Dear Mr. Hart and Mr. Parker:
You have our approval, in accordance with the attached conditions, to excavate, shade and/or place fill in 0.074 acre of
vegetated wetlands and Public Trust/estauarine waters in order to construct a bulkhead for shoreline stabilization, a boat ramp and a
boathouse and to conduct maintenance dredging along the shoreline of a man-made canal adjacent to Pamlico Sound in Dare County, as
described in your application received by the Division of Water Quality on January 18, 2001. After reviewing your application, we have
determined that this fill is covered by General Water Quality Certification Number 3274. This Certification allows you to use your CAMA
Permit when it is issued by the NC Division of Coastal Management. In addition, you should get any other federal, state or local permits
before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply
Watershed regulations. Also this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the
General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your project, you
must notify us and you may be required to send us a new application for a new certification. If the property is sold, the new owner must
be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for
this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h).
For this approval to be valid, you must follow the conditions listed in the attached certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60
days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter 150B of the North
Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its
conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you have any

shoreline of a man-made canal to the Pamlico Sound.

Project Setting
The application site is located at lots 11 and 12, Palmetto Drive, Palmetto Shores in Frisco, Dare
County. The site consists of 2 adjacent lots, approximately 8,000 sf each, along a man-made canal
that connects to the Pamlico Sound. The site has an elevation of approximately 3 feet above the
NWL and has sandy soils. Lot 11 is a developed lot including a single family residence and a 30 ft
by 6 ft landward boardwalk connected to the house by a 6 ft wide wood walkway. Lot 11 is
owned by J. Richard Parker and is vegetated in indigenous grasses. The shoreline of lot 11 is
stabilized with a wooden bulkhead that terminates approximately 5 ft from the property line
between lots 11 and 12.
Lot 12 is an undeveloped lot owned by co-applicant "S. Thomas Hart". It is vegetated in
indigenous grasses and shrubs including salt meadow hay (Spartina patens) and prickly pear. The
shoreline of the next lot (Lotl3) adjacent to lot 12 is stabilized with a wood bulkhead that
terminates short of the "Hart" property. The shoreline of lot 12 is not stabilized and has a 2 to 4 ft
wide coastal wetland fringe, and consists of predominately black needle rush (Juncus
roemerianus), salt meadow hay (Spartina patens) and salt water cordgrass (Spartina alterniflora).
Approximately one to two feet of this wetland fringe is waterward of the NWL. Approximately
25 ft of the coastal wetland fringe is vegetated in Spartina alterniflora. Bank erosion and an
undercut escarpment are present along portions of the shoreline of lot 12 and a spoil bank is
visible 2 to 3 feet waterward of the NWL. The application reports that 2 ft of erosion have
occurred within the last year on lot 12.
With the exception of the spoil bank areas adjacent to the NWL off-shore of lot 12 where water
depths are less than one foot, the existing canal water depths range between - 2.5 feet near the
shoreline to - 4 feet 20 feet off-shore. The -4 foot water depth contour off-shore of lots 11 and 13
is approximately 5 feet waterward of the existing bulkhead. The canal width is approximately 80
feet and is approximately 1,200 feet in length with a basin located at the landward end of the
canal. The basin is used by a commercial marina and boat maintenance facility. The canal bottom
consists of predominately sand with little or no organic material. No significant areas of
submerged aquatic vegetation were observed during the application site visit. Juvenile fin-fish
were observed off-shore of lot 12 during a site visit concerning this application. The waters of this
canal carry the same water classifications as the Pamlico Sound and are not open to commercial
shellfish harvest in this vicinity. The North Carolina Marine Fisheries and Wildlife Resources
Commissions classify the waters of the Pamlico Sound as Estuarine Waters. The Coastal
Resources Commission has designated these waters as Public Trust Area and Estuarine Waters.
Project Description
This project proposes to stabilize the entire shoreline of lot 12 and tie this bulkhead into the
existing bulkhead on lot 11. Since a small portion of this proposed bulkhead would be located on
lot 11, the application has been submitted in both property owners' names as co-applicants. The
application also proposes to construct a boat ramp, dock and boathouse on lot 12, as well as
undertake maintenance dredging along the shoreline of lot 12.
The proposed maintenance dredging would excavate to a depth of - 4 feet, NWL, the area directly
waterward of lot 12 and connect to the existing - 4 foot water depth some 20 feet off-shore,

creating a slip area approximately 95 feet by 20 feet. The spoil would be excavated by mechanical
means and placed 30 feet from the existing shoreline in a spoil retention area located on lot 12.
The bulkhead shoreline stabilization structure would connect to the existing bulkhead on lot 11,
terminate at the proposed boat ramp near the property line between lot 12 and lot 13. The new
bulkhead would stabilize 83 feet of shoreline, and extend an average distance of 4 feet waterward
of the NWL, and a maximum distance of 5 feet beyond the NWL. The proposed bulkhead would
be constructed of treated wood. The tieback area would be backfilled with sand from off-site, as
well as with de-watered dredge spoil. A 62 foot long by 5 foot wide boardwalk would be
constructed directly landward of the bulkhead and would connect to a 5 foot wide by 15 foot long
courtesy pier that would be situated adjacent and perpendicular to the bulkhead. This waterward
pier would extend along the southern side of the proposed boathouse and would allow pedestrian
access to both the south and the east sides of the boathouse.
The proposed boathouse would be parallel to the shoreline and be sheathed from the roofline
down, three feet above the NWL. Since the dock would also extend 3 feet above the NWL, this
would result in the essentially the entire boathouse being enclosed. This structure would be 26.5
feet in length and extend 15 feet beyond the new bulkhead and include a boatlift and pitched roof.
The boat ramp would be situated near the lot 12-13 property line, be 12 feet wide and 20 feet
long. The ramp would extend 12 feet into the canal beyond the NWL, be constructed of pre-cast
concrete and set into place in sections. The remaining ramp length would include the driveway
portion of the ramp.
The overall land disturbance, including bulkhead tieback area and backfill would be approximately
97 feet by 17 feet. This proposal does not specifically include any single-family structure
construction for lot 12, although this construction was previously authorized by CAMA Minor
Permit 2000-112, issued on July 26, 2000 by Dare County and this construction will be part of the
overall accumulative impacts related to on-site development.
Anticipated Impacts
The proposed canal maintenance excavation would result in creating a useable slip and access area
for the proposed boathouse and ramp facility for lot 12. This excavation would result in the
disturbance of 1,900 sf of Public Trust Area and the removal of approximately 106 cy of dredge
spoil material from the canal. The spoil would be placed within an adjacent upland 3,150 sf
retention area, outside of the Coastal Shoreline buffer area but within the Estuarine Shoreline
AEC.
The proposed bulkhead alignment would result in the filling of approximately 388 sf of Public
Trust Area, as well as the filling and associated loss of approximately 388 sf of coastal wetland
fringe habitat within and adjacent to these Public Trust Area waters. The proposed boat ramp
would extend 12 feet into the canal and result in excavation and fill of 144 sf of Public Trust
Area. The ramp would also be associated with a portion of the above referenced wetland losses.
The driveway to the ramp would create 96 sf of impervious area within the Coastal Shoreline
buffer area. The excavation and filling activity associated with the bulkhead and ramp would

remove any associated wetland area of habitat along this waterway. The backfill and grading
would result in approximately 1,649 sf of land disturbance within the Coastal Shoreline buffer.
The proposed 62 ft by 5 ft boardwalk would be located over a portion of the bulkhead backfill
area and would provide water access along this shoreline without extending into the adjacent
Public Trust Area waters, and would minimize shading and navigation impacts within these
waters. However, this boardwalk would result in the loss of 325 sf. of vegetation within the
Coastal Shoreline buffer area. The proposed 15 ft by 5 ft courtesy pier, along with the boardwalk,
would allow boat and boathouse access on two sides of the boathouse without extending further
into the canal than the footprint of the boathouse. The proposed boathouse would be consistent
with the current rules concerning boathouse size. It's location, as well as the courtesy pier, would
not extend beyond one-fourth of the canal width and would not be within the 15 foot adjacent
riparian setback area. Current policy regarding the enclosure and siding of boathouses allows for
structures to be enclosed half-way down from the roof line. The proposed boathouse appears
somewhat to exceed this policy.
The proposed shoreline stabilization and filling activity would result in an increase in turbidity
levels, at least temporarily, along this portion of this waterway. The placement of a bulkhead
structure and maintenance excavation along this shoreline would result in alteration of the shallow
water habitat bottom adjacent to the existing shoreline and the proposed slip area. The proposed
development would result in 2,761 sf of disturbance within the Public Trust Area of this canal and
this figure would include slightly less than 400 sf of shading. Other than the boat ramp, there are
no proposed impervious surfaces within 30 feet of the NWL associated with this proposal.
However, the recently issued CAMA Minor permit will result in approximately 560 sf of open
decking and 500 sf of impervious surfaces within the buffer area.
