APPROVAL of 401 Water Quality Certification
Dear Mr. Enoch:
You have our approval, in accordance with the attached conditions, to dredge and fill material 0.011 acre
of wetlands in order to install a travel lift slip in place of an existing boat ramp on your property in Washington
County, as described in your application received by the Division of Water Quality on October 12, 2000. After
reviewing your application, we have determined that this fill is covered by General Water Quality Certification
Number 3274. This Certification allows you to use your CAMA Permit when it is issued by the NC Division of
Coastal Management. In addition, you should get any other federal, state or local permits before you go ahead with
your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply
Watershed regulations. Also this approval will expire when the accompanying CAMA Permit expires unless
otherwise specified in the General Certification. This Certification replaces the one issued to you on December 11,
2000.
This approval is only valid for the purpose and design that you described in your application. If you
change your project, you must notify us and you may be required to send us a new application for a new
certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter
and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the
future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For
this approval to be valid, you must follow the conditions listed in the attached certification and the additional
conditions listed below:
1. Any and all maintenance on motors must be performed in an enclosed area with a roof to protect the area
from hydrocarbon runoff. Maintenance may be performed on motors left in the boat if there is no
discharge of pollutants into Waters of the State.
2. If any maintenance is performed in the open, a bermed and concreted area must be used with an oil/water
separator. It should be noted that the oil/water separator may require an NPDES (Non-Point Discharge
Elimination System) Permit for the effluent discharge,
3. No sand blasting may be performed over the water. Sand blasting must be performed in an area which can
contain any discharge or drift,

SPCC is the acronym for "Spill Prevention, Control, and Countermeasure"
plan. It is required by the federal gov. (EPA) for any facility which
stores >550 gallons (combined) of pertroleum products. A plan must be in
place and accessable to spill responders (DWQ) in the event of a spill.
I have accompanied the EPA on numerous occasions to do compliance
inspections on these facilities. In 1998 I spent 3 days with an EPA
inspector inspecting marine facilities on the Outer Banks. We inspected
37 facilities, 36 were in violation, 7 were discharging petroleum
products into the streams at the time of the inspection. We have told
the EPA that we will be there "eyes" and notify them of any facilities
in violation. Part of the inspection form for NPDES facilities includes
a section which requests info. as to whether a SPCC plan is in place. We
(WaRO) have told the EPA that we will put the requirement into the 401
conditions (since it is wq related) for new marinas and/or marine repair
facilities. This regulation is codified at 40 CFR Part 112 . It was
implemented in 1974 under the authority of Section 311 of the 1970
FWPCA. The coastal area is regulated under OPA '90 (Oil Pollution Act of
1990) which the USCG is the regulatory authority.
This is just a little history in case you need it. The WaRO and the WiRO
have put this in conditions before.

8. PROJECT SUMMARY: The applicant proposes to install a travel lift slip in place of an existing boat
ramp. The travel lift slip will be used to haul out boats for maintenance and repair. The slip will be
18' wide x 45' long with an average final depth of 6'. A 3' x 20' filled travel lane will be constructed
on on each side of the slip.

Project Setting
The project site is located at the end of SR 1322 on Kendrick Creek (Mackeys Creek) in the
Mackeys Community near Roper, North Carolina. A ±40 slip Marina exist onsite with a marina store,
storage buildings and two functioning boat ramps. A large graveled area adjacent the creek serves
as a parking area for new and used boats for sale. A wooded wetland exist upstream and downstream
adjacent to the developed marina property. The area is vegetated with upland grasses and scattered
loblolly pine trees. A large basin is located on the northwest side of the property. The basin is a
result of efforts to dig a large boat basin authorized under CAMA Major Permit No. 23-89. The
basin has not been connected to the creek due to complications resulting from woody material in the
basin that continually expands and surfaces rendering it unsuitable for navigation.
Kendrick Creek is classified as SC by the Environmental Management Commission.
Project Description
The applicant proposes to excavate an existing boat ramp in order to construct an 18' wide
by 45' long travel lift slip. The travel lift slip will be utilized to haul out boats for maintenance and
repairs. The existing concrete boat ramp will be removed and an area 18'x 45' will be excavated of
which 18' x 20' will be below the normal water level. Excavation of the creek bottom will be
landward of the 7' contour creating an average depth of 6' in the slip with depths at the landward
edge of the slip to be 5'. A total of 54.4 cubic yards of material will be removed below and 131.3
cubic yards above the normal water level. The three sides of the travel lift slip will be bulkheaded.
Two filled travel lanes will be constructed on opposite sides of the slip out into the creek by boxing
in an area Y x 20' using driven pilings, lapped wood bulkhead and whalers. The travel lanes will then
be filled with soil then capped with concrete. A 2'x 45' piece of channel iron will be bolted to the
concrete to provide support and provide a track for the travel lift tires. A ±15' x ±60' concrete drive
is proposed from the terminus of SR 1322 to the proposed slip.
Project Impacts
A total of 360 ft2 of creek bottom will be excavated that was previously impacted by a boat
ramp. The travel lanes will result in the filling of 120 ftz of creek bottom. Approximately 450 ftz of
uplands will be excavated. The excavation of the slip, installation of the bulkhead and travel lanes
will result in short term localized turbidity. There will be an increase in surface run off resulting from
the day to day activities of hauling and maintaining large boats.

Re: CAMA Permit for Mackeys Landing Marina
Dear Mr. Trowell:
Mackeys Landing Marina is submitting all requested information for a CAMA permit to
construct a proposed traveling boatlift. There is an existing inland basin available to this
site; however, this basin is built in an area which was once filled with sawdust. This
causes two major problems in using this area for a boatlift. The first is each time the basin
is cleaned out to the regional depth the sawdust material swells and fills the basin again.
Also to access this basin, heavy equipment would have to travel over this same type
material which will fail under heavy loading.
The owners are wanting to remove an existing concrete boat ramp to construct the
proposed traveling boatlift. To complete this project 65 LF of wooden bulkhead will be
constructed inland of the normal water level. Approximately 150 cubic yards of highland
material will be excavated in this area to construct the bulkhead. Once past the existing
shoreline, two finger piers are to be constructed using driven pilings, lapped wood
bulkhead and whalers. These finger piers will be filled with soil to a point and then capped
with concrete. This fill is within the public trust waters and equals approximately 17.28
cubic yards. An additional 6.17 cubic yards of fill including the concrete cap and will be
used to complete the finger piers. A total of 23.45 cubic yards will be used for this
construction. This area, as well as the proposed bulkhead, will serve as travel lanes for a
traveling boat lift. Also there are existing wetlands on the property; however, they are not
adjacent to the project area.
The excavation waterward of the natural water level is estimated to be approximately1 9 6.3 5
cubic yards. No excavation shall be deeper than the point in the basin where the
excavation begins. The remainder of the facility has been shown on the plans prepared for
Mackeys Landing Marina by Jarvis Associates, PA dated September 28, 2000.

Dear Mr. Huggett:
Reference the application of Mackeys Landing Marina for a Department of the Army (DA)
permit to install a travel lift in place of an existing boatramp, on property located off State Road
1322, adjacent to Kendrick Creek, near the Community of Roper, in Washington County, North
Carolina.
The Federal agencies have completed review of the proposal as presented by the application
and your field investigation report.
We recommend that the following conditions be included in the State authorization:
1. All work authorized by this permit must be performed in strict compliance with the
permit plans, which are a part of this permit.
2. The permittee understands and agrees that, if future operations by the United States
require the removal, relocation, or other alteration, of the structure or work herein authorized, or
if, in the opinion of the Secretary of the Army or his authorized representative, said structure or
work shall cause unreasonable obstruction to the free navigation of the navigable waters, the
permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate, or
alter the structural work or obstructions caused thereby, without expense to the United States. No
claim shall be made against the United States on account of any such removal or alteration.
3. No excavated or fill materials will be placed at any time in any vegetated wetlands or
waters.

4. The temporary placement or double handling of excavated or fill materials within waters
or vegetated wetlands is not authorized.

Dear Mr. And Ms. Enoch:
You have our approval. in accordance with the attached conditions, to dredge and fill material 0.011 acre of wetlands in order to
install a travel lift split in place of an existing boat ramp on your property in Washington County, as you described in your application
dated October 12, 2000. After reviewing your application, we have decided that this fill is covered by General Water Quality
Certification Number 3274. This Certification allows you to use Nationwide Permit Number YYYYY when the Corps of Engineers
issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not
limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this
approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General
Certification. This Certification replaces one issued to you on December 11, 2000.
This approval is only valid for the purpose and design that you described in your application. If you change your project, you
must notify us and send us a new application. If the property is sold, the new owner must be given a copy of this Certification and
approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future)
exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you
must follow the conditions listed in the attached certification. This approval shall expire when the corresponding Nationwide Permit
expires or as otherwise provided in the General Certification.
1. Any and all maintenance on motors must be performed in an enclosed area with a roof to protect the area from
hydrocarbon runoff. Maintenance may be preformed on motor left in the boat if there is no discharge of pollutants
into Water of the State,
2. If any maintenance is performed in the open, a bermed and concreted area must be used with a oil/water separator. If
should be noted that the oil/water separator may require an NPDES (Non-Point Discharge Elimination System)
Permit for the effluent discharge,
3. No sand blasting may be performed over the water. Sand blasting may be performed over an area which ca contain
any discharger or graft.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60
days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 1508 of the North
Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 276 1 1-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you have any
