Dear Mr. Wijesuriya:
Lori Ann Phillips from the -Department of Environmental and Natural Resources conducted a
stormwater inspection on September 18, 2015, as part of a multimedia'inspection of your'' facility.' Your
assistance during the inspection was greatly appreciated. The inspection report is attached: Findings '
during the inspection were as follows:
1. Certificate of Coverage (CQC) No. NCG020069 under NPDES general permit NCG020000
Martin Marietta Aggregates — Fuquay Plant to discharge stormwater runoff and process
wastewater to an unnamed tributary of Buckhorn Creek.
2. A review of the facility's Stormwater Pollution Prevention Plan (SPPP) indicated that it
included all of the components required by the general permit. All recordkee ping was found
up to date and thorough.
3. Qualitative and analytical monitoring have been conducted regularly at the process
wastewater outfall and.'the stormwater discharge outfall.
4. All outfalls were observed during the inspection and were found to be maintained and
accessible. it is recommended that silt fencing be placed at the end of the access road
near the process wastewater outfall to eliminate silt from penetrating the rip -rap and
directly depositing into the creek, as evidence of this occurrence was observed during
the inspection.

On December 18, 2013, 1, Joe Dupree, of the Raleigh Regional Office, along with Ashley Rodgers, PE
and Chris Pullinger, also of the Raleigh Regional Office, carried out a stormwater compliance evaluation
inspection (CEI) for the above permit. The availability of Mr. Matt Waligora to assist me, was
appreciated as it facilitated the inspection. A synopsis of the inspection is discussed below:
1. The Stormwater Pollution Prevention Plan (SPPP) was available during the inspection. The
SPPP was reviewed and updated annually during this permit cycle. All components of the plan
were evaluated during the CEI, and the plan was found to be complete and being put into active
use.
2. The Stormwater Discharge Outfalls (SDO) were inspected during the inspection. The SDO
appear to be adequately capturing all of the stormwater coming from the production area.
3. Qualitative monitoring results were reviewed during the CEL Qualitative monitoring results
were available and up to date.
4. it appears that the current permit will expire on December 31, 2014. An application for renewal
of your permit is required to be received a minimum of six months prior to its expiration.

Dear Ms. Wijesuriya:
In response to your letter of August 22, 2006, regarding approval of the use of a flocculant
in the closed loop recycle system at the Martin Marietta Fuquay Quarry, you have
permission from the Division to use the specified flocculant Nalcolyte 7135. Use of the
flocculant should be in full compliance with the conditions of NC DWQ General Permit
No. NCG200000. This includes the provision that your recycle ponds must have
sufficient size to contain the accumulation of water from a 25-year, 24-hr storm event.

With reference to your letter dated August 11, 2006. Item 4 of the inspection report noted that
there were 55-gallon drums at the site stored outside of the secondary containment structure. As
mentioned to you during the inspection, we are currently seeking bids to construct a shop at this
facility. "this construction is scheduled to take place in 2006 and we plan to move these drums to
this shop once it is completed. During the interim we will continue to monitor these drums to
insure that they are handled properly.

Subject: Authorization to use flocculant in a Closed Loop Recycle System
Martin Marietta Materials, Inc. — Fuquay Quarry

Dear Mr. Bennett
We wish to seek authorization to utilize flocculant (Nalcolyte 7135) at Martin Marietta Materials,
Inc., Fuquay Quarry in their closed loop plant process water recycle system. As such, please find
attached a copy of the Material Data Safety Sheet (MSDS) for the flocculant. As you can see
from Section 15 of the MSDS, this product does not fall under SARA Title III Section 313 Toxic
Chemicals reporting requirement.
As mentioned above, the plant process water settling ponds are completely closed loop and have
been designed to operate with two feet of freeboard. It is our understanding from reviewing
Permit NCG020000 and the Technical Bulletin that the approval for flocculent use was only
applicable to use in treatment facilities that have the potential to discharge. As stated, this
flocculent will be used in a closed loop system. This type of system is exempt from the
Authorization to Construct requirements for the same reason that we assumed flocculent use was
exempt. All of the water contained in these systems remains on site and effluent limitations are
not an issue. The Technical Bulletin definition of Treatment Facility also reinforces this by
stating that these facilities are used to meet effluent limitations.
I trust this will satisfy the Part II, Section B(7) requirement of the NPDES General Permit. Should

Mr. Chad Coburn of the Division of Water Quality, Raleigh Regional Office, conducted an compliance
evaluation inspection of the Fuquay Quarry for coverage under the NPDES permit NCG020069 on August 2,
2006. Mr. Nuwan Wijesuriya and Mr. Lester Goshorn represented Martin Marietta Materials Inc. during the
inspection and their assistance was greatly appreciated. Findings during the inspection are as follows.
1) The Stormwater Best Management Practices (BMP's) Plan for the site was reviewed and found to be
in excellent order. A general location map and site map identifying all SDO's, a copy of the general
permit, records of spills, training rosters, emergency contact information, and records of in house site
inspections, were on file.
2) Qualitative monitoring is being performed according to the permit, and records are kept on site in
accordance to the permit requirements. Analytical monitoring is being performed according to the
permit, and laboratory records kept at the company's central office in Raleigh were made available
to the inspectors upon request. Monitoring records are kept on site as well.
3) Part 11, Section B (7) of the permit states that no chemical flocculants shall be used in the treatment
facility without written authorization from the Division of Water Quality. There is no record of
written authorization for the use of the chemical flocculants in the file. Please send a request for

4) Fifty-five gallon drums at the site are stored on the ground`witliourany kind of secondary
containment. These drums need to be either stored inside or have some sort of secondary spill
containment. Notify this office as to what measures will be taken to comply with EPA's Oil
Pollution Prevention regulations as they relate to 40 C.F.R. 112.

Quality (DWQ) is forwarding herewith the reissued stormwater general permit. Please review the new permit to familiarize
yourself with the changes in the reissued permit. The general permit authorizes discharges of stormwater and some types of
wastewater. You must meet the provisions of the permit for the types of discharges present at your facility. This permit is
reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement
between the state of North Carolina and the U.S. Environmental Protection Agency, dated December 6, 1983.

facilities. The operator must hold a certificate of the type and grade at least'equivalent to or greater than the
classification assigned to the wastewater treatment facilities by the Certification Commission. Tlic
Permittee must also employ a certified back-up operator of the appropriate type anti grade to compiy with
the conditions of Title 15A, Chapter 8A, .0202. The ORC of the fact]ity must.,visit each Class I facility'at
least weekly and each Class H,-111, and IV facility at least daily, excluding weekends rind holidays, and
must properly manage and document daily operation and maintenance of the facility and must comply with
all other conditions of Title 15A. Chapter 8A, .0202. Once the facility is classified, the Perririttec rirust,
submit a letter to the Cer ificalion Commission which designates the operator in responsible charge within
thirty days after the wastewr.iter treatment facilities are 50`lo complete.
A copy of the approved plans and specifications shall be maintained on file -by the Permittee for the
life of the facility,
failure to abide by the requirements contained in this Author-iZation to Construct 1111.1y subject the

In accordance with the reporting requirements of the above referenced permit, this letter is to serve as
written not] ication that the monthly pit discharge sample for May 1997 exceeded the monthly turbidity
limitation. The sample, taken at 10:00 a.m. on May 1, 1997, had a turbidity reading of 244 NTUs. Mr.
Kirk Stafford of your office was notified of this reading on June 6, 1997.
As discussed during our phone conversation, this reading was caused by the excessive rainfall amounts
prior to the sampling event. Approximately 5.1" of rain fell from April 22 through April 30. This
quantity of rain caused a considerable amount of stormwater from surrounding areas to flood the pit. Due
to the size of the pit at Fuquay, water in the pit is typically used for process water and dust suppression.
A discharge will typically only occur under extreme rainfall events. In reality, this discharge is actually a
stormwater discharge.
The discharge monitoring reported for this sample will also note the specifics of the sampling event along
with contributing factors to the exceedance.

Enclosed please find a set of detailed drawings to cover the construction of a closed loop
settling cell system at Martin Marietta Aggregates Fuquay Quarry. This type of system is
covered under the General Permit issued for this site in December, 1992. Certificate of
Coverage No. NCG020069 under General Permit No. NCGO20000 includes pit discharges,
stormwater discharges and discharges from process wastewater systems..
Included in this submittal is a check in the amount of $200.00 to cover the authorization fee
and 2 sets of details sealed by a Professional Engineer.
As shown on the drawings, this system will consist of 2 settling cells and a plant supply pond.
This system will handle fines washed from the crushed stone. All collected material will be
used onsite in berms or will be sold. This system will have the required 2 foot of freeboard
and all of the surface runoff will be -directed `away from'the "system:---

NPDES general permit. Issuance of this certificate of coverage supercedes the individual NPDES
permit No. NC0069809. This permit is issued pursuant to the requirements of North Carolina
General Statute 143-215 .1 and the Memorandum of Agreement between North Carolina and the
US Environmental Protection agency dated December 6, 1983.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to request an individual permit by submitting an individual
permit application. Unless such demand is made, this certificate of coverage shall be final and
binding.
Please take notice that this certificate of coverage is not transferable except after notice to the
Division of Environmental Management. The Divsion of Environmental Management may require
