After reviewing your application, we have decided that this action is covered by General Water Quality Certification Numbers 3287 and 3289. This certification allows you to use Nationwide Permit Numbers 39 and 14 when the Corps of Engineers issues them. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Water shed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed below and in the attached certification. 1. There shall be no direct discharge of a "green" associated with this project into any stream. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. The project is located in Catawba County, and is approximately shown on the attached site vicinity maps. The owners of the Course have been acquiring adjacent properties for approximately 2 years, and have contracted with the Robert Trent Jones Course Design Group to design and build a Championship Golf Course. The Course will utilize the existing "front nine" holes built in the early 1970's and the annexed properties to develop and expand the course and development. Nearly one dozen preliminary course layouts have been produced by the design group. The owners have chosen the plan that has the least amount of impacts to jurisdictional channels and vegetated wetlands. Alternative course designs have been abandoned that utilized a large tract of property purchased east of SR 1709. This plan would have required more extensive impacts to channels and approximately a5 acre of wetlands (see the attached maps that indicate abandoned course development). Additionally, avoidance and minimization has been achieved through the use of 10 separate bridge crossings as alternatives to culverts for road and cart crossings of jurisdictional channel. The project site was evaluated for the presence and extent of jurisdictional Waters of the U.S. by Wetland and Natural Resource Consultants. The delineation and extent of jurisdiction was field approved by Mr. Chapin on a November 16, 2000 site visit. No impacts to jurisdictional vegetated wetland are proposed. One road crossing under NW 14 is proposed as a complete and separate project for access to proposed residential expansion. The purpose of the pond is to create a "water hazard" for Hole #9 (par 3 hole located north of SR 1711). The footprint of the dam has been reduced to the smallest possible amount of hard impacts that will provide for the minimum surface water area desirable for this type of feature. The approximately 0.64 acre of surface water is offered as mitigation for the hard impacts. Additionally, the owner has agreed to the use of bridges instead of the originally proposed culverted cart crossings on this drain in order to avoid and minimize impacts. The owners of the Course have been acquiring adjacent properties for approximately 2 years, and have contracted with the Robert Trent Jones Course Design Group to design and build a Championship Golf Course. The Course will utilize the existing "front nine" holes built in the early 1970's and the annexed properties to develop and expand the course and development. Nearly one dozen preliminary course layouts have been produced by the design group. The owners have chosen the plan that has the least amount of impacts to jurisdictional channels and vegetated wetlands. Alternative course designs have been abandoned that utilized a large tract of property purchased east of SR 1709. This plan would have required more extensive impacts to channels and approximately 0.5 acre of wetlands (see the attached maps that indicate abandoned course development). Additionally, avoidance and minimization has been achieved through the use of 10 separate bridge crossings as alternatives to culverts for road and cart crossings of jurisdictional channel. The project site was evaluated for the presence and extent of juri sdictional Waters of the U. S. by Wetland and Natural Resource Consultants. The delineation and extent of jurisdiction was field approved by Mr. Chapin on a November 16, 2000 site visit. No impacts to jurisdictional vegetated wetland are proposed. One road crossing under NW 14 is proposed as a complete and separate project for access to proposed residential expansion.
