Dear Mr. Huff:
Your revised application for a 401 Water Quality Certification was received in the
Central Office on February 5, 2001 (dated February 2, 2001). According to our rules
[15A NCAC 2H .0507 (A)], if final action is not taken within 60 days, the Certification is
waived unless DWQ has objected in writing to your application. Therefore, DWQ has
waived the requirement for a 401 Water Quality Certification for your plains to impact
0.06 acres of wetlands or 165 feet of streams for development of Carthage Colonies
project at SR 1152 near Hwy 78 as described in your application.
However if additional impact occurs or your development plains change, this
waiver is no longer valid and a 401 Water Quality Certification will be required.

Re: Request for written 401 certification approval for the pCarthage Colonies,
Sanford, Lee County, North Carolina
Dear Mr. Dorney:
On February 2, 2001, a revised permit application, impact map, etc. for Carthage Colonies was
sent to your office. Our client requested the use of Nationwide permits 14 and 18, which would
have impacts to wetlands totaling 0.0585 acres and channel impacts totalingl65 linear feet. The
February 2, 2001 PCN form, impact map, and cover letter are attached along with a copy of the
invoice from Action Couriers showing that the permit application was received by your office and
signed for by A. Milland.
As per my telephone conversations with you and Mr. Bob Zarzecki, it is my understanding that a
letter from you requesting further site information and dated May 1, 2001 was sent to out to
someone, however I have not yet received a copy. Regardless of the May 1, 2001 letter, the
Division of Water Quality's 60-day response time expired on Apri12, 2001. Please send written
correspondence that the Division of Water Quality has waived its right to further comment on this
project and therefore gives its permission to complete the project as specified in the attached PCN
form and impact map. Upon suggestion of your office, I have also included a stamped self-
addressed envelope to further aid your office in sending me a timely response.

Dear Mr. Dorney:
In response to your letter dated January 16, 2001, the attached Preconstruction
Notification and impact map reflects changes made to the site plan to reduce the
impacts on site. Specifically, the area shown as Crossing 3 on the attached
impact map will utilize an open bottomed culvert. The open bottomed culvert will
span from high ground to high ground to avoid impacting any channel or wetland
areas.
Due to this revision only the use of nationwide permits 14 and 18 are requested
to cover impacts to jurisdictional wetlands and surface waters (i.e. stream
channels) for the subject property. The impacts for this project will total 165
linear feet and 0.0585 acres of wetland. A Pre-construction Notification Form is
attached.

The proposed work for Carthage Colonies includes the construction of roads
required to access the property and the construction of a dam and its subsequent
pond. The construction will employ the use of mechanical equipment typically
used to complete such work.
13. Purpose of proposed work: The roads will provide access to the property and a
connection between Carthage Street and Fire Tower Road.
14. State reasons why it is believed that this activity must be carried out in wetlands
(include any measures taken to minimize wetland impacts): The applicant
requested a delineation of wetlands present on the property prior to site plan
development in order to avoid jurisdictional wetlands to the maximum extent
practicable Impacts 1 and 2 (see attached impact map) impact waters of the
U.S. in order to provide access to the individual proposed home lots on the
property Impact 4 is due to a dam placed on a channel which is required to
create the pond The wetlands within the proposed pond make up impact 5 and
due to the close proximity to the channel are unavoidable if the pond is to be
built.
15. You are required to contact the U.S. Fish and Wildlife Service (USFWS) and/or
National Marine Fisheries Service (NMFS) (see agency addresses sheet) regarding
the presence of any federally listed or proposed for listing endangered or

On April 23, 2001 the Division of Water Quality (DWQ) was notified by receipt of your
applications regarding your plan to fill wetlands for the purpose of constructing the Cartilage
Colonies subdivision in Lee County. Approval from DWQ is required to disturb these wetlands.
Please provide seven copies of the following information and refer to the DWQ # listed above in
your reply. In particular as described in 15A NCAC 2B .0502, we will require you to discuss how
lots 69 and 70 are buildable without fill. Please show these buildable envelopes on maps of
suitable scale (for instance 1" = 100 feet) so we can begin to determine your projects' compliance
with 15A NCAC 2H .0500.
Please call me at (919) 733-1786 if you have any questions or would require copies of our
rules or procedural materials. This project will remain on hold as incomplete in accordance with
15A NCAC 2H .0505(c). The processing time for this application will begin when this
information is received. If we do not hear from you by writing within three (3) weeks we will
assume you no longer want to pursue the project and will consider it withdrawn.

The proposed work for Carthage Colonies includes the construction of roads
required to access the property and the construction of a dam and its subsequent
pond. The construction will employ the use of mechanical equipment typically
used to complete such work.
13. Purpose of proposed work: The roads will provide access to the property and a
connection between Carthage Street and Fire Tower Road.
14. State reasons why it is believed that this activity must be carried out in wetlands
(include any measures taken to minimize wetland impacts): The applicant
requested a delineation of wetlands present on the property prior to site plan
development in order to avoid jurisdictional wetlands to the maximum extent
prapticable Impacts 1 and 2 (see attached impact map) impact waters of the
U.S. in order to provide access to the individual proposed home lots on the
property. Impact 4 is due to a dam placed on a channel, which is required to
create the pond The wetlands within the proposed pond make up impact 5 and
due to the close proximity to the channel are unavoidable if the pond is to be
built.

In response to your letter dated January 16, 2001, the attached Preconstruction
Notification and impact map reflects changes made to the site plan to reduce the
impacts on site. Specifically, the area shown as Crossing 3 on the attached
impact map will utilize an open bottomed culvert. The open bottomed culvert will
span from high ground to high ground to avoid impacting any channel or wetland
areas.
Due to this revision only the use of nationwide permits 14 and 18 are requested
to cover impacts to jurisdictional wetlands and surface waters (i.e. stream
channels) for the subject property. The impacts for this project will total 165
linear feet and 0.0585 acres of wetland. A Pre-construction Notification Form is
attached.

U.S. in order to provide access to the individual proposed home lots on the
property. Impact 4 is due to a dam placed on a channel which is required to
create the pond The wetlands within the proposed pond make up impact 5 and
due to the close proximity to the channel, are unavoidable if the pond is to be

On behalf of Homes by Huff , a division of Crossman Communities of NC
(property owner), we request authorization to use Nationwide Permits 14, 18, and
39 to cover impacts to jurisdictional wetlands and surface waters (i.e. stream
channels) for the subject property. A Pre-construction Notification Form is
attached.
The proposed residential subdivision, Carthage Colonies, consists of the
construction of houses and their required roads and utilities as well as the
construction of a pond. The 195 -acre property is located south of Sanford on
Fire Tower Road (SR 1152) approximately 1.1 miles north of its intersection with
Highway 78 in Lee County, NC (see attached USGS site vicinity map).
The property contains approximately 7 acres of bottomland hardwood and
ephemeral jurisdictional wetlands of which 0.0894-acre and 217 linear feet
(including 61 feet of unimportant channel) will be impacted by construction of the
residential community. Of the total acreage of impacts, 0.0197 acres (this total
includes acreage of important and unimportant channel impacts) are road
impacts (NWP14), 0.0109 acres are due to other road impacts (NWP 39), and
0.0588 acres are impacts due to a pond (0.0028 acres due to channel impact of
the dam and 0.056 acres of wetland impact from flooding)(NWP 18). Of the total
channel impacts, 64 linear feet of impacts to an "important" stream channel and
61 linear feet of impacts to an "unimportant" stream channel are due to the road
crossing utilizing NWP 14. An additional road crossing with 52 linear feet of

channel impact will require the use of Nationwide Permit 39. Nationwide Permit
18 will be utilized to cover the 40 linear feet of channel impacts associated with
the constructed pond. It is the understanding of S&EC that flooded stream
channel is not considered an impact.
The applicant requested a delineation of wetlands present on the property prior
to site plan development in order to avoid jurisdictional wetlands to the maximum
extent practicable. Impacts 1, 2, and 3 (see attached impact map) impact waters
of the U.S. in order to provide access to the individual proposed home lots on the
property. The road associated with impacts 1 and 2 is required to connect the
existing Fire Tower Road with the existing Carthage Street. Impact 4 is due to a
dam placed on a channel, which is required to create the pond. The wetlands
within the proposed pond make up impact 5 and due to the close proximity to the
channel, are unavoidable if the pond is to be built. The pond will be used for
recreation as well as a stormwater treatment structure.
The perpendicular crossing distances associated with the requested Nationwide
Permit 14 total 40 feet (i.e. less than 200 feet) and the associated acreage of the
crossing equals 0.0197 acres (i.e. less than 1/3 acre).
Several acres of protective greenspace have been left along both sides of
Persimmon Creek and along the unnamed creek as it exits the proposed pond.
S&EC, Inc. does not believe that any wetland mitigation will be required. If for
some reason however mitigation is required, our client proposes payment into
the North Carolina Wetland Restoration Program.
At this time neither the N.C. Division of Water Quality (DWQ) nor the U.S. Army
Corps of Engineers have been on site. If a site visit is required, please contact
our office so that one can be scheduled.

The Division of Water Quality has reviewed your plans for the discharge of fill material into 0.087
acres of wetlands and 217 linear feet of streams located at SR 1152 near NC 78 in Lee County for
residential development (Carthage Colonies) as described in your application dated December 13, 2000.
Insufficient evidence is present in our files to conclude that your project must be built as planned in waters
and/or wetlands in accordance with 15A NCAC 2H .0506. Therefore, unless modifications of the proposal
are made as described below, we will have to move toward denial of your 401 Certification as required by
15A NCAC 2H .0507(e) and will place this project on hold as incomplete until we receive this additional
information, we are requesting (by copy of this letter) that the U.S. Army Corps of Engineers place your
project on administrative hold.
Please provide us with information supporting your position that states your project must be
constructed as planned and that you have no practicable alternative to placing fill in these waters and/or
wetlands. Specifically can you realize the road network to eliminate crossing number 3 with cul-de-sacs?
Any documentation suchas maps an narrative at you can supp y to address alternative designs for your
project may be helpful in our review of your 401 Certification.
Please respond within three weeks of the date of this letter by sending a copy of this information to
me and to Matt Flynn, of the Raleigh Regional Office at (919) 571-4700. If we do not hear from you in
three weeks, we will assume that you no longer want to pursue this project and we will consider the project

In response to your letter dated January 16, 2001, the attached Preconstruction
Notification and impact map reflects changes made to the site plan to reduce the
impacts on site. Specifically, the area shown as Crossing 3 on the attached
impact map will utilize an open bottomed culvert. The open bottomed culvert will
span from high ground to high ground to avoid impacting any channel or wetland
areas.
Due to this revision only the use of nationwide permits 14 and 18 are requested
to cover impacts to jurisdictional wetlands and surface waters (i.e. stream
channels) for the subject property. The impacts for this project will total 1,65
linear feet and 0.0585 acres of wetland. A Pre-construction Notification of rm is

The proposed work for Carthage Colonies includes the construction of roads
required to access the property and the construction of a dam and its subsequent
pond. The construction will employ the use of mechanical equipment typically
used to complete such work.
13. Purpose of proposed work: The roads will provide access to the property and a
connection between Carthage Street and Fire Tower Road.
14. State reasons why it is believed that this activity must be carried out in wetlands
(include any measures taken to minimize wetland impacts): The applicant
requested a delineation of wetlands present on the property prior to site plan
development in order to avoid jurisdictional wetlands to the maximum extent
practicable. Impacts 1, and 2 (see attached impact map) impact waters of the
U.S. in order to provide access to the individual proposed home lots on the
property. Impact 4 is due to a dam placed on a channel, which is required to
create the pond. The wetlands within the proposed pond make up impact 5 and
due to the close proximity to the channel, are unavoidable if the pond is to be
built.

In response to your letter dated January 16, 2001, the attached Preconstruction
Notification and impact map reflects changes made to the site plan to reduce the
impacts on site. Specifically, the area shown as Crossing 3 on the attached
impact map will utilize an open bottomed culvert. The open bottomed culvert will
span from high ground to high ground to avoid impacting any channel or wetland
areas.
Due to this revision only the use of nationwide permits 14 and 18 are requested
to cover impacts to jurisdictional wetlands and surface waters (i.e. stream
channels) for the subject property. The impacts for this project will total 165
linear feet and 0.0585 acres of wetland. A Pre-construction Notification Form is
attached.

Dear Mr. Dorney:
In response to your letter dated January 16, 2001, the attached Preconstruction
Notification and impact map reflects changes made to the site plan to reduce the
impacts on site. Specifically, the area shown as Crossing 3 on the attached
impact map will utilize an open bottomed culvert. The open bottomed culvert will
span from high ground to high ground to avoid impacting any channel or wetland
areas.
Due to this revision only the use of nationwide permits 14 and 18 are requested
to cover impacts to jurisdictional wetlands and surface waters (i.e. stream
channels) for the subject property. The impacts for this project will total 165
linear feet and 0.0585 acres of wetland. A Pre-construction Notification Form is
attached.

required to access the property and the construction of a dam and its subsequent
pond. The construction will employ the use of mechanical equipment typically
used to complete such work.
13. Purpose of proposed work: The roads will provide access to the property and a
connection between Carthage Street and Fire Tower Road.
14. State reasons why it is believed that this activity must be carried out in wetlands
(include any measures taken to minimize wetland impacts): The applicant
requested a delineation of wetlands present on the property prior to site plan
development in order to avoid jurisdictional wetlands to the maximum extent
practicable. Impacts 1, and 2 (see attached impact map) impact waters of the
U.S. in order to provide access to the individual proposed home lots on the
property. Impact 4 is due to a dam placed on a channel, which is required to
create the pond. The wetlands within the proposed pond make up impact 5 and
due to the close proximity to the channel, are unavoidable if the pond is to be
built.

Dear Mr. Dorney and Mr. Thomas:
On behalf of Homes by Huff , a division of Crossman Communities of NC
(property owner), we request authorization to use Nationwide Permits 14, 18, and
39 to cover impacts to jurisdictional wetlands and surface waters (i.e. stream
channels) for the subject property. A Pre-construction Notification Form is
attached.
The proposed residential subdivision, Carthage Colonies, consists of the
construction of houses and their required roads and utilities as well as the
construction of a pond. The 195 -acre property is located south of Sanford on
Fire Tower Road (SR 1152) approximately 1.1 miles north of its intersection with
Highway 78 in Lee County, NC (see attached USGS site vicinity map).
The property contains approximately 7 acres of bottomland hardwood and
ephemeral jurisdictional wetlands of which 0.0894-acre and 217 linear feet
(including 61 feet of unimportant channel) will be impacted by construction of the
residential community. Of the total acreage of impacts, 0.0197 acres (this total
includes acreage of important and unimportant channel impacts) are road
impacts (NWP14), 0.0109 acres are due to other road impacts (NWP 39), and
0.0588 acres are impacts due to a pond (0.0028 acres due to channel impact of
the dam and 0.056 acres of wetland impact from flooding)(NWP 18). Of the total
channel impacts, 64 linear feet of impacts to an "important" stream channel and
61 linear feet of impacts to an "unimportant" stream channel are due to the road
crossing utilizing NWP 14. An additional road crossing with 52 linear feet of

channel impact will require the use of Nationwide Permit 39. Nationwide Permit
18 will be utilized to cover the 40 linear feet of channel impacts associated with
the constructed pond. It is the understanding of S&EC that flooded stream
channel is not considered an impact.
The applicant requested a delineation of wetlands present on the property prior
to site plan development in order to avoid jurisdictional wetlands to the maximum
extent practicable. Impacts 1, 2, and 3 (see attached impact map) impact waters
of the U.S. in order to provide access to the individual proposed home lots on the
property. The road associated with impacts 1 and 2 is required to connect the
existing Fire Tower Road with the existing Carthage Street. Impact 4 is due to a
dam placed on a channel, which is required to create the pond. The wetlands
within the proposed pond make up impact 5 and due to the close proximity to the
channel, are unavoidable if the pond is to be built. The pond will be used for
recreation as well as a stormwater treatment structure.
The perpendicular crossing distances associated with the requested Nationwide
Permit 14 total 40 feet (i.e. less than 200 feet) and the associated acreage of the
crossing equals 0.0197 acres (i.e. less than 1/3 acre).
Several acres of protective greenspace have been left along both sides of
Persimmon Creek and along the unnamed creek as it exits the proposed pond.
S&EC, Inc. does not believe that any wetland mitigation will be required. If for
some reason however mitigation is required, our client proposes payment into
the North Carolina Wetland Restoration Program.
At this time neither the N.C. Division of Water Quality (DWQ) nor the U.S. Army
Corps of Engineers have been on site. If a site visit is required, please contact
our office so that one can be scheduled.

The proposed work for Carthage Colonies includes the construction of roads
required to access the property and the construction of a dam and its subsequent
pond. The construction will employ the use of mechanical equipment typically
used to complete such work.

connection between Carthage Street and Fire Tower Road.
14. State reasons why it is believed that this activity must be carried out in wetlands
(include any measures taken to minimize wetland impacts): The applicant
requested a delineation of wetlands present on the property prior to site plan
development in order to avoid jurisdictional wetlands to the maximum extent
practicable. Impacts 1, 2, and 3 (see attached impact map) impact waters of the
U.S. in order to provide access to the individual proposed home lots on the
