system consists of a large primary settling basin adjacent to a smaller overflow basin, which then
sends process wastewater to a smaller secondary settling basin adjacent to another basin of similar
size that is kept empty for overflow as well. Stormwater from that section of the facility does enter
the primary settling basin thus qualifying it as "Other Process Recycle Wastewater" under Part III,
Section B (4) of the general permit. This process wastewater system must be monitored in
accordance with Table 8 of the permit during an overflow event.
8) During the inspection a question was raised by Mr. Wijesuriya concerning the permit requirement
for analytical monitoring of stormwater discharges from on -site vehicle maintenance. Since the
facility does meet the requirement of using more than 55 gallons of new motor oil per month when
averaged over the calendar year, analytical monitoring of stormwater from the section of the facility
that does not drain into the "closed loop system" should be performed in accordance with Table 3 of
the permit.
9) Applicability of EPA's Oil Pollution Prevention Regulations as they relate to the Franklin Quarry
should be investigated by Martin Marietta personnel. (This writer noted facility oil and fuel storage
in excess of 1320 gallons — the threshold for which the regulations apply to facilities meeting certain
criteria.)

yourself with the changes in the reissued permit. The general permit authorizes discharges of Stormwater and some types of
wastewater, You must meet the provisions of the permit for the types of discharges present at your facility. This permit is
reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement

A request for an Authorization to Construct was received on March 30, 1999 by the Division of
Water Quality (Division). The final plans and specifications for the subject project have been reviewed
and found to be satisfactory. Authorization is hereby granted for the construction and operation of the
proposed process wastewater recycle system and discharge,'of treated wastewater to an unnamed
tributary to Cedar Crcck in the Tar Pamlico River B isln.
This Authorization to Construct, 0201 SOACS, shall be subject to revocation unless the
wastewater treatment facilities are constructed and operated in accordance with the conditions and
limitations specified in 15A NCAC 2H .0100, General Permit NCG020000, and approved plans.
The sludge generated from these treatment facilities must be disposed of in accordance with G.S.
143-215.1 and in a manner approved by the North Carolina Division of Water Quality.
In the event that the facilities fail to perform satisfactorily, including the creation of nuisance
conditions, the Permittee shall take immediate corrective action, including those as may be required by
this Division, such as the construction of additional or replacement wastewater treatment or disposal
facilities.
The Raleigh Regional Office, telephone number (910) 486-1541 shall be notified at least forty- _.
eight (48) hours in advance of operation of the installed facilities so that an in -place inspection can be
made. Such notification to the regional supervisor shall be made during the normal office hours from
8:00 a.m. until 5:00 p.m. on Monday through Friday, excluding State Holidays.

Upon completion of construction and prior to operation of this permitted facility, a certification
must be received from a professional engineer certifying that the permitted facility has been installed in
accordance with the NPDES Permit, this Authorization to Construct and the approved plans and
specifications. Mail the Certification to the Permits and Engineering Unit, P.O. Box 29535, Raleigh,
NC 27626-0535.
A copy of the approved plans and specifications shall be maintained on file by the Permittee for -
the life of the facility.
Failure to abide by the requirements contained in this Authorization to Construct may subject the
Permittee to an enforcement action by the Division of Water Quality in accordance with North Carolina
General Statute L43-215.6A to 143-215.6C.

Dear Mr. Goodrich:
Attached please find four (4) copies of details and design drawings for the construction of a
closed loop settling cell system at Martin Marietta's Franklin Quarry. The ponds associated with
this system will be located north of the existing plant processing area and will be utilized to wash
crushed aggregate for clean stone production. This facility is covered under General Permit No.
NCG020180.
As noted in the design drawings, all surface water runoff will be directed away from the cells
allowing the system to operate as a closed loop. Additionally, each of the cells will maintain a
minimum two feet (2) of freeboard at all times. In the past, an engineers certification :was
provided for the construction of this type of system; however, based on recent correspondence
with Mr. Bradley Bennett of your office, a PE Certification is not needed for this type of system
when constructed "in-house" in accordance with accepted practices.

The Division of Environmental Management has recently evaluated all existing individual permits for potential
coverage under general permits currently issued by the Division. 15A N.C.A.C. 2H .0127 allows the Division to
evaluate groups of permits having similar discharge activities for coverage under general permits and issue
coverage where the Division finds control of the discharges more appropriate in this manner. The Division has
determined that the subject discharge qualifies for such coverage. Therefore, the Division is hereby issuing the
subject Certificate of Coverage under the state-NPDES general permit no. NCG020000 which shall void NPDES
Permit NC0072052. This Certificate of Coverage is issued pursuant to the requirements of North Carolina and the
US Environmental Protection Agency Memorandum of Agreement dated December 6,1983 and as subsequently
amended.
If any parts, measurement frequencies or sampling requirements contained in this general permit are unacceptable to
you, you have the right to submit an individual permit application, associated processing fee and letter requesting
coverage under an individual permit. Unless such demand is made, this decision shall be final and binding. Please
take notice this Certificate of Coverage is not transferable. Part II, EA. addresses the requirements to be followed
in case of change of ownership or control of this discharge.
In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the
Pem-ittee shall take immediate corrective action, including those as may be required by this Division, such as the
construction of additional or replacement wastewater treatment or disposal facilities. Construction of any
wastewater treatment facilities will require issuance of an Authorization to Construct from this Division.
Failure to abide by the requirements contained in this Certificate of Coverage and respective general permit may
subject the Permittee to an enforcement action by the Division of Environmental Management in accordance with
North Carolina General Statute 143-215.6A to 143-215.6C. Please note that the general permit does require
monitoring in accordance with federal law. The monitoring data is required to be submitted to the Division no later
than January 31 for the previous year in which sampling was required to be performed.

The issuance of this Certificate of Coverage is an administrative action initiated by the Division of
Environmental Management and therefore, no fees are due at this time. In accordance with current rules, there
are no annual administrative and compliance monitoring fees for coverage under general permits. The only fee
you will be responsible for is a renewal fee at the time of renewal. The current permit expires August 31,1997.
This coverage will remain valid through the duration of the attached general permit. The Division will be
responsible for the reissuance of the general permit and at such time, you will be notified of the procedures to
follow to continue coverage under the reissued permit. Unless you fail to follow the procedures for continued
coverage, you will continue to be permitted to discharge in accordance with the attached general permit.
The issuance of this Certificate of Coverage does not preclude the Permittee from complying with any and all
