Center Street Lexington, NC 27292 Subject: Pretreatment Review of Enforcement Response Plan (ERP) City of Lexington - NPDES Number NCO055786 Davidson County Dear Ms. Minerali, The Pretreatment, Emergency Response, and Collection Systems Unit (PERCS) of the Division of Water Resources has reviewed the updated Enforcement Response Plan (ERP) for the City of Lexington. The updated ERP was in response to the Dental Amalgam Rule (40 CFR 441) and was received by the Division on February 3, 2020. The review indicates that the ERP is adequate and meets the requirements of 15A NCAC 02H .0905 and 40 CFR 403.8 (f)(5). Proper implementation is also required by the City's NPDES permit. The Division expects you to follow this approved ERP for all enforcement actions. Modifications to this ERP must be approved by the Division.
