VAN DER VAART Secretary JAY ZIMMERMAN DWR Director October 24, 2016 Mr. Kevin Howard, County Manager County of Chowan PO Box 1030 Edenton, North Carolina 27932 RE: Phase II Site Assessment Report Review Vahalla Water Treatment Plant NPDES Permit No. NCO032719 Chowan County, North Carolina Dear Mr. Howard: On August 29, 2016, the Washington Regional Office received a report for the above referenced facility that presented the results of the Phase II Site Assessment performed in response to the Notice of Violation (NOV) issued by the Division of Water Resources — Water Quality Regional Operations Section on October 6, 2015, for exceedance of the North Carolina Groundwater Quality Standards (15A NCAC 2L). Based on our review, this office concurs with the conclusions and recommendations in the report and requests that Chowan County proceed with the completion of a Comprehensive Site Assessment (CSA), as required by 15A NCAC 2L .0106(g). The CSA should include, but is not limited to the following: The source and cause of contamination; 2. Any imminent hazards to public health and safety and actions taken to mitigate them in accordance with 15A NCAC 2L .0106(f); 3. All receptors and significant exposure pathways; 4. The horizontal and vertical extent of soil and groundwater contamination and all significant factors affecting contaminant transport; and 5. The subsequent report must be signed and sealed by a P.E. or L.G. For information on available consultants and engineers, you may contact the Consulting Engineers Council of North Carolina at (919) 781-7934, or the North Carolina Board for Licensing of Geologist at (919) 850-9669, or the North Carolina Petroleum Marketers Association at (919) 782- 4411. The complete CSA report must be submitted to this office by July 1, 2017, as required by Item 2(b)(2) of Special Order by Consent (SOC) WQ S16-003. As noted in Item 3 of the SOC, failure to meet a required deadline will result in enforcement action.
