This was a follow up inspection. Required action from 4/14/11 inspection had been completed. Location Map had been updated. SDO #5 had increased treatment units and retention time. Inspector performed onsite pH and Turbidity of SDO#5. pH was 7.2 s.u. and Turbidity was 37 NTU. TSS was analyzed for SDO#5 by Asheville lab with a result of 7.3 mgll. SD0#5 is considered WW and to be sampled quarterly. The washing area and residual wash water from the plant can drain to SDO#5. SD03# was previously noted as being a WW outfall but was re-evaluated and is a SW outfall to be sampled semi-annually. The portion of the plant that drains to SDO#3 is crushing not washing. SDO#2 is overland flow and receives runoff from vehicle maintenance and is considered a stormwater (SW) outfall with vehicle maintenance requirements. SDO#3 was determined during this inspection to be.a SW discharge instead of previously thought WW. SDO#4 is an intermediate point and not a final discharge point so it is not necessary to sample this location. SD0#1 is the final discharge point for these associated flows. SDO#5 is overland flows from stock piles and plant area and is considered a WW discharge because of the residual wash waters. SDO#5 is also the drainage area for the Asphalt facility (Mid State). Vulcan and Mid State are leaning towards seperating their discharge. Vulcan is considering a berm or possibly a pipe to isolate their overland flows from Mid State flows. Also SDO#5 did have some erosion at the outfall that needed repair. It is also in response to a Representative Outfall Status request. Representative Outfall Status is not granted at this time. Stormwater Discharge Outfall SD0146- 003 is not considered representative of SDO 146-005. At the time of the inspection SDO 146-005 was discharging. Also, the drainage areas need to be reevaluated; it appears that SDO 146-003 does not receive a similar constitution of wastewater as SDO 146-005. Vulcan requested Representative Outfall Status (ROS) for SDO 146-005; requesting SDO 146-003 represents SDO 146-005. Required Action: ROS is not granted, at the time of the inspection SDO 146-003 was not representative of SDO 146-005. The Outfaii Location Map (Marshall Miller Assoc. 5/27/2010) with the drainage areas depicted does not appear to be accurate. The SDO locations are not a concern; however the drainage areas need groundtruthing, especially outfall 146-003 drainage area. It did not appear during the inspection that most of the processing area wastewater and stormwater flowed to outfall 146-003. (Required Action:::tJpdate'the OutfaiFL'ocation-Map to accurately show drainage areas associated with outfalls, also include if the outfalls are monitored as a Stormwater (SW) or a Wastewater (WW) discharge. SDO 146-005 was discharging process water at the time of the inspection. There was a constant flow of process water toward two gravel bermed areas that had been created in a sequence. The discharge did not appear to be causing a turbidity issue in the receiving stream. However, the gravel berms were not serving their purpose as erosionlsedimentationlstormwater control treatment units. Process water was flowing through the gravel berms with no retention/treatment. The inspector had concerns that the discharge occurring during the inspection could indicate non compliance. Please keep in mind NCG020000 Permit Requirement Part III Section A. 2. and 3.b. should be used as a management tool to avoid non-compliance. 'Required -Action: The facility was instructed to perform additional monitoring of this SDO to determine if the discharge was compliant.. It was suggested the facility sample the SDO 146-005 discharge at base flow (non storm event), as well as added sampling of the discharge during a storm�event. The facility will likely need to reconstruct or reconfigure the treatment units to maintain compliance. Sample results obtained from this SDO, along with any changes or maintenance performed on the treatment unit need to be sent to Asheville Regional Office for theme twxt a quarters —' The outfall 146-005 drainage area also consists of an asphalt plant, Mid State Contractors. Mid State Contractors was notified that they need to be covered under a Stormwater Permit (NCG 16). If the companies are interested in sharing analytical responsibilities at SDO 146-005 the DWQ inspector is ok with Mid State and Vulcan doing so unless compliance issues arise or otherwise notified. Sampling Discharge Outfall requirements for the Vulcan Lenoir facility as noted during the April 2011 inspection were as follows: SDO 146-001 sampling required "Quarterly"; this is considered a wastewater discharge because it receives process water from the process area and gravel pile runoff as well as mine dewatering from the pit. SDO 146-002 sampling required "Semi-annual"; this is considered a stormwater discharge as long as water from process area during heavy rain events is not flowing here. This outfall is to be sampled according to the vehicle maintenance -SDO 146-00l sampling required "Quarterly"; this is considered a wastewater discharge because it receives process water from the process area and gravel pile runoff. This drainage area is bermed with gravel along the stock yard perimeter. The outfall is a single gravel basin/berm area without a discrete conveyance. It is recommended that twice a year during the qualitative monitoring this perimeter berm is walked and evaluated for effectiveness. SDO 146-005 sampling required "Quarterly"; this is considered a wastewater discharge because it receives process water from the process area and gravel pile runoff. The outfall is two gravel berms in a series. See comments above. Please keep in mind that evaluation of the discharge from your facility is an ongoing event. Unless there is a significant drought or exceptional basin capacity, analytical monitoring is required. Be careful not to wait until too late in the quarter to evaluate your discharge, otherwise you may miss a sampling event. As mentioned above, use the NCG020000 Permit Requirement Part III Section A. 3.b. to stay on top of maintenance and likely discharge events to meet analytical monitoring expectations. Mine dewatering and/or discharges of process wastewater, including commingled stormwater. Stormwater discharges from other plant areas where the stormwater has contacted areas directly related land disturbance and process areas. Your letter cited reasons to support the request that included: • Hard copies of the new NCG020000 permit not being received until mid -February, when the permit had become effective January 1, 2010; • Spotty weather patterns resulting in Storm events during non -operating hours that prevent sample collection; and • The need for additional time to train Sampling Personnel on significant changes in the permit. One of the reasons for your request was the new provision that monthly monitoring will apply for the remainder of the permit term, should the mine ever fail to collect a sample during a scheduled monitoring period (footnote 1 of Table 1 in Part 111). While considering your request, the Stormwater Permitting Unit (SPU) realized this provision may unfairly affect permittees who obtain coverage under NCG020000 in the middle of a monitoring period. The SPU has written up guidance to address this situation and related conflicts in the permit text (see attachment). . Recognizing there were possible conflicts with this provision that our guidance now addresses, DWQ will grant your request for an extension to collect a stormwater sample by August 31, 2010. Vulcan Materials is a member of NCAA, and a representative of the company attended the initial meeting. • The provision that triggers monthly monitoring for failure to sample came out of discussions with industry representatives during these meetings and was incorporated into the final permit as a result. • The definition of representative storm event also changed as a result of these discussions with NCAA to increase sampling opportunities during operating hours. A representative storm event in NCG020000 now only requires a period of 48 hours of no rain prior to the event. • An advance copy of the final permit was forwarded to the Executive Director of the NCAA on December 29, 2009 and subsequently distributed to NCAA members. The final NCG020000 permit was available to all permittees on the DWQ website when it became effective in January 2010. • Stormwater sampling requirements are not new with this renewal, even though sampling is now semi- annual (instead of annual in the previous permit). While there was a slight infringement into the buffer zone, no till was placed into jurisdictional wetlands and streams without the proper permitting. Along a short section of the fill, the buffer was inadvertently reduced to approximately 36 feet in width. In response to your inspection, we have removed all fill so as to reestablish a buffer of at least 50 feet. We have also provided temporary silt fencing and have revegetated such areas and the lower section of the berm. As you are aware, the above work was subject of our April 2003 modification application that was approved July 24, 2003, In conjunction with the mine permitting, we retained Mr. Craig Wyant of A Fine Line Design to perform a comprehensive wetlands and streams delineation, and to secure any associated permits. To verify this, please find enclosed excerpts from his work and a copy of the US Army Corps of Engineers, Action ID 200231138. Our project impacted short sections of channels that were allowable under the Corps permit. Although our project did not require 401 Certification or a permit from Division of Water Quality, we met all associated requirements in effect at that time. There has been no unauthorized filling of'wetlands. During berm construction, several small "boulders" rolled into the buffer zone. One inadvertently rolled near the edge of the jurisdictional isolated wetlands. All such boulders have been removed without any adverse impacts or tilling.
