Your supplemental information for a 401 Water Quality Certification was received in the Central
Office on October 16, 2000. According to our rules [15A NCAC 2H .0507(a)], if final action is not taken
within 60 days, the Certification is waived unless DWQ has objected in writing to your application.
Therefore, DWQ has waived the requirement for a 401 Water Quality Certification for your plans to impact
0.4 acres of wetlands for commercial development as described in your application dated October 6, 2000.
However if additional impact occurs or your development plans change, this waiver is no longer valid and a
401 Water Quality Certification will be required.

On October 16, 2000, the NC Division of Water Quality (DWQ) received your revised application for a
401 Water Quality Certification for the proposed Whiteville Towne Centre development in Columbus County.
In accordance with 15A NCAC 2B .0233, a thorough inspection of the site has been conducted by staff of the
DWQ Wilmington Regional Office. The additional information provided in your revised application does not
specifically address avoidance and minimization of wetland impacts on the property. We strongly suggest that
you re-design the project to pursue alternatives to the proposed filling of wetlands in the outparcel.
Furthermore, please note that the proposed stormwater pond with a littoral shelf will not replace the functions
and values of the 0.4 acres of wetlands you propose to fill. We maintain that the existing wetland could be
incorporated into your stormwater management plan, thereby reducing wetland impacts and improving
stormwater treatment. It may also be helpful for you to provide copies of any your correspondence with the
Department of Transportation pertaining to traffic issues in the vicinity of this project. Unless the proposed
project is re-designed to minimize wetland impacts, or compelling evidence is provided to demonstrate the
avoidance and minimization of wetland impacts, specifically in the outparcel, we will move toward denial of
the 401 Certification as required by 15A NCAC 2H .0507(e).
Until the information requested in this letter is provided, I will request (by copy of this letter) that the
Corps of Engineers place this project on hold. Also, this project will be placed on hold for our processing due

This letter serves as a response to your letter to Whiteville (E&A) LLC dated September 12, 2000. Our
office has reviewed the construction drawings along with your letter in order to determine the feasibility of
moving the three-way access drive off J.K Powell Boulevard into the proposed shopping center closer to the
intersection of J.K. Powell Boulevard and Love Mill Road. There is a grassed median in J.K. Powell
Boulevard that the NCDOT would like to maintain. Moving the three-way access drive in a southerly
direction past the wetland area would remove about 180 feet of the grassed median.and would further
complicate and restrict the traffic pattern near the intersection of J.K. Powell Boulevard with Love Mill
Road (SR 1432). Much attention has been given to this project regarding traffic congestion problems in this
area of J.K. Powell Boulevard. The City of Whiteville Rezoning Board as well as the City Council spoke at
great length to our firm as well as the developer as to the importance of maintaining uninterrupted traffic
flow on J.K. Powell Boulevard. As a result of the strict guidelines set forth by both the City of Whiteville
and NCDOT, the developer will be responsible for lane widening that will occur on both sides of J.K.
Powell Boulevard and on the northern side of Love Mill Road (SR 1432) to ensure that traffic flow will be
maintained on both streets. Traffic congestion and flow are also affected by the location of access drives. If
the three-way access drive (Drive A) on J.K. Powell Boulevard is moved in a southerly direction, this will
become the only access to the proposed shopping center off J.K. Powell Boulevard. This would be right
turn-in, right turn-out only, and would not be sufficient to maintain the desired traffic flow into and out of
the center or to maintain the desired traffic flow along J.K. Powell Boulevard according to the NCDOT
review and recommendations.
The proposed development will disturb about 17,500 square feet of existing wetlands. However, the
development will be creating approximately ## acres of open water and ## acres of wetlands (specifically
the littoral/wetland shelf area) by means of the proposed stormwater detention/retention pond. The
stormwater detention/retention pond has been designed as a wet pond. The upper portion of the
detention/retention pond will serve as a marsh area (littoral shelf), with water depths averaging less than
one foot under low-intensity rainfall events. The lower portion of the detention/retention pond will
remain wet (open water), having an average water depth of up to 5.5 feet at the lowest point in the
detention/retention pond. We have designed the grade of the detention/retention pond such that, at the
point the main stormwater system enters the pond into the sediment forebay, there is about 150 feet of
length at 2.00% slope and an additional 50 feet of length at 4.00% slope for the stormwater to flow along
to the lower portion of the detention/retention pond where the sediments can settle out of the stormwater.
At the lower portion of the pond, the stormwater will accumulate to a depth of approximately 5.5 feet
before water exits the pond through an outlet structure. During this time of accumulation, sediments can
settle to the bottom of the pond while the upper water levels, which will be exiting the pond through the
outlet structure, will be of higher quality. A further measure for sediment control in the rip rap filter
berm placed in front of the outlet structure to help filter water before it enters the outlet structure.
Stormwater reaching elevation 76.50 or higher will filter through the rip rap berm, further assisting in
sediment trapping. Please refer to the enclose plan for clarity regarding the scenarios I have described in
this response.

LLC, is submitting the necessary supportive documentation for the issuance of a 401
Water Quality Certification to impact 0.4 acre of wetlands on the Whiteville Towne
Centre development site in Columbus County, North Carolina. This letter is intended to
address all of your concerns regarding the proposed Whiteville Towne Centre
development in your letter dated September 12, 2000.
The Proposed Grading and Storm Drainage Plan is designed to optimize public safety and
improve the water quality benefits of existing low quality on-site wetlands (Wetland A
and B) through their replacement with a 0.97 acre wet detention pond/stormwater
wetland area and a grassed swale approximately 735 linear feet long (Appendix A -
Sheet 1). This wet detention/stormwater wetland area is located along the northwestern
property boundary and will be designed according to Stormwater BMPs outlined by the
North Carolina Department of Environment and Natural Resources (NCDENR)l. A
completed DWQ - 401 Wet Detention Basin Worksheet has been included as Appendix
C. An Operation and Maintenance Plan outline has been included as Appendix D.

Traffic Safety Issues
The location and characteristics of the driveways onto this site have been dictated by a
number of elements beyond the control of our client. Driveway A, located off of J.K.
Powell Boulevard (US 701), is intended to be the major ingress/egress into the
development and its proposed location is dictated by the current traffic conditions
associated with the intersection of J.K. Powell Boulevard and Love Mill Road, a grassed
median along J.K. Powell Boulevard, outparcels A and B along J.K. Powell Boulevard,
and the orientation of the facility fronting J.K. Powell Boulevard. Driveway A has been
designed as a full service (i.e., right and left turning capable) entrance and exit onto the
site. Safety issues raised by the North Carolina Department of Transportation (NCDOT)
and City of Whiteville at the intersection of J.K. Powell Boulevard (US 701) and Love
Mill Road (SR 1432) have dictated the placement of the driveways off of J.K. Powell
Boulevard in their respective locations to allow safe ingress and egress to the site.
Wetland Evaluations
Following a conversation between you and our Mr. Jeff Holland, the two on-site wetland
areas were evaluated utilizing the North Carolina Department of Environment and
Natural Resources (NCDENR) Guidance for Rating the Values of Wetlands in North
Carolina 2. The evaluation and ratings of the two on-site wetland areas were based on:
• Water Storage
• Bank/Shoreline Stabilization
• Pollutant Removal
• Wildlife Habitat
• Aquatic Life Value
• Recreation and Education
The on-site wetland areas were classified as ephemeral wetlands based on their small size
and dependence on rainfall as a primary source of hydrology (Appendix B - Wetland
Rating Worksheet). These areas are primarily dominated by black oak (Quercus nigra),
sweetgum (Liquidambar styraciflua), red maple (Acer rubrum), tulip poplar
(Liriodendron tulipifera), Baccharis (Baccharis halmifolia), and Chinese privet

(Ligustrum sinense). All of these species are considered facultative and indicative of
marginal wetland environments. These areas appear to have been formed by the
redirection of off-site stormwater runoff for adjacent parcels. These areas do not
represent good potential for use as a stormwater wetland area based on their limited water
storage ability due to their small size and shallow depth, and the presence of invasive
species. The proposed wet detention/stormwater wetland plantings are expected to
exceed the current rating of the on-site low quality wetland areas by providing increased
flood attenuation, establishing native vegetation, and an increased ability to filter
stormwater.
The on-site wetland areas rated a 22 out of a possible 100 points. The primary reason for
the low ratings score include:
• Limited water storage capabilities based on size and
lack of good microtopographic relief.
• The lack of a connection to any significant surface
water feature and/or lack of significant ground
water inputs.
• The species composition of these wetland areas are
primarily dominated by weedy species such as
Chinese privet and Baccharis that provide limited
food and cover to wildlife and restrict the
establishment of native wetland vegetation.
• The presence of raw sewage within Wetland B due
to an upgradient leech field.
Due to the low quality of the existing wetlands, it is our understanding that the proposed
wet detention/stormwater created system can be engineered to provide a greater water
quality benefit than the existing on-site wetland areas. Specific water quality benefits
anticipated include:
• Wetland B is currently receiving sewage from a
leech field located upgradient. This potential source
of pollution to downstream waters will be
eliminated.
• Currently stormwater is being routed from the
Quick Stop Food Mart into the 0.128-acre Wetland

A. This stormwater is not being properly treated
due to the limited size and water-holding capacity
of Wetland A. This area will be replaced with a
larger wet detention area capable improved water
quality treatment.
To compensate for the loss of approximately 0.40 acre of wetlands, a 0.32 acre vegetated
littoral shelf capable of removing a variety of surface water pollutants will be created
along the slopes of the wet detention/stormwater wetland. In addition to the littoral shelf,
approximately 0.08 acre of open water habitat is expected to be created through the
construction of this system.
The shelf will be vegetated and have a shallow 6:1 slope that provides adequate zones for
the establishment of wetland vegetation. Detailed plan and profile views of this pond
have been included as (Appendix A - Sheet 2). In addition to the wet
detention/stormwater wetland, a grassed Swale will be created to treat off site stormwater
coming onto the site from adjacent commercial developments. The existing ditch along
the western property boundary will be engineered and regraded into a grassed swale.
This grassed swale will have shallow side slopes, a gentle bottom grade, and various
check dams. Specific benefits of this swale include pollutant and sediment removal and
increasing the flood storage capacity of the existing ditch.
It is believed that the proposed storm water management plan provides effective
mitigation for any current function and values found within the existing low quality
wetlands and provides for a more environmentally sensitive means to dealing with the
current source of pollution to downstream waters, as well as being able to effectively
treat any off-site storm water that is currently being ditched onto the project site. This
proposed plan is being submitted to help ensure that the activities proposed would have
only minimum adverse effects on the aquatic environment and it shows that the applicant
is committed to mitigating for the function and value of the existing wetlands due to
unavoidable impacts. Thank you for your consideration of the eligibility of this project
as proposed for authorization under section 401 for the Water Quality Certification.

On August 4, 2000, the NC Division of Water Quality (DWQ) received your application for a
401 Water Quality Certification to impact 0.4 acre of wetlands in order to construct the Whiteville
Towne Centre in Columbus County. In accordance with 15A NCAC 2H.0506, a thorough
inspection of the site has been conducted by staff of the DWQ Wilmington Regional Office. Based
on this review, along with your application materials, we have determined that insufficient
evidence has been provided to conclude that your project must be built as planned. Specifically,
can the crossing off J.K. Powell Boulevard be relocated to uplands to avoid the wetland impact?
Furthermore, have you investigated incorporating these wetlands into your stormwater
management plan? Unless modifications of the proposal are made, or compelling evidence is
provided to demonstrate the avoidance and minimization of wetland impacts, we will move toward
denial of the 401 Certification as required in 15A NCAC 211.0507(e).
Until the information requested in this letter is provided, I will request (by copy of this letter)
that the Corps of Engineers place this project on hold. Also, this project will be placed on hold for
our processing due to incomplete information (15A NCAC 2H.0507(h)).

area- The entrance off J.K. Powell Blvd_ could be relocated to uplands and avoid the weland

Engineering Consulting Services, Ltd. (ECS) on behalf of our client Whiteville (E&A), LLC, would like
to request that an NWP 39 be issued for the proposed impacts with no additional mitigation conditions
attached for losses of two low quality wetland areas located on the subject site. The function of these
areas will be offset and mitigated with the development of a comprehensive storm water management
plan.
Avoidance/Minimization
After extensive searches within the local land market over the past two years and having to walk away
from several other sites in the area due to issues including but not limited to environmental impacts,
Whiteville (E&A), LLC has purchased an approximate 15-acre site to develop a Necessity Retail Center
and Food Store located at the intersection of Highway 701 By-Pass and Love Mill Road, in Whiteville,
North Carolina. The proposed development footprint has been downsized considerably to fit the
approximate 15-acre site being purchased and still meet the minimum requirements to ensure the center's
economic success.
Every consideration has been given to ensure this development is successful. The site was reengineered
and redesigned numerous times with the final design being submitted to the City of Whiteville and the
appropriate agencies for permitting. The civil engineers for the project have met numerous times with
the North Carolina Department of Transportation to ensure safe ingress and egress to the property. The
engineers have had to consider traffic patterns and access, balanced with the existing conditions, to
determine the safest location of the curb cuts and meet the Department of Transportation's requirements.
For the reasons discussed above, the scope and size of the project and the land available, it has not been
feasible or economical to exercise avoidance/minimization strategies for wetlands. It is anticipated that
the project development will result in unavoidable impacts to 0.398-acres of wetlands. A concerted and
coordinated planning effort.between ECS and Whiteville (E&A), LLC has culminated in the current site
plan, which minimized the development impacts to the maximum extent while still achieving the project
goals.
FunctionNalue & Mitigation
The non-alluvial wetland depressions located on the site consist of dominant vegetation that is comprised
of facultative species. These depressions are currently functioning as storm water retention areas for off-
site impervious surfaces (Figure 1). These wetland areas are of low quality and value and appear to be
supported mainly from the off-site storm water ditches that flow onto the site and accumulate in these
low-lying areas. The function of the present storm water retention, pollutant and sediment removal areas
(depressions) will be replaced by a proposed storm water management plan that will create a sediment
forbay followed by a stilling basin - wet pond. It is believed that the storm water management plan will
provide a more environmentally sensitive means to dealing with the off-site storm water currently being
ditched onto the project site.
To achieve project goals and to ensure that activities proposed would have only minimum adverse effects
on the aquatic environment, the applicant is hereby committed to providing mitigation for the function of
these wet depressions through the development of an on-site storm water management pond with a
sediment forbay followed by a stilling basin - wet pond. This would serve as a replacement for any
wetland functions that may be lost due to site development activities. Thank you for your consideration
of the eligibility of this project for authorization under NWP 39, with regard to additional mitigation
activities for these low quality wetland areas.
